HomeMy Public PortalAboutOrdinance No. 2023-18 Granting FDOT Perpetual Easement Donation1st Reading/Public Hearing: 2"d Reading/Public Hearing: Adopted: Effective Date: Sponsored By: September 13, 2023 October 11, 2023 October 11, 2023 October 11, 2023 Interim City Manager ORDINANCE NO. 2023-18 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA, GRANTING THE FLORIDA DEPARTMENT OF TRANSPORTATION (FDOT) A PERPETUAL EASEMENT DONATION FOR PARCEL 800, WITHIN THE CITY; PROVIDING FOR INCORPORATION OF RECITALS; PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICT AND REPEALER; PROVIDING FOR SCRIVENER'S ERRORS; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Florida Department of Transportation ("FDOT") has identified Parcel 800 as property owned by the City of Opa-Locka Florida ("City") and, as a relevant part of one of their current and ongoing construction projects; and WHEREAS, pursuant to Sections 337.25 and 337.29, Florida Statutes, FDOT has requested that the City donate a perpetual easement of this parcel to FDOT for the purpose of constructing and maintaining a signal master arm, service disconnects, controller cabinets, concrete pad, pull boxes, wiring and conduits; and WHEREAS, Section 4.3 of the City of Opa-Locka' s Charter requires an Ordinance for the conveyance of land; and WHEREAS, the City Commission finds that it is in the best interests of the City and its residents to donate a perpetual easement of this parcel to FDOT, pursuant to composite Exhibit "A" and as described herein. NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA: SECTION 1. RECITALS ADOPTED. The recitals to the preamble herein are incorporated by reference. SECTION 2. AUTHORIZATION The City Commission of the City of Opa-Locka, Florida, hereby donates a perpetual easement of Parcel 800, within the City, to FDOT, pursuant to composite Exhibit "A" and as described herein. SECTION 3. SCRIVENER'S ERRORS Sections of this Ordinance may be renumbered or re -lettered and corrections of APPROVED AS TO FORM AND LEGAL SUFFICIENCY: Ordinance No. 2023-18 typographical errors, which do not affect the intent of this Ordinance may be authorized by the Interim City Manager, following review by the City Attorney, without need of public hearing, by filing a corrected copy of same with the City Clerk. SECTION 4. SEVERABILITY If any section, subsection, clause or provision of this Ordinance is declared invalid or unconstitutional by a court of competent jurisdiction, the remainder shall not be affected by such invalidity. SECTION 5. CONFLICT All sections or parts of sections of the applicable City of Opa-Locka ordinances currently in place in conflict herewith are intended to be rescinded and repealed to the extent of such conflict. SECTION 6. EFFECTIVE DATE This Ordinance shall, upon adoption, become effective as specified by the City of Opa-Locka Code of Ordinances and the City of Opa-Locka Charter and is subject to the approval of the Governor or Governor's Designee. Financial Impact - There is no immediate financial impact. There could be subsequent legal costs. Proposed Action: It is recommended the City Commission of the City of Opa-locka adopt legislation allowing the Florida Department of Transportation FDOT to construct a master arm signal to serve a pedestrian crosswalk across NW 27th Avenue. Vehicular, bicycle, and pedestrian traffic will be impacted. MAINTENANCE OF TRAFFIC During construction, temporary lane closures and detours will affect traffic. Pedestrian detours will be established with clear signage. Access to adjacent businesses and neighbourhoods will be maintained.
