Dement, J. Bootz, W. Sharp, J. Peterson, D. Gullicksen was absent. OTHERS PRESENT: Administrator - J. West Village Clerk - V. Krnac Attorney J. Harvey, Treasurer Geschke, H. Countryman, Officer Deering, R. Miller Bldg. Insp. - Mauer. At 7:30 p.m. Mayor Latta opened the meeting with the pledge to the flag. Roll call was taken, D. Gullicksen was absent. J. Bootz moved to approve the agenda with the addition of an Executive Session on personnel tv reconvene, requested by Mayor Latta, J. Bootz; for pending litigation requested by K. Callanan. When the meeting recanvenes, appointments to auxiliary Police, requested by J. Peterson. Seconded by K. Callanan. Voice vote. 5 yes, p no. Motion carried. W. Sharp moved to approve the minutes of September 3rd, 16th and October 7, 1985. Seconded by J. Dement. Voice vote. 5 yes, 0 no. Motion carried. Mayor Latta read a letter from the City of Joliet/Mayor $ourg asking our support to change Hourse Bill 1529, Police and Fire Collective Bargaining law. The Municipal League has adopted the following position that the language of Senate Amendment ~~3 {Firefighters inclusion} is unacceptable as it applies to determination of supervisory status and in management rights and scope of arbitration. Firefighters should be covered under the same general terms as police; Volunteer paid on call firefighters must be specifically excluded; The 25 covered employee trigger for inclusion of a municipality (under existing law) be increased or altered in recognition of additional police and firefighters so as the maintain the status quo. The urgently request we write our legistrators regarding this matter. W. Sharp moved the Village write a letter to our legistrators and tell them we do support Illinois Municipal League position on House Bill 4X529. Seconded by K. Callanan. Vote by roll ca11. Mayor Latta read a letter from ~cClester-Nimmons. Free Public Library Board requesting the Village Board pass a resolution for the purpose of levying a .Q2% tax in the fiscal year 1986/$7 for equipping and maintenance of the PLAINFIELD VILLAGE BOARD OF TRUSTEES Regular Meeting October 21, 1985 Page Twa library building and its equipment. They sent a sample resohiti:-on for Village t~ act upon. W. Sharp questioned "Section 3. The minimum number of voters _ of the Village of Plainfield required to sign a petition requesting that the question of the adoption of the resolution be submitted to the elactors of the Village of Plainfield is 1209,'. It was the consensus of the Board, the number of signatures on the petition was .not correct and the Mayor directed the Clerk to check on the number required and bring the findings back to the next board meeting. Mayor Latta read a letter from residents an Highview Court requesting to be on the agenda in reference to problems associated with the construction at the end of Highview Court. (Letter signed by Mrs. Krupowica: and Mrs. Lohmar). Mrs. Krupowicz spoke in reference to the trucks on Highview Ct., she understands as Officer Deering explained to the residents that during construction of the addition to the Plaza,..the trucks must use Highview Ct. She questioned the Board as the Mr. Bays plans to service the stores in the building? Also she questioned if the no truck signs on Highview Ct. will keep the trucks from driving down Highview Ct. to deliver from the west (rear) of the building? Attorney Harvey stated the Board can not speak for Mr. Bays as to his plans. Mr. Bays must abid by the Village ordinances, if Mr. Bays has violated any ordinance and the residents in the area are aware of any violation, it should be brought to the attention of the Building lnspector and/or Police. Are you aware of any violations of the Village ordinances? Mrs. Krupowicz questioned, who is suppose'to watch out far any violations? Attorney Harvey stated we have a Building Inspector who checks for code violations in the construction of the building, and the regulation of truck traffic would be a function of the Police Department. Mr. Mauer, Building Inspector stated there are no zoning or Cade violations. Mrs. Krupowicz questioned, does he know how they plan to service it? Mr. Mauer stated Mr. Bays originally stated it was going to be a professional building and probably serviced from the from of the building. Originally the plans were to divide 100' x 200' building into $ - 25' stalls 100'deep, he took water perruits out far 6 structures and it is open-ended at this paint in time. The structure, elevations, set-back, there are no violations. There are two catch-basins placed behind the building, one at the corner of Mr. Lohmar's property, in case there would be any run off. The drainage is 20,000 sq. ft., it is put in the form of an eave-trough. taken to a drainage file into the storm sewer. The elevation of Mr. Lohmars corner, from route 59 to Highview Ct. is approx. 2~'drop, the building is almost even with the elevation of route 59. The 2' shows up because the building is constructed level. They are dropping the grade at the rear, at my suggestion, 16" with a step down from the rear of the building, that will put it approx. 1' higher than Highview Ct. Officer Deering read the portion from the ordinance relating to truck traffic, Chapter 9, Article 5, Section 5 -25. Mrs. Krupowicz questioned if that means they could deliver down our street with delivery to the back of the building? Officer Deering stated a semi truck, loaded with steel beams tried to deliver from behind d.D. Browns and he couldn't make it, so he directed the semi to go around and back down Highview Ct. There was no other access for the trucks to deliver the construction material. Attorney Harvey stated there was no other . Mrs. Krupowicz stated her problem is; will they see the end of the trucks on Highview Ct. after all construction is complete? Attorney Harvey stated the Police and the Village will have to enforce the ordinance. J. Dement questioned Attorney Harvey about the easement at the end of Highview Ct. Attorney Harvey stated he understands the easement is a 22' utility easement. Mrs. Davis stated the easement is xiext to her property and they don't know if it goes across Highview Ct. Attorney Harvey stated the original title holder who gave the easement, might still own that property, even though he has the easement, he has not given up the property I'm speculating. Mrs. Krupowicz stated do we have to check this out to see what Mr. Bays plans are? Attorney Harvey stated that would be a great place to start, also you might be able to varify if he is the owner of that easement. Mrs. Davis stated she has a quick claim deed to the 22'. Attorney Harvey stated, after looking over the deed, he will have to make a copy and research it in the original plat. This property could have been dedicated to the Village. It wouldn't hurt to contact the original owners, Zupancic. Mrs. Krupowicz questioned if this could be • checked into by the Village. Attorney Harvey questioned if the residents have ever been approached, is this a situation that could be resolved between the residents and Mr. Bays, that maybe he isn't going to use it for deliveries, if he were willing to bind himself to not using Highview Ct., you wouldn't have any problems. Mr. Mauer stated he caxi not see how that building could make deliveries from Highview Ct., they couldn"t make the turn to service the building. Mayor Latta suggested the residents contact Zupancics as to the owner of the easements, if it does belong to Mr. Bays, call him and ask his intentions. Mrs. Kurpowicz questioned can they check to see if it was dedicated to the Village and if it was, can we come back to the next meeting and go on from there? The Board was in agreement. Mrs. Krupowicz questioned can they put in some trees or bushes as a buffer. Mayor Latta. stated it all depends on who owns the property. W. Sharp stated we want you to come back with the answer from Mr. Zupancic. Mr. Lohman stated the building is not the one he was going to build. Mayor Latta stated but the original plans were if he received a B-3 zoning, but he did not receive it. Mr. Lohman questioned Attorney Harvey if they have violated any local, county or State laws, when they put up that building. Mr. Harvey stated per Mr. Mauer, Building Inspector, no Village violations; we have jurisdiction under our ordinances. Mayor Latta acknowledged receipt of a letter from Saxon Peterson. & Selfridge concerning the Chobar Trust, naming the people involved in the trust and where They can be reached. Mayor Latta stated the Halloween hours will be from 4:00 p.m. to 6.00 p.m. October 31st. • PLAZNFIELD VILLAGE BOARD OF TRUSTEES Regular Meeting October 21, 1985 Page Four Mayor Latta suggested the sign ordinance be tabled and brought to a Workshop. Also it was suggested the parking lot ordinance will go to Workshop. K. Callanan mowed to authorize a temporary task force to draft a temporary Historic Preservation ordinance for Village of Plainfield, the Planner, K. Callanan and 2 other people, with the approval of D. Gullicksen. Seconded by W. Sharp. Voice vote. 5 yes,. 0 no. Motion Carried. Mayor Latta appointed Lone Mueller, from our Historical Society and Michael Lambert, who is continuing his education in Preservation Architecture to the Historic Preservation task force, at the recommendation of K. Callanan. 3. Peterson reported we had an electrical fire in Police squad M-6 and it has been totaled by our. insurance company. ,7. Peterson reported the Village of.Plainfield is a member of 111inois Fire and Police Commissioners Association and acknowledge receipt of • the Certificate. J. West reported we will have a Commonwealth Edison. Dresden Drill in November referencing the Braidwood Station. Tkiere will be a press release in the near future. R. Miller stated he will get. with the clerk tomorrow on the paper woxk for sidewalk replacements. W. Sharp reported we have a damaged furnance in the Street Garage. W. Sharp stated our Cable TV meeting will be October 31st and we expect to get some ordinaxYCe changes from the Cable .companies per the Federal Law. J. Dement informed the public the sewer and water bills are going to be late this quarter due to the change over to the new computer. .7. Dement reported we have received a letter from EPA regarding the change in status of our Sewer Treatment Plant. The plant was built and designed for 0.75 MGD; IEPA changed that to 1.0 MGD and now we are requesting that error be corrected. ~v~en this is corrected it will change our discharge requirements, frequency of monitoring and will change pxiority number for grants. .T. Dement reported on letter from E.P.A, stating from samples taken in 1980 determined that Plainfield has a higher than allowed Radium content in . It has been noted, most cities and villages in northern Illinois who have deep wells also have a radium problem. Radium Information: EPA notification made Oct. 4, 1985 The Village is in violation from samples taken in Oct. of 19$0. Maximum concentration allowed by the Illinois pollution control board is 5 pico Curries per liter.qua- 1 pico Currie per liter = 1/trillionth of a part per million per liter. The radium concentration in 1980 radium -226 = 6.9 pica Curries per liter. radium -22$ = 2.9 pico Curries per liter. Total combined concentration = 9.$ pico Curries per liter. The Village is 4.8 pico Curries per Liter above the maximum allowable concentration. The public notice is for informational purposes only. It is not a notice of immediate hazard to water consumers. Should a hazard exist, immediate notification will be made. A portion of radium which is ingested remains in the bone. The radiation which is given off from the radium, because of its high energy, causes damage to the surrounding tissue. A dose of 5 pico Curries per liter may result in the development of bone cancer in a very small portion of the population. At the levels detected, the short term risk is minimal and no special precautions. need to be taken by the consumer at this time. The Village of. Plainfield has taken samples. to a private laboratory for independent testing in order to update the results. If the results come back the same notification will be made by mail every 3 months until the situation is resolved. J. Dement reported last week we met with IEPA and we discussed our Municipal Compliance Plan. They informed us, by the Clean Water Act, every community will have to come in with a Municipal Compliance Plan. Each community will do sa when their discharge permit comes due for renewal. Our permit just, became due so they informed us, we must come up with a Compliance Plan, The reason, our wet weather flow exceeds what the Clean Water Act of 1972 states. At the present time, our Engineering staff is working an our Compliance Plan and our own people are working on some options. d. West reported the computer is .new, we are learning how to use it, we are. providing input iota pne program. We only have logged in about 12 hours to date. We are working an payroll and water billing. J. Bootz moved to adjourn into Executive Session to reconvene. Seconded by W. Sharp. Voice vote. S yes, 0 no. Bootz moved to approve a wage increase of $.SO per hour far full-time employees, starting the first full pay period in November and will consider part-time employees later. Secanded by J. Dement. Peterson moved the Board employ Dave Bennett as the part-time "'on-call" mechanic for the village in terms of the job description approved at the October 7 regular meeting, at the salary of ten ($10.00) dollars an hour, effective as soon as physical completed. Peterson moved the Board allow Officer Offerman to return to light duty on October 22, "1985, to be paid a full-time salary. Should he be unable to initially work a full $ hour shift, his future personal and sick days would be reduced proportionately by the hours not worked. Seconded by K. Callanan. Vote by roll call. Callanan, yes; Dement, yes; Bootz, yes; Sharp, yes; Peterson, yes. 5 yes, 0 no. Motion .carried. J. Peterson moved the Board appoint Kirk Thompson and Sam Ballet to the Plainfield Auxiliary Police effective October 22, 1985. They will be on probation until they have met the following conditions: -Successful completion of the forty (40) hour training course offered by the Will County Safety Patrol. -Physical and psychological tests be completed and passed, as deemed necessary by the new Police Chief and approved the the Board as requirements for membership in the Plainfield Police Department Auxiliary. -Successful report from the new Police Chief following a Background Investigation of the Auxiliary member. -Recommendation from the Police Committee following an Oral Interview with the Auxiliary member. Peterson moved to continue Executive Session tomorrow evening for discussion of selection evaluation process of the new chief, tomorrow evening, October 22nd, at 6:30, not to reconvene. Peterson moved the Board hold 3 special Executive Session meetings on Monday, October 28, Tuesday, October 29 and Wednesday, October 30 at 6:30 p.m. for interviewing Police Chief applicants.
