MILLER - STREET FOREMAN At 7:00 p.m. Mayor Latta opened the meeting. Roll call was taken, D. Gullicksen was absent. W. Sharp moved to approve the Agenda of the Continued Meeting. Seconded by J. Gaylord. Voice vote. 5 yes, D no. Motion carried. Planner Waldock reported the Board had requested a recommendation from the staff on Indian Oaks: 1) Acceptance of public improvements on Unit 2 of Indian Oaks Estates and reduction of surety to the ten percent (10~) maintenance amount of $38,000; 2) Recognize public improvements completed for Unit 3 of Indian Oaks Estates and grant a reduction of surety to the ten percent (10~) maintenance amount of $36,300. (Said surety is available to cover as-built drawings and the minor storm sewer clean-up work which is considered a maintenance item.) Actual acceptance of public improvements should be withheld until as-built drawings are submitted in accordance with ordinance requirements; 3) Authorize reduction of surety for Unit 4 not to be carried out until street lights have been installed and are operational. The surety remaining should include the remaining improvements listed in John Djerf's letter of December 14, 1989 minus $8,500 for street lights bringing the total Letter of Credit to $30,713 which includes the ten percent (10~) maintenance requirement; and 4) Authorise reduction of surety for Unit 5 not to be carried out until after street lights have been installed and are operational. The surety remaining should include the remaining improvements listed in John Djerf's letter of December 14, 1989 minus $10,200 for street lights bringing the total Letter of Credit to $98,414 which includes the ten percent (10~) maintenance requirement. Planner Waldock stated we received the "As-Built Drawings" on Unit 2 and 3 today. L. Kelly moved to reduce the "Letter of Credit" on Indian Oaks Unit 2 to $38,000 for maintenance. Seconded by J. Dement. Vote by roll call. Gaylord, yes; Dement, yes; Sharp, yes; Lewin, yes; Ke11y, yes. 5 yes, 0 no. Motion carried. L. Kelly moved to reduce the "Letter of Credit" for Indian Oaks Unit 3 to $36,300 for maintenance.. Seconded by J. Dement. Vote by roll call. Vote by roll call. Gaylord, yes; Dement, yes; Sharp, yes; Lewin, yes; Kelly, yes. 5 yes, 0 no. Motion carried. L. Ke11y moved to reduce the "Letter of Credit" for Indian Oaks Unit 5 to $150,000. Seconded by W. Sharp. Vote by roll call. Gaylord, yes; Dement, yes; Sharp, yes; Lewin, yes; Kelly, yes. 5 yes, 0 no. Motion carried. Mayor Latta questioned Mr. Sharp (Indian Oaks Developer) of the street cuts that were made on Indian Boundary Road. Is he aware it is his responsibility to do the repairs? Planner Waldock stated there are six (6) curb cuts on Indian Boundary Road. Five (5) were for Indian Oaks Subdivision and one (1) is the responsibility of the Village. Engineer Djerf stated it would be better for the road and the residents if the developer (Mr. Sharp) repaired those cuts in the road as soon as possible. Developer Sharp stated he would get the road cuts repaired as soon as weather is warm enough and the asphalt plants are open. The Board directed Attorney Harvey to draft the Resolution for Indian Oaks Unit 2 and 3 and also the Developer will provide the Village with the "Letters of Credit" with correct dates. This should be at the next meeting of February 19, 1990. L. Kelly moved to adjourn into Executive Session, to reconvene, with Workshop to fallow. Seconded by J. Gaylord. Voice vote. 5 yes, 0 no.
