FLAINFIELD VILLAGE BOARD OF TRUSTEES
REGULAR MEETING
DATE: FEBRUARY 5, 1990

Mayor Latta opened the meeting at 7:33 p.m. with the pledge to
the flag.
Roll call was taken, J. Gaylord and D. Lewin were absent.
J. Dement moved to approve the New/Old Business Section of the
Agenda to include an Executive Session for personnel before item
#14, Committee Reports, to reconvene and another Executive
Session for Land Acquisition, item #20, not to reconvene.
Seconded by D. Gullicksen. Voice vote. 4, yes, 0 no. Motion
carried.
The Board discussed the Salvation Army requests on the Consent
Agenda of activities during the 1990 year. It was the consensus
that they must identify dates of activities, therefore, their
request will be approved when the dates are given to the Village.
Planner Waldock spoke in reference to Planning Case No. 248-
. 1221892. Applicant - Arbor of Plainfield, Inc. Location - South
of Renwick Road, 400 feet west of Howard Avenue. Request -
rezoning from Residence A, single-family to Residence A-2, multi-
family. The applicants have requested the rezoning of 11.39
acres along the south side of Renwick Road. The subject area is
vacant farmland and is comprised of 2 outlots being platted as
part of Arbor Place Subdivision. The subject site is surrounded
by vacant farmland in each direction. A farmstead divided from
the original farm is located adjacent to the site and is occupied
as a single-family dwelling. Peerless Subdivisian is
approximately 475 feet east of the nearest rezoning boundary.
Plainfield Acres Subdivision (north of Renwick) is located
approximately 168 feet east of the nearest building site of the
rezoning area. The Comprehensive Plan has guided the vacant land
north of Renwick Road west of Howard as moderate density
residential. However, a pre-annexation agreement for that area

has established single-family zoning upon annexation. The Plan
Commission held a lengthy discussion of this case. Large numbers
of people were present to express opposition to the rezoning.
Norm and Ione Mueller submitted a legal objection regarding, this
case. A petition with 375 names was submitted in opposition as
well. Neither the legal objection or the petition specified a
reason for opposition, to this case. The Plan Commission
expressed concern over the unknown future use of the Spires
property adjacent and west of the site. They felt that this use
should be determined prior to rezoning of the subject site. Plan
Commission recommends denial of the rezoning request by Arbor of
Plainfield, Inc. for. an 11.39 acre site from Residence A to
Residence A-2 as requested. The vote was unanimous to deny. L.
Kelly spoke in reference to a letter circulated to the Board from
concerned homeowners. There are some statements in this letter
that are incorrect. All the vacant farm land is not to be
rezoned. The Board has never said there could be 300 townhouses
(rentals) on this property. It has never come to the Village
Board prior to this. The letter indicates this is the Township
Board, untrue. We are the Village Board, who has the final
decision. Mr. Waldock is not a member of the Board. He is the
• Village Planner. If we are going to discuss this property, lets
discuss the 11 acres only that is involved with this case. Mr.
Koop, a partner with Arbor of Plainfield, spoke and displayed
same prints. He stated this 11 acres was designated a moderate
density housing. The development would be cared for by the
Homeowners Association such as snow plowing, grass cutting,
shrubbery trimming, exterior and common areas of the building.
There will be 4 units per building. We could build 114 units on
this property. We have elected to build about 96-98 units. They
feel they .have the problem of the surface water worked. out. The
units will range from $100,000 to $115,000 (base price) per unit.
Single-family homes (2 bedroom) - $125,000 to $165,000. A11
units will have 2 car garages. Many residents from adjacent
properties attended the meeting and voiced their concerns. Nancy
Ross - sewer/water and schools; (answer) sewer/water will be from
the Village utilities and schools are up to the School District
but each building permit requires a school contribution. Mike
Bass - concerns of where the surface water will run; (answer) the
developers have hired a geologist, an engineer and they must
consult with the Village Engineer. The developer's engineer
stated there will be 3 ponds where the water will be retained.
Larry See, Township Raad Commissioner, stated there will be no
drain-off from these ponds to the south. It is already a swamp
in that .area. The drain file that was in that area and it
drained to the DuPage River, it has broken. It is on private
property. It does not drain at all anymore. We cannot stand
more water to the south. The retention ponds will help with

flash floods but they must be drained. the developers engineer
stated we must follow the ordinances for the Village of
Flainfield. Joe Conklin - how deep are the ponds to be?;
(answer) maximum 6' to 10'. Joel Mathison - are these units all
sale units?; (answer) all sale units. Tim Cummings - stated we
do not need multi-family between commercial and residents.
Attorney Peterson spoke representing Mr. and Mrs. Norman Mueller
who have filed an abjection to Arbor of Plainfield. There
property is directly across from Route 30 from Lake Renwick.
There concern is water run-off. Engineer Djerf stated each
property owner is responsible for there own water run-off.
J. Dement moved to concur with the Plan Commission recommendation
for denial of the rezoning request from Arbor of Plainfield, Inc.
for 11.39 acre site from Residence A to Residence A-2 as
requested. Seconded by D. Gullicksen. Vote by roll call.

no. Motion carried.
L. Kelly stated we have denied this request but we do need this
type of housing in our community. It is just finding an area.
It is a difficult situation where we already have single-family.
We have areas to the north and west that would allow far this
type of development.
w. Sharp moved for a 5 minute break. Seconded by J. Dement.
Voice vote. 4 yes, 0 no. Motion carried.

Planner waldock spoke in reference to Case #242-113089V.
Applicant - Douglas Graver. Location - 404 west Chicago Street.
Request - variance of 8 feet from the Residence A. Ten foot
(10') rear yard setback requirement for an 18' x 19' attached
garage. Hardships exist due to the size of the lot which is 66'
x 58' and is surrounded by fully developed parcels. The Zoning
Board of Appeals recommends approval of a variance.
L. Ke11y moved to concur with the Zoning Board of Appeals and
approve the variance (Case #242-113089) allowing an attached
garage 3 feet from the south rear property line where 10 feet is
required by ordinance. Seconded by W. Sharp. Vote by roll call.

Planner Waldock spoke in reference to Case #247-121889V.
Applicant - Dr. Joseph and Sally Conklin. Location - southwest
corner of Lockport and James Streets. Request - variance to
allow construction of an office at 20 foot front yard setback
where 30 feet is required. The findings by the Zoning Board of
Appeals are: 1) the setbacks as proposed would not be a negative
impact to the neighborhood; 2) the proposed setbacks are
consistent ,with surrounding properties; 3) the Village will
benefit by maintaining consistent development. standards for
downtown sites; and 4) setbacks, if approved, would preserve a
large oak tree on site. The Zoning Board of Appeals recommends
approval of the requested variances to allow 20' building
setbacks from Lockport and James Streets.
L. Kelly moved to concur with the Zoning Board of Appeals and
approve the request to allow 20' building setback from Lockport
and James Street for a construction of an office at the southwest
corner. Seconded by J. Dement. Vote by roll call. Dement, yes;
Sharp, yes; Kelly, yes; Gullicksen, yes. 4 yes, 0 no. Motion
carried,
• Planner Waldock spoke in reference to the request from Robert
Rogina, Engineer for Phoenix Developers, requesting acceptance of
public improvements for Units 2 and 3 of Indian Oaks Estates and
reduction of the Letters of Credit far Units 4 and 5. Harry
Countryman, Ron Miller, Peter Waldock and Engineer John. Djerf
have conducted a site inspection to determine the extent of the
public improvements. At that time, we found. Unit 2 complete;
Unit 3 needs some maintenance work, silt has built up in the
storm sewer line and should be cleaned out; as built drawings
have not been furnished to the Village. However, a reduction of
the surety is not unreasonable in light of the fact that the
physical improvements are complete and the Letter of Credit is
about to expire on February 18, 1990 so a new surety will be
needed. Engineer Djerf ,stated he has a set of "As Built
Drawings" for Unit 2, does not have them for Unit 3. Planner
Waldock stated we are recommending withholding acceptance of
improvement until we receive the "As Built Drawings" and the
Letter of Credit be reduced to maintenance level of 10~ surety.
It was the consensus of the Board after much more discussion -
Unit 2 is complete with Engineer Djerf having one (1) set of "As
Built Drawings".
W. Sharp moved to reduce the surety to 10~ of original level or
$38,000. Seconded by J. Dement. Motion rescinded.

It was the consensus of the Board on Unit 3 that three (3) sets
of "As Built Drawings" must be supplied to the Village and direct
Attorney Harvey to draft a resolution to reduce the surety, and a
"Letter of Credit" submitted to him for review prior to the
continued meeting of next Monday, February 12, 1990. Unit 4 and
5 are in need of the street lighting. The develop stated they
are' having problems getting Commonwealth Edison in to get the
street lighting installed. Commonwealth Edison is in a back log.
They are requesting a reduction of the "Letter of Credit". It
was the consensus of the Board for the staff to check into Unit
3, 4 and 5 and bring a recommendation to the Board at the
continued meeting on February 12, 1990.
L. Kelly moved to adopt Ordinance No. 1313 Zoning Property Owned
By First Midwest Bank/Tllinois As Trustee Under Trust No. 189
(Lichtenwalter). Seconded by D. Gullicksen. Vote by roll call.

no. Motion carried.
L. Kelly moved to adopt Ordinance No. 1314 Annexing Property
Owned By Mary C. Stephens. Seconded by D. Gullicksen. Vote by
roll call. Dement, yes; Sharp, yes; Kelly, yes; Gullicksen, yes.

L. Kelly moved to adopt Ordinance Na. 1315 Disconnecting Certain
Territory Owned By Mary C. Stephens From The Village Of
Plainfield Corporate Limits. Seconded by D. Gullicksen. Vote by
roll call. Dement, yes; Sharp, yes; Kelly, yes; Gullicksen, yes.

J. Dement moved to adopt Ordinance No. 1316 Abating The 1989 Tax
Levy For The $2,125,000 General Obligation Bands, Series 1989 Of
The Village Of Plainfield, Illinois. Seconded by D. Gullicksen.
Vote by roll call. Dement, yes; Sharp, yes; Kelly, yes;
Gullicksen, yes. 4 yes, 0 no. Motion carried.
W. Sharp moved to adopt Resolution No. 961 Authorizing The
Execution Of Documents In Regards To The Village Of Plainfield's
Recycling Grant Application. Seconded by D, Gullicksen. Voice
vote. 4 yes, 0 no. Motion carried.
J. Dement moved to adopt Resolution Na. 962 Authorizing The
Execution Of An Easement Agreement Between The Village Of
Plainfield And Commonwealth Edison Company. Seconded by W.
Sharp. Voice vote. 4 yes, 0 no. Motion carried.

D. Gullicksen moved to issue payout #6 in the amount of $75,069
to Louis. Ruffolo and Son Construction. Company upon receipt of all
applicable waivers of lien and Contractors Affidavit and it shall
be charged to Water/Sewer accounts 02-10-91-0713 and. 02-11-91-
0714 (funded by G.O. "Alternate" Bonds). Seconded by J. Dement.
Vote by roll call. Dement, yes; Sharp, yes; Kelly, yes;
Gullicksen, yes. 4 yes, 0 no. Motion carried.'
W. Sharp moved to pay the bills for the period of February 1,
1990 through February 15, 1990. Seconded by D. Gullicksen. Vote

yes. 4 yes, 0 no. Motion carried.
D. Gullicksen acknowledged receipt of the Treasurer's Report
(January 30, 1990).
W. Sharp moved to adjourn into Executive Session, to reconvene.

carried.

to $9.81 per hour or $20,400 annually, effective this pay period.

W. Sharp moved to increase the salary of Officer Kenneth Gettemy
to $9.81 per hour or $20,400. annually, effective this pay period.
Seconded by J. Dement. Voice vote. 4 yes, 0 no. Motion
carried.
James Scarpetta and Kenneth Gettemy completed their basic
training on January 17, 1990.
W. Sharp moved to increase the salary of Kevin Adams to $10.33
per hour or $21,481 annually, effective this pay period.
Seconded by D. Gullicksen. Voice vote. 4 yes, 0 no. Motion
carried.
W. Sharp moved to increase the salary of Donna Prince,
Dispatcher, to $7.50 per hour or $15,600 annually, effective this
pay period. Seconded by J. Dement. Voice vote. 4 yes, 0 no.

W. Sharp moved to increase the salary of Troy Hambly, part-time
Dispatcher, to $7.50 per hour, effective this pay period.
Seconded by D. Gullicksen. Voice vote. 4 yes, 0 no. Motion
carried.
L. Kelly reported tomorrow night is the Plan Commission meeting
and the Cerra Case is on the agenda. The Village formally
objected to this case previously, now they are returning.
Planner Waldock reported Coilplus is requesting an interpretation
that a 40,000 square foot addition not apply to our ordinance.
It's coming to Plan Commission tomorrow night.
L. Ke11y moved to continue this meeting to Monday, February 12th
on Indian Oaks and an Executive Session on land acquisition.
Seconded by W. Sharp. Voice vote. 4 yes, 0 no. Motion carried.
