GULLICKSEN, L. KELLY, D. LEWIN, J. BOOTZ, K. CALLANAN. J. DEMENT WAS ABSENT. OTHERS PRESENT: M. PUSINELLI - ADMINISTRATOR V. KRNAC - VILLAGE CLERK 6:41 p.m. Roll call was taken, J. Dement was absent. Administrator Pusinelli introduced Jerry Gorski and Tom Good from the Law Firm of Gorski and Good. They are attending our meeting to explain various steps we can take to annex certain parcels of property. Mr. Good spoke in reference to the Village's request far their firm to do a "title search" of various parcels of property in the un- incorporated territory of Plainfield. The fallowing is a proposed timeline which could reasonably be met, assuming no unusual problems arise: 1) Determination of ownership of territory under consideration by title company. Completion date: completed. 2) Preparation of Plat of Annexation - legal description. It is my understanding that the Village intends to utilize the services of Tyson Engineering. Mr. David Tyson indicated that once he is advised to proceed and is supplied with a copy of the title company"s work as well as your map depicting the parcels, it will take his firm not longer than six (6) weeks to prepare the necessary Plat of Annexation and legal description. Assuming Mr. Tyson is immediately advised to proceed and is supplied with the necessary documents, the estimated completion date would be May 16, 1988. Completion date: May 16, 1988. 3) Preparation of Petition for Annexation and appropriate notices. As discussed in this office's March 25, 1987 letter to the Village, a Petition must be prepared for filing with the Will County Circuit Court. Various notices must also be prepared regarding the hearing on the Petition. The preparation of these documents could be accomplished concurrently with the work being completed by Tyson Engineering as detailed in 2 above. Completion date: May 16, 1988. The Petition for Annexation must be executed by a majority of the electors residing in the territory to be annexed. This must be researched at the County Clerk's Office and can be accomplished concurrently with the preparation of the Petition for Annexation and notices as detailed in 3 above. Completion date: May 16, 1988. 5) Preparation of form of Annexation Agreement for individual property owners. You have indicated that a number of property owners have requested various assurances in conjunction with their execution of the Petition far Annexation. Annexation Agreements would be the appropriate vehicle to formalize these assurances. This office could have a form of Annexation Agreement prepared within a couple of weeks. However, such farm Agreement would require modifications to correctly reflect the exact agreement of the parties in each instance. To that end, the Village should authorize you to begin negotiations with property owners immediately. This office is ready to assist you in such negotiations if desired by the Board. Once the negotiation of the various Annexation Agreements is complete, a hearing on such Agreements must be conducted by the corporate authorities with not less than fifteen (15) days nor more than thirty (30) days published notice. Tt is very important that the Village exercise its best efforts to quickly negotiate the Annexation Agreements. The speed at which annexation takes place is directly dependent upon completion of this step. Completion date: Dependent on completion of negotiation of Annexation Agreements. Approximately thirty (30) days after all such Agreements have been negotiated. 6) Court procedure for annexation. Once the Annexation Agreements have been approved, and once the Petition for Annexation has been executed, the Petition for Annexation can be filed with the Court and a hearing set thereon. The hearing must be commenced not less than twenty (20) nor more than thirty (30) days after the filing of the Petition. It may be continued from time to time. If objections are filed it is likely that at least one continuance will occur. While it is very difficult to predict the exact timing of the Court proceeding (it is subject to the discretion of the Judge), it should be concluded within ninety (90) days. The last time this office handled this type of annexation, it took approximately nine (9) weeks. Completion date: Within ninety (90) days after filing of Petition. Kelly moved to authorize the Law Offices of Gorski and Good to proceed with items #2, 3, 4 and 5 of their letter dated April 5, 1988 and authorize Tyson Engineering to execute item #2 Preparation of Plat of Annexation. Seconded by J. Bootz. Vote by roll call. Gullicksen, yes; Kelly, yes; Lewin, yes; Bootz, yes, Callanan, yes. 5 yes, 0 na. Motion carried. J. Bootz moved to adjourn. Seconded by D. Gullicksen.
