A SPECIAL ORDINANCE VACATING A CORPORATION STRIP
WHEREAS, Habitat for Humanity of Greater Richmond, Indiana, Inc., has petitioned the Common Council of Richmond, Indiana, requesting a portion of a platted, but no longer used, corporation
strip located on the south and west sides of the property commonly known as the 200 Block of N.W. 13th Street. A copy of a map showing the parcel to be vacated is attached hereto as
“Exhibit A”; and
WHEREAS, the abutting landowners are as follows:
Abutting on the South (from the east to the west):
(1) Robert M. and Janet L. Phillips, 116 NW 13th St., Richmond, IN 47374
(2) Norman S. and Alice Lorene Himebaugh, 1308 Clearview Dr., Richmond, IN 47374
(3) James C. and Freda A. Riden, 1312 Clearview Dr., Richmond, IN 47374
Abutting on the West (from the south to the north):
Estelle Hieger, 25 Debolt Lane, Richmond, IN 47374
Donald A. and Helen L. Glosson, 21 Debolt Lane, Richmond, IN 47374
Mary Kathryn Fulton, 17 Debolt Lane, Richmond, IN 47374
Abutting on the North:
Juanita Ford, 218 NW 13th Street, Richmond, IN 47374
The property across the street from Habitat land is owned by the City of Richmond (Clear Creek Park and McBride Stadium).
WHEREAS, Common Council, pursuant to Indiana Code § 36-7-3-12, conducted a public hearing on said petition ____________________, 2005, after publishing legal notice thereof at least
ten (10) days in advance of said hearing as required by statute; and
WHEREAS, the Richmond Advisory Plan Commission, pursuant to Richmond Code § 155.04(b), conducted a public hearing on said petition ___________________, 2005 after publishing legal notice
thereof at least ten (10) days in advance of said hearing as required by ordinance; and
WHEREAS, it is desirable to vacate said corporation strip.
NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana, that the portion of the corporation strip described in attached Exhibit A is hereby vacated and
that ownership of such land shall vest in the Habitat for Humanity of Greater Richmond, Inc., an Indiana non-profit corporation.
