At 7:30 p.m., Mayor Latta opened the Public Hearing on Indian
Oaks Estates Annexation Agreement..
Roll call was taken, all members were present.
Mayor Latta stated each Board member has just received a new
modified Annexation Agreement.
Attorney Carey reviewed the revised Agreement - page #3-4 -
Development of Subdivisions: and after the necessary hearings
and meetings required by law, approve the Preliminary Plat; the
language change 1300 s uare feet as a minumum for single family
dwelling and 1500 square feet for dwelling containin more than
one story; if wells are needed and then water lines extended,
the Village would have the right to require the property owner
be required to connect to the Village's water supply. The Board
was in agreement that the wells should be capped and Mr. Carey
stated this could be part of the covenant and run with the land
and added to paragraph (3) #7. #10 Special Covenants - down-
zoning of 7 lots to allow $ single family dwellings (dimensions
are in exhibit "C"); page 10 (B) the developer agrees to insure
completion of extending water lines to service Van Dyke Road,
there will be a "Letter of Credit" when Unit 2 is brought before
the Board for approval; page (11) Park Lands - Owners agree to
dedicate land to the Plainfield Park District for park and
recreational purposes then and in such event, upon the termination
of the Agreement, the Village shall disburse the entire balance
held in Trust to Plainfield Township Park District. There was
a question on the effect of the "Letter of Credit". Attorney
Harvey stated a "Letter of Credit" is intended to cover each
unit as it is developed. We can't tell how much a "Letter of
Credit" should be until the final engineering is completed and
an estimate of the costs. We could not tie a super large letter
aver things we are not certain of the costs or when they will
be done. What we usually do is compile a list of things to be

done within a particular time frame. If this list is not done
within the time frame, then the Village will complete the list
and use the developers money ("Letter of Credit"). We should
follow our Subdivision Regulations completely, do not waive any
of the regulations. Attorney Carey stated the developers are
willing to deposit $600.00 on a lot for closing the wells and
the Village could see that the wells are closed. J. Dement stated
he has no idea what it would cost 10 years from now to cap a
well. W. Sharp stated there should be a way to include in the
agreement, a fair market value far capping a well. Mr. Capista
stated, if we must drill wells, at the time of drilling, we will
request from the driller, the fair market priced for capping
and deposit that amount with the Village. It will be the owners
responsibility if that amount does not cover the capping plus
attorney fees and any other costs connected. J. Dement stated
this suggestion, seems more equitable. J. Bootz questioned if
we should have an easement for each well? Attorney Harvey stated
it should be included in the contract. Mayor Latta questioned
if the lots have been corrected on the final plat. Engineer
Rogina stated they have been corrected. Attorney Harvey stated
the changes an the final plat must be reviewed by our engineer.
D. Gullicksen stated we would like time to review and if we are
going to have any changes before the next meeting, he wants 2
to 3 days to review it, or forget it.
It was the consensus of the Board that the developers will have
in the Village Office by April 29th, completed and revised
agreement and final plat for Indian Oaks Subdivision. Also,
they will supply our engineer the final plat of Indian Oaks for
review and reconfiguration of the lots at the south end of Whis-
pering Creek Subdivision. It will then be placed on the Agenda
for the regular meeting of May 4, 19$7.
D. Gullicksen moved to adjourn the Public Hearing. Seconded
by K. Callanan. Voice vote. 6 yes, 0 no. Motion carried.
