At 7:30 p.m. Mayor Latta opened the meeting with the pledge to
the flag.
Roll call was taken, all members were present.

Let it be known Dennis Lewin received the Oath of Office of
Trustee from the Village Clerk on April 27, 1987 in the Clerk's
Office.
J. Boots moved to approve the New/Old Section of the Agenda.
Seconded by J. Dement. Voice vote. 6 yes, 0 no. Motion carried.
Mayor Latta read the Consent Agenda.
D. Gullicksen moved to approve the Consent Agenda. Seconded
by J. Dement, Voice vote. 6 yes, 0 no. Motion carried.
D. Lewin read a letter from Peace Lutheran Church/Reverand Edward
Geschke, commending Chief Bennett for his professionalism and
sincere concern with regard to the accident involving Jamie
Simonson. Also Chief Bennett's concern with the child's condition
and his support to the family. Mayor Latta directed the Clerk
to place this letter in Chief Bennett's personnel fa.le.
Mayor Latta read a Proclamation declaring May 10-16, 1987 as
Preservation Week 1987. Mayor Latta stated this should have
meaning to Plainfield, considering we are the oldest community
in Will County.

J. Dement moved to approve sending the two (2) newly elected
Trustees to the Conference either Arlington Heights - $75.00
or Springfield - $65.00, also .meals, travel & lodging to be paid
if they attend in Springfield, also meals and travel for
Arlington Heights (must provide receipts for all expenses).
Seconded by K. Callanan. Voice vote. 6 yes, 0 no. Motion
carried.
J. Dement reported we are planning "Spring Clean-up" this year,
running from May 23 through June 20, 1987, We received three
(3) quotes: A-Way Disposal - $120.00; Banner Disposal - $158.00;
and C & A Disposal - $140.00. Each quote is for 20 cubic yard
dumpsters.
J. Dement moved to contract A-Way Disposal at $120.00 per 20
cubic yard dumpster far our "Spring Clean-up" from May 23rd
through June 20, 1987. Seconded by J. Bootz. Voice vote.

L. Kelly read the Plan Commission report on Case No. 157-2187V -
Ralph Mollo/True Value petitioner requesting a variance for sign
at 112 North Division Street. Initial request was for a 72
square foot sign variance. Now requesting a 48 foot sign variance,
after Mr. Mollo discussed his request with Mayor Latta and Mr.
Gullicksen. Zoning Board of Appeals recommended by a vote of
4-0 that the Village Board approve the 48 square foot sign in
front of the building, 60 square foot sign over the double doors,
minus the 8 - 3' x 3' aluminum graphic panels.
L. Kelly moved to accept the recommendations of the Zoning Board
of Appeals on Case No. 157-2187V and approve the sign variance
of 48 square feet sign in front of the building and 60 square
feet sign over the double doors with total of 108 square feet.
Seconded by K, Callanan. Vote by roll call. Callanan, yes;
Dement, yes; Bootz, yes; Gullicksen, yes; Kelly, yes; Lewin,
yes. 6 yes, 0 no. Motion carried.
L. Kelly read the Plan Commission report on Case No, 158-219872;
location -- 211 Evans Street and 813 Bartlett Avenue; petitioner
- Peter D. Kiefert; request - zoning change from I-1 to Residence
A. Plan Commission by a vote of 6--0 recommends to the Village
Board that these properties be rezoned to Residence A and the
Village Board waive the fee for filing.
L. Kelly moved to accept the recommendation of the Plan Commission
Case No. 158-219872 and allow the rezoning of the properties
at 211 Evans Street and 813 Bartlett Avenue from I-1 to Residence
A; also the filing fees be waived for 813 Bartlett Avenue.
Seconded by J. Bootz. Vote by roll call. Callanan, yes; Dement,

L. Kelly read the Zoning Berard of Appeals Case Na. 159-21987V;
petitioner - Peter Kiefert; location - 211 Evans Street; request
- side yard variance from 10 feet to 6 feet. By a vote of 6-0,
the Zoning Board of Appeals recommended the Village Berard grant
the sideyard variance. After some discussion by the Village
Board, it was determined the house to be constructed on this
property will be a raised ranch of approximately 1800 square
feet.
L. Kelly moved to concur with the Zoning Board of Appeals
recommendation on Case No. 159-21987V to allow a sideyard variance
an the west from 10 feet to 6 feet at 2.11 Evans Street. Seconded
by D. Gullicksen. Vote by roll call. Callahan, yes; Dement,
yes; Bootz, yes; Gullicksen, yes; Kelly, yes; Lewin, yes. 6
yes, 0 no. Motion carried.
L. Kelly read the Plan Commission Report on County Case -- Wolf
Creek Industrial Park Unit 2 Subdivision. Since this is outside
our mile and one-half jurisdiction, we do not have to recommend
to the County unless we object. Plan Commission did not object
and neither did the Village Board.
K. Callanan was going to report on Plainfield Fest 1987 but due
to the Board not having the street closures in their packet,
it's tabled until next Berard Meeting -- May 18, 1987.
Robert Rogina, Engineer for the purposed Indian Oaks Subdivision,
spoke stating initially, Unit I consisted of 18 lots extending
across the entire frontage of Indian Boundary Road. Now, Unit
IT will consist of 13 lots. John Djerf, Engineer far the Village,
reviewed the plans for Unit I and gave his comments:
1) Sanitary sewer specifications allow for alternate use
of PVC composite sewer pipe in addition to the vitrified
clay pipe required by subdivision regulations. We recommend
the alternate be allowed, if acceptable to the Village.
2) Sanitary sewer specifications require TV inspection
at contractor's expense with report to Village. We
believe this to be an acceptable alternative to require-
ments of Section 3-14-2A of the Subdivision Regulations.
3) Stormwater storage is not being furnished with this
unit which is larger than 5 acres. While required by
Section 3-9-3A, storage will be provided in future units
for drainage from this unit and the new streets. A
portion of this unit is also drained by the existing
storm system on Indian Boundary Road which ties into
the Whispering Creek std.rmwater detention area.

Mr, Djerf stated the amount of the estimate for the letter of
credit: water main - $23,380; sanitary sewer -~ $38,083; storm
sewer work - $4,049; roadway and other miscellaneous items
(sidewalks, trees & etc.) -- $47,644. Total is $113,155, "Letter
of Credit" in the amount of $114,000. This estimate was prepared
by the developers engineers, Beling Consultants. We have reviewed
the estimated and find it to be satisfactory. Attorney Harvey
stated the "Letter of Credit" should have the "Subdivision Cost
Estimates" (5-4-87) attached and have it approved by New Lenox
State Bank. Also, C & S Joint Venture is Mr. Sharp & Mr. Capista
exclusively. Mr. Capista stated they will name the streets in
Indian Oaks different than those in Whispering Creek. J. Bootz
questioned on if they are aware they should pay for the engineering
fees far this development? Mr. Capista stated they are aware
and will pay them when they are invoiced.
J. Bootz stated he was concerned if proper inspections will be
made during the construction. Mr. Djerf stated he will do periodical
inspections and the sewer and water staff will also do inspections.
Provisions are in the ordinance requiring adequate inspections.
J. Bootz stated we need enough inspections to catch anything
before it is covered up and we don't know about it. J. Dement
questioned pages 10 & 11 of the Annexation Agreement. He feels
our time frame requirements should be the same for both the Village
and the developer. Tt was the consensus of the Berard that page
12-(c) shall read:
The Village shall not be required to begin construction
of such installation until the following conditions have
occurred:
1) The Owners have submitted the final plat of
Indian Oaks -- Unit #2 for approval by the
Village;
2) The State of Illinois Environmental Protection
Agency allows the Village to extend its water
lines to service the entire premises. The
construction of such improvements if not
,ooner completed, shall commence within 90
days of the last to occur of the foregoing
conditions.
K. Callanan moved to authorize the Village President to sign
the Annexation Agreement Between The Village Of Plainfield,
111inois, And Charles Sharp, Larry Capista, And Harris Bank
Of Naperville, As Trustee Under Trust. Agreement Known As Trust
No. 2993 (Ordinance No. 1124). Seconded by D. Gullicksen. Vote

K. Callanan moved to adopt Ordinance No. 1125 Annexing Property
Owned By Charles, Larry Capista, And Harris Bank Of Naperville,
As Trustee Under Trust Agreement Known As Trust No. 2993. Sec-
onded by D. Gullicksen. Vote by roll call. Callanan, yes;
Dement, yes; Bootz, yes; Gullicksen, yes; Kelly, yes; Lewin,
yes; Mayor Latta. 7 yes, 0 no. Motion carried.
K. Callanan moved to approve the final plat for Indian Oaks
Subdivision - Unit 1 subject John Djerf's letter of recommen-
lotions and the modification of the "Letter of Credit". Sec-
onded by D. Gullicksen. Vote by roll call. Callanan, yes;
Dement, yes; Bootz, yes; Gullicksen, yes; Kelly, yes; Lewin,
yes. Mota.on carried.

Attorney Harvey read the Illinois Pollution Control - "Order"
giving a variance to the Village of Plainfield. (Attached)
K. Callanan moved to authorize the Village President to execute
the Illinois Pollution Control Board - Opinion and Order on
Radium (variance). Seconded by L. Kelly. Vote by roll call.

Mayor Latta reported the Will County Municipal League will con-
duct their Monthly Dinner Meeting at the Rialto Theater, Thursday,
May 14, 1987.
J. Bootz moved to approve the Warrant List (4/17 thru 4/30/87)
for payment. Seconded by J. Dement. Vote by roll call. Callanan,

Attorney Harvey reported Steven Fox zoning violations are sched-~
uled for Court tomorrow (May 5, 1987).
It was the consensus of the Board to cancel the Workshop for
May 25, 1987.
before the end of 18 months, and the Board will add four months
to this period to provide for Board deliberation of any timely--
filed petition for variance.
However, while the Agency has suggested that reports
concerning compliance activities be filed every six months, the.'
Board will require that reports be filed every three months to
insure the Village's diligence. A twenty-two month variance will
provide the Village l8 months in which to perform additional
sampling and testing, to complete its studies, tv choose and
commence a.compliance option; the four months added to this
period provides for Board deliberation of any timely filed
petition for extension of variance.
This Opinion constitutes the Board's findings of fact and
conclusions of law in this matter.
ORDER
1. Petitioner, the village of Plainfield is hereby granted a
variance from 35 I11. Adm. Code 602.105(x) (Standards of
Issuance) and 602.106(b) (Restricted Status) but only as they
relate to the 5 pCi/1 combined radium-226, radium-228
standard of 35 I11. Adm. Code 604.301(x), and the 15 pCi/1
grass alpha particle activity standard of 35 I11. Adm. Code
604.301(b) subject to the following conditions:
A) This variance expires on February 15, 1989, or at such
earlier time as either analysis pursuant to 35 IT1. Adm.
Code 605.105(x) shows that compliance with the
radioactivity standards has been achieved or for failure
by Petitioner to file a variance petition pursuant to
_. paragraph l (I) of this Order;
B) In consultation with the Agency, Petitioner shall
continue its sampling program to determine as accurately
as possible the level of radioactivity in its wells and
finished water. i) As to sampling the finished water,
until this variance expires, Petitioner shall collect
quarterly samples of its water from its distribution
system, shall composite and shall analyze them annually
by a laboratory certified by the State of Illinois for
radiological analysis so as to determine the
concentration of radium-2__26 an_d_ radiu__m-22.9.. The results
of--the-~~ari~l-yse3fshalZ--~be reported~to ~~thefWater 4uality
Unit, Division of Public Water Supplies, 2200 Churchill
Road, IEPA, Springfield, Illinois 62706, within 30 days
of receipt of,each analysis. At the option of
Petitioner, the quarterly samples may be analyzed when
collected. The running average of the most recent four
quarterly sample results shall be reported to the above
address within 30 days of receipt of the~most recent

quarterly sample, ii) As to sampling the raw water in
the wells, Petitioner shall follow the procedures
outlined in subparagzaph i) above,. except that only four
quarterly samples shall be collected and analyzed for
each well.
C) Within 3 months of the grant of the variance, the
Petitioner shall secure professional assistance (either
from present staff or an outside consultant) in
investigating compliance options, including the
possibility and feasibility of achieving compliance by
blending water;
D) Within 4 months of the grant of the variance, evidence
that such professional assistance has been secured shall
be submitted to the Agency's Division of Public Water
Supplies, FOS, at 2200 Churchill Road, Springfield,
Illinois 62706;
E) Within 17 months of the grant of the variance, the
Petitioner shall complete investigating compliance
..~ methods, including those treatment techniques described
in the Manual of Treatment Techni ues for Meetin the
Interim Primary Drinking Water Regulations, USEPA, May
1977. EPA--600/8-77-005, and~~~pr~~pa~'e a detailed
Compliance Report showing how compliance shall be
achieved with the shortest practicable time; but no
later than five years from the date of this variance;
F) This Com liance Re ort shall be submitted within 18

months of the grant of this variance to IEPA, DPWS;
G) Within three months thereafter Petitioner shall apply to
IEPA, DPWS, Permit Section, for all permits necessary
for construction of installations, changes or additions
to the Petitioner's public water supply needed for _
achieving compliance with the maximum allowable
concentration for radium;
H) If compliance has not been earlier achieved, and if
Petitioner has not filed a variance petition on or
before October 1S, 1988, this variance shall terminate;
I) Pursuant to 35 T11. Adm. Code 606.201, in its first set
of water bills or within three months after the date of
this Variance Order, whichever occurs first, and every
three months thereafter, Petitioner will send to each
user of its public water supply a written notice to the
effect that Petitioner has been granted by the Pollution
Control Hoard a variance from 35 Ill. Adm. Code
602.105(a) Standards of Issuance and 35 Ill. Adm.. Code

602.106(b) Restricted Status, as it relates to the
combined radium standard;
J) Pursuant to 35 Ill. Adm. Code 606.201, in its first set
of water bills or within three months after the date of
this Order, whichever occurs first, and every three
months thereafter, Petitioner. will send to each user of
its public water supply a written notice to the effect
that Petitioner is not in compliance with the combined
radium--226, radium-228 standard. The notice shall state
the average combined radium in samples taken since the
last notice period during which samples were taken;
K) The Petitioner shall take all reasonable measures with,
its existing equipment to minimize the level of radium
in its finished water;
L) The Petitioner shall provide written progress reports to.
IEFA, DPWS, FOS every 3 months concerning steps taken to
comply with paragraph B and F. Progress reports shall
quote each of the above paragraphs and immediately below
each paragraph state what steps have been taken to
comply with each paragraph, ,
2. Within forty-five days of the date of this Order, Petitioner
shall execute and forward to Thomas Davis, Enforcement
Programs, Illinois Environmental Protection Agency, 2200
Churchill Road, Springfield, Illinois 62706, a certificate
of Acceptance and Agreement to be bound to all terms and
conditions of the variance. This forty-five day period shall
be held in abeyance during any period that this matter is
being appealed. The form of Said Certification shall be as
follows:
I (We), having read the Order of
the Illinois Pollution Control Board in PCB 87-9, dated April l6,
1987, understand and accept the said Order, realizing that such
acceptance renders all terms and conditions thereto binding and
enforceable.
