KOCH, JR. COMMISSION CHAMBERS OF THE TOWN HALL, 100 SEA ROAD, GULF STREAM, FLORIDA. I. Call to Order Mayor Morgan called the meeting to order at 9:00 A.M. II. Regular Meeting of October 9, 2020 Vice Mayor Stanley made a motion to approve the minutes of the regular meeting on October 9, 2020. Communication from the Public (3 min. maximum) Mr. Bob Ganger, Town of Gulf Stream resident, found a box of documents regarding the 1970's restoration of oceanfront beaches that he will be donating to the Delray Beach Historical Society. Mr. Ganger Minutes of Town Commission Regular Meeting & Public Hearing Held November 13, 2020 @ 9:00 A.M. gave a little history of what he found in the box and gave the Town Commission a handout with historical information as he thought it was significant to Gulf Stream. Mayor Morgan agreed that it was very interesting and thanked him for all he had done in bringing historical significance to Gulf Stream. Mayor Morgan introduced a video sent by the Florida League of Cities honoring Commissioner Joan Orthwein with the Mayor John Land Years of Service Award for 25 years of service to Gulf Stream. Mayor Morgan added that she had really served 32 years as she was on the Architectural Review and Planning Board for seven years and served as Chairman of that Board before moving on to the Commission where she served as Vice Mayor for many years, as well as Mayor, of Gulf Stream. He spoke of Commissioner Orthwein's intellect, integrity, honesty, and sense of humor that has helped lead Gulf Stream forward through the 25 years she has spent on the Town Commission. Mayor Morgan then presented her with a plaque and pin also sent by the Florida League of Cities. Commissioner Orthwein thanked everyone and stated it was an honor to serve on the Town Commission. VIII. Public Hearing. A. Petition for Abandonment 1. Declaration of Ex-Parte Communications Vice Mayor Stanley stated he had spoken to the applicant's legal counsel. 2. Administer Oaths Town Clerk Taylor swore in James and Nadia Davis. 3. Application for Abandonment filed by Blaine C. Dickenson, Esq. as agent for James R. Davis, Jr. of 588 Banyan Road, Gulf Stream, Florida 33483 Assistant Town Attorney Nazzaro explained this was a petition for abandonment at the end of Banyan Road in front of 588 Banyan Road, which is owned by the Davis's. Mr. Nazzaro added he had spoken to Town Attorney Randolph who advised getting an appraisal and the two parties settling on a privilege fee or dollar amount for the abandonment. Mr. Nazzaro stated the abandonment is approximately 2,500 sq. ft. of a public road that there would be no negative effects to services or the use of emergency vehicles accessing the properties on Banyan. He added the appraisal put the approximate value of the 2,500 sq. ft. at $525,000 and the Davis's were willing to pay $200,000. Mr. James Davis thanked the Staff and Commissioners for evaluating their application and wanted this to be a win -win for all involved. Mr. Davis went into an explanation of market values and comparisons with other lots in town. There was discussion amongst the Commissioners about being fiduciaries for the Town and being fair and objective to all parties involved. The Commission decided on going with 2 Minutes of Town Commission Regular Meeting & Public Hearing Held November 13, 2020 @ 9:00 A.M. the best comparable property at a price of $347,500.00. Mr. Davis said he would think about it and get back to the Commission. IX. Reports. A. Town Manager 1. Utility Undergrounding Town Manager Dunham stated Comcast was completing their task of getting their current customers hooked up to fiber. He added staff had met with AT&T out in the field to identify how many conduits they needed to finish their work. Town Manager Dunham said the Town could expect an estimate from Wilco for the scope of work needed to finish but it needed to be done so FMC could complete the work on AlA. He added that the staff was asking for authorization from the Commission to contract with Wilco on an amount not to exceed $25,000 piggybacking on a Wilco Publicly Bid contract with another city to do the work. Town Manager Dunham reiterated that it was important to get the work done in the next week or two before Harddrives is able to do the milling and asphalting so time was of the essence. Mayor Morgan asked if money was already budgeted for this to which Town Manager Dunham stated that Wilco had already been paid so the Town would need a new contract. Assistant Town Attorney Nazzaro stated that Wilco had completed everything according to the plan and this would be an additional request by AT&T that the Town was treating separate. Town Manager Dunham added that this was similar to a change order. Vice Mayor Stanley made a motion to approve a contract with Wilco to finish the AT&T work, not to exceed $25,000. The motion was seconded by Commissioner Orthwein with all voting AYE at roll call. 2. Update-AlA Water Main Replacement Town Manager Dunham stated FMC was finished installing all the new water mains, abandoned the existing water main, completed all the tie-ins, and all the bacterial testing had been completed and signed off by the Health Department. He added the only thing left was the milling and asphalting of all three roads. 3. Update -Minor Road & Drainage Repairs (Core Area) Town Manager Dunham stated that the goal was to have from Old School up to Lakeview completed in the next 10 days and then they would begin to work on Gulfstream Road beginning at Golfview going North. 4. Flood Vulnerability & Mitigation Town Manager Dunham stated he had asked Baxter & Woodman's Water Drainage Division Manager to do a short study to assess the King Tide issues in Town, examining the Town's vulnerability and using the County's latest Lidar information, which will provide detailed topographic elevation. He added that some solutions may be sea wall modifications or earthen grading. Town Manager Dunham stated they would also be looking at the outfall pipes according to the Town's NPDES 3 Minutes of Town Commission Regular Meeting & Public Hearing Held November 13, 2020 @ 9:00 A.M. permit. He added the Town has 14 outfall pipes, but the Town only has five check valves which need replacement. A presentation from them would be made in December, he said. 5. Replacement of Town Hall Generator Fuel Tank Town Manager Dunham stated the Town Hall Generator fuel tank needed to be replaced. Vice Mayor Stanley stated this should be replaced before the next storm season. Town Manager Dunham stated that estimates would be forthcoming. 6. In -Season Construction Activities Town Manager Dunham reminded everyone that December 1, 2020 was the start of season but wanted them to know that construction activities can still be going on, just not noisy construction such as pile driving, sandblasting, jackhammers, etc. He added that the Code allowed there to be some exemptions from that, on a temporary basis. Mayor Morgan suggested that the arrival and departure times would be enforced to which Town Manager Dunham agreed. Commissioner Orthwein wanted to clarify that indoor work, such as painting, was allowed, to which Town Manager Dunham agreed and added that was the only work allowed on Saturday during season. B. Finance Director 1. Financial Report as of October 31, 2020 Town Manager Dunham referred to CFO Tew. She stated that the Town ended the year in a good position and wanted to remind the Commission that the revenue and expenditures would continue to be allocated to FY 2020 until November 30, 2020. D. Police Chief 1. Activity for October 2020 Chief Allen asked that the report be accepted as submitted and mentioned the two cars that had been taken. One of them had been recovered and one was still missing and again it was due to cars being unlocked with the key fobs left in the car. Chief Allen stated as people are coming back into town, he has the officers knocking on doors to remind them to lock their cars. He then introduced a new officer, Justin Menard, who came from serving for 25 years with the Florida 4 Minutes of Town Commission Regular Meeting & Public Hearing Held November 13, 2020 @ 9:00 A.M. Highway Patrol. Mayor Morgan stated he had received some phone calls from residents who were pleased to see the additional coverage in town with the addition to the Police Department. With that, Chief Allen gave the news of an officer who had resigned, so they were back looking for another officer to take his place. X. Items for Commission Action. A. Proclamation Town Clerk Taylor read a Proclamation by Mayor Morgan proclaiming November 26, 2020 as Marilyn Gooder Mayer Day in the Town of Gulf Stream, FL in recognition of her 100th birthday. Mayor Morgan added that the Mrs. Mayer was a remarkable woman and the proclamation summarized her as an outstanding person. Commissioner Orthwein thanked everyone for the proclamation and stated that Mrs. Mayer had wanted to be at Town Hall to accept the proclamation but was being very cautious as family was coming in for her birthday and she wanted to be in good health when they arrived. B. Resolution No. 20-12; A RESOLUTION OF THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, FLORIDA PROVIDING FOR THE APPROPRIATIONS OF BUDGET REVENUES AND EXPENDITURES IN THE GENERAL FUND FOR THE FISCAL YEAR ENDING SEPTEMBER 30, 2020; PROVIDING AN EFFECTIVE DATE. Town Clerk Taylor read Resolution No.20-12; A RESOLUTION OF THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, FLORIDA PROVIDING FOR THE APPROPRIATIONS OF BUDGET REVENUES AND EXPENDITURES IN THE GENERAL FUND FOR THE FISCAL YEAR ENDING SEPTEMBER 30, 2020; PROVIDING AN EFFECTIVE DATE. C. Palm Beach County Law Enforcement Mutual Aid Agreement Town Manager Dunham stated 26 Law Enforcement Agencies sign on to this agreement every year allowing them to all aide each other if needed. Vice Mayor Stanley made a motion to approve the PBC Law Enforcement Mutual Aid Agreement. Commissioner White seconded the motion with all voting AYE at roll call. D. Bid Award #20-001, Double Detector Check Valve Water Supervisor Beltran explained this was a piece of equipment that is now under ground and the State doesn't allow that anymore and this one is leaking water, so it needs to be changed. Town Manager Dunham stated the low bid was with Southern Pipeline and the staff would recommend accepting that bid. Commissioner White asked where it was going to be located to which Mr. Beltran explained and told her it would be covered with shrubbery. Vice Mayor Stanley made a motion to approve the $38,750.00 bid by Southern Pipeline for the Double Detector Check Valve. Commissioner Orthwein seconded the motion with all voting AYE at roll call. E. Appointment of a Special Magistrate Assistant Town Attorney explained that the Special Magistrate for the Town of Gulf Stream is appointed by the Town Commission for a two-year term. He added that in dealing with some code enforcement issues, the staff realized that the Town does not have an active contract with a Special Magistrate. Assistant Town Attorney recommended Keith Davis as he represents municipalities exclusively and has agreed to serve as the Town's Special Magistrate for a rate of $190 per hour. Commissioner Orthwein made a motion to approve Keith Davis as the Town's Special Magistrate. The motion was seconded by Vice Mayor Stanley with all voting AYE at roll call. F. Agreement to Bore Additional Undergrounding Conduit - Wilco LLC Town Manager Dunham explained that the Commission had approved up to $25,000 at the Commission Meeting held on November 13, 2020 for Wilco to finish the AT&T undergrounding work. The proposal, which was a piggy -back on a Longboat Key undergrounding job, came in at $47,140.00, thus needing Commission approval, he added. Mayor Morgan stated it was work that needed to be done and Wilco did a good job previously. Town Manager Dunham stated that AT&T would begin work the week after Thanksgiving. Commissioner Lyons was happy to hear that AT&T would be completing the project. Mayor Morgan reminded everyone that the purpose of the lawsuit against AT&T was to get the work completed. He added the Town was being held hostage by AT&T to an exorbitant surcharge on their original contract, which was excessively high compared to Comcast and what they are trying to do is force the Town into paying additional sums, the legitimacy of which are being questioned by the Town. He added that AT&T wanted the Town to attend mediation on the amounts they claim the Town owes and the Town has made it clear that the Town will not meet until the work is substantially completed. 1 Commissioner Orthwein made a motion to approve the $47,140.00 contract with Wilco to bore additional undergrounding conduit. (Consultant) perform engineering services to assess the Town's stormwater resiliency. This request followed recent king tide events that resulted in water levels in the Intracoastal Waterway breaching the top of an existing seawall and sheetflowing over private property and washing into the Town's road right-of-way. This technical memorandum presents the findings regarding flooding vulnerability as a result of king tides by identifying (1) low areas within the Town's rights -of -way, (2) the level of protection provided by existing check valves on stormwater outfall pipes and (3) identifying other areas threatened by potential seawall breaches. The effects of projected future sea levels are also examined with recommendations for the Town to consider for phasing improvements to prevent or mitigate the flooding. Low Lying Areas To determine low lying areas, it was necessary to establish the elevation to use as a benchmark. This elevation was based on the historic king tide elevations that have occurred. The elevation was determined by reviewing monitoring information collected by the South Florida Water Management District (SFWMD) at the nearest canal control structure (S-40) located on the C-15 Canal at Federal Highway where water levels are monitored both upstream and downstream of the structure. The downstream side of the structure represents the Intracoastal Waterway. Figure 1 shows the daily high tide elevations between 1985 and 2020. The spikes in the graph are indicative of king tides. Based on this information, an elevation of 3.0 feet, NAVD was used as the expected king tide elevation, which is approximately 2 feet above the current average high tide elevation. Town of 'Gitlf Slh•eam King Tide Resiliency Assessment — Technical Memos-andinn In 2018, Palm Beach County requisitioned new Light Detection and Ranging (LiDAR) datasets covering the entire County to replace 2007 datasets that only covered coastal areas of the County. These datasets include elevations obtained by measuring the time differential of sending and receiving light projected onto the ground by lasers at high altitudes. The new datasets have twice the resolution with data points of elevation every 2.5 feet and they have also been found to be more accurate than the previous datasets. The LiDAR datasets that correspond to the Town were merged together to create a single spatial dataset that was then used to identify areas that are below the threshold of 3.0 feet, NAVD. In regard to the problem that was observed recently of king tide water levels exceeding the seawall at 3550 Polo Drive, Figure 2 shows that a low lying area extends between the road and the water, confirming the observations of water rushing into Polo Drive. Polo Drive includes a stormwater system consisting of inlets, pipes and a stormwater pump station. The overflow that occurred into the system was in excess of what the pump station could handle and resulted in flooding as the system, at this point, was equalized with the Intracoastal Waterway and was simply recycling sea water. This not only creates road hazards, but is also detrimental to the pump station which likely ran nonstop for several hours. The station was also designed for freshwater flow and could be negatively affected by prolonged pumping of brackish water. Brea 2 Observed ! + ! ! It is important to note that while seawalls Figure 2: King tide breach offer a level of protection, most lots are graded higher than the seawalls which can offer an even greater level of protection by forming a barrier between the Waterway and roads. Lots are graded higher because finished floors of homes are typically required to be higher than the adjacent road.. The low elevations along the southern portion of 3550 Polo Drive contributed to the breach of flow that occurred there. Low lying areas for the entire Town are shown in Figure 3 along with the existing stormwater pipes. The pipe locations are important because if they extend between the Intracoastal Waterway and the low lying areas, they could carry the tide waters up into the streets unless stormwater check valves prevent that from occurring. The locations of existing check valves are also shown. Baxter & rfOOdfrlurt. lnL 5 r Town of Gzlll'Streom King Tide Resiliency Assessmenl — Technical Alemorandilm Check Valves Check valves are the first line of defense against king tides backing up into a piped drainage system. These valves allow flow to move in only one direction and can prevent water from backing up into the streets from the Intracoastal Waterway. Pipes will normally allow water to move in either direction depending on which side of the pipe has the higher water level. The side with the higher level will create pressure forcing the water to move to the side with the lower water level. Check valves use this pressure to open the flow if the flow is in the correct direction and close the flow if it is not. There are two types of valves. An "inline check valve" includes a conical rubber diaphragm located inside the pipe and is normally closed. Pressure from the upstream side of the pipe forces the valve to open. Another valve, commonly referred to as a "duck bill" valve" works in a similar manner, but is attached to downstream end of the pipe. The valve is normally clamped shut and rolls inward. Water pressure forces the valve to open. Figure 4 shows these two types of valves. There are other mechanical types of valves not typically used for stormwater applications due to their cost. Figure 4: Inline check valve (left) and Duck Bill check valve (right) The inline check valve is a newer technology and has advantages over the duck bill valve. It is less susceptible to barnacle growth and degradation due to the sun's UV rays. Both of which can negatively affect the ability to open and close properly and can shorten the life of the valve. The inline check valve will also open under lower pressures meaning that water does not need to build up as high before opening, This is referred to as head loss. The Lower the head loss means that more water can pass through the pipe unimpeded. The Town currently has five check valves attached to outfall pipes. Four of the valves are older duck bill style valves and one, installed two years ago, is an inline check valve. These locations are shown in Figure 3. The southernmost valve in the figure is the inline check valve. It is recommended that the older duck bill valves be replaced with the newer inline check valves. Furthermore, based on a review of the areas prone to king tide flooding, it is recommended that additional check valves be installed as discussed in the Recommendations section. Tou,n of Unlf ,9ream King Tic -ire Resiliency Assessment — Technical Alemoruntlnm Future Conditions Despite the uncertainties regarding the causes, Sea Level Rise (SLR) is occurring along Florida's coasts. This has been most noticeable with the king tides which have inundated more areas in recent years than in the past. It is also evident in the monitoring data that has been collected over the past 40 years, including the data collected for this assessment. Figure 1 includes a computer generated trend line of daily high tide elevation at SFWMD's S-40 Structure which indicates that the average high tide has risen approximately 6 inches since 1985. The Unified Sea Level Projection was published in October 2015 and updated in 2019 by the Southeast Florida Regional Climate Change Compact (SEFRCCC) with regional projections for the period from 1992 through 2100. This publication is being used by local municipalities for SLR planning purposes. The unified projections include three global mean curves that were regionally adapted to account for observed acceleration in SLR in South Florida as shown in Figure 5. Based on SEFRCCC's recommendations the SLR in 2030 will be approximately 10 inches than the level in recorded in 1992. As stated previously, sea levels have risen approximately 6 inches since 1985. It is estimated that four of those inches occurred between 1992 and 2020 which suggests that an additional 6 inches can be expected between 2020 and 2030. The LiDAR dataset was used again to identify areas that are below the threshold of 3.5 feet, NAVD (3.0' current high tide plus the additional 6" anticipated by 2030). These areas are shown in Figure 6 and represent areas prone to king tide flooding in 2030. Current flood prone areas are also shown to provide a reference of flood prone area increases that can be expected between 2020 and 2030. Bawer X ll oodmaa tnc. t i t T'l t « d� I Town of Gulf Stream King Title Resiliency Assessment — Technical Memorandum Recommendations Based on current and future king tide projections, the following short term and long term (before 2030) recommendations are offered for the Town's consideration. • Existing duck bill style check valves should be replaced with the newer inline check valves that can operate more efficiently and are less prone to barnacle and UV rays that can affect the performance over time. Three of the valves should be replaced short term and one should be replaced long term as shown on Figure 6 provided that it is periodically inspected and functioning properly. • Three additional inline check valves should be installed in the short term and one in the long term as shown on Figure 6. These are at locations where valves currently don't exist. This recommendation is based on the extent of the current and future king tide prone areas. • Areas of concern should be addressed. These four areas are shown on Figure 6 and described below, starting from north to south: o The LiDAR information indicates that a small portion of The Little Club golf course may be susceptible to king tides. A breach of seawater from the Intracoastal Waterway could potentially enter the golf course lakes which are connected to the Town's roadway drainage system and could result in roadway flooding. The Little Club is a private golf course and should be asked to investigate the concern. o The low elevations along the southern portion of 3550 Polo Drive contributed to a breach of flow that recently occurred at that location. The yard area on the south side of home on that lot should be regraded to a minimum elevation of 4.0 feet NAVD. This will need to be coordinated with the property owner and a landscape architect and should be occur as soon as possible. o The final two areas are located at the west ends of Banyan Road and Palm Way and have very similar potential issues. Those portions of the roads are located immediately adjacent to the water and exhibit low elevations according to the LiDAR information. These areas should be surveyed and, if confirmed, improvements such as raising the roads or the seawalls should be considered. Note: This assessment did not include a review of the condition or the top elevations of seawalls which vary based on location and lot boundaries. The seawalls, however, are typically lower than elevations within the lots which slope up to the finished floors. These higher elevations on the lots provide more protection of the roadways than the seawalls offer. The exception is where roads are adjacent to the water. In regard to the valve recommendations, the Town should inspect the relevant existing outfall pipes and consult with a valve supplier to verify suitability of their products based on the existing conditions.
