O'REILLY & ASSOCIATES, INC. is submitting the attached Notice of Intent, Proposed Site Plan and the associated paperwork for the proposed project at the above referenced property. The project proposes to install a seasonal dock, create a vista corridor from the existing deck area, to remove invasive plant species in the area of the dock, to convert a gravel patio area to a paver patio area and replanting an area within the rear yard with native plant species, within the rear yard. Wetland Resource: The property abuts Blueberry Pond (A Great Pond). Adjacent to the Pond is a Bordering Vegetated Wetland (BVW) and has been flagged in the field. Flags #1 to #11 are shown on the Site Plan and represent the landward extent of the wetland. The 50- and 100 -foot Buffer Zones have been delineated and shown based on the edge of the BVW. NOTE: In 2011, the edge of the BVW was reviewed and approved by the Brewster Conservation Commission for proposed work by the former owner (Johnson). Project Narrative: The project consists of several different proposals. The proposed requests are as follows: 1. Seasonal Dock: The applicant would like to install a seasonal dock into the waters of Blueberry Pond. Due to the water depth available, the proposed dock should be considered a dingy dock. The Applicants are requesting the Commission grant the necessary variances for the dock to protect the shoreline from foot traffic getting into and out of the pond area. The dock is not fully compliant with the Town's Dock regulations in that the available water at the end of the dock does not comply with the requirement of 2,5 feet of water depth. The dock has been laid out to provide 1.3 feet of water at the end of the dock. The dock will consist of three 8'x4' dock sections in a 'T' layout and be supported by a total of eight (8) posts. The dock will begin just landward of the edge of the pond. 1573 MAIN STREET, P.O. The dock sections will be stored in an area beyond the 50 -foot Buffer zone within the existing lawn area. Pond Bottom Analysis: J.M. O'Reilly & Associates, Inc. completed an evaluation of the pond bottom. The evaluation found the existing pond bottom to be covered with layer of muck (mud). The pond bottom, below the muck (mud), was found to be sandy with several cobbles. Shellfish (freshwater) were not found during the field inspection. 2. Invasive Species Removal: The applicants would like to remove the invasive species in a former beach area. The applicants are interested in removing the invasives to allow the native species to thrive. The removal will be done by hand, no chemicals will be used to control the vegetation. Once the invasives are removed, the area will be reviewed by the Applicant and the Agent to determine if additional native species are needed to fill in the area. 3. Vista Corridor: The Vista Corridor is proposed to be from the existing deck area. The proposed pruning is of the lower limbs of the large trees within the corridor. The removal of the limbs will follow the 10% removal limit of the tree canopy. 4. Patio Conversion: A portion of the large existing gravel patio area will be converted to a dry -laid paver patio area. The remaining gravel patio areas will be eliminated and converted to planting beds. The proposal reflects a reduction of about 295 sf hardscape area within the Buffer Zone. 5. Re -Planting Area: The proposal is to remove the existing vegetation within an isolated area in the rear yard. The area will be planted with different native species to provide more diversity to the back yard and ultimately the wildlife. Refer to the plan for planting details. The planting and converting of the area will be completed in phases to not create an issue with erosion and wash out. Variance Request: The proposed dock, invasive species removal, the vista corridor, and a portion of the Re -Planting area is in the resource areas and the 50 -foot Buffer area. As such the proposed work requires a variance from the Brewster Wetland Regulations. Seasonal Dock: The dock has been designed in accordance with the guidelines of the Brewster Policy for Docks, as a dingy dock. Alternatives: 1. Do nothing: • This alternative to the dock is currently occurring. Access to the Pond is via the existing pathway. The foot traffic over the BVW would cause impact to both the BVW and Pond. The alternative is not an option for the applicants. 2. Permanent Dock: • The dock could be permanent to avoid the seasonal disturbance of the Pond's bottom. The one-time installation of the piles would eliminate the need for the spring and fall disturbance to place the small pads onto the Pond's bottom. This alternative was rejected since a permanent dock structure is in direct contrast with the requirements of the Conservation Commission. Also, the potential for ice buildup on the Pond would cause damage to the pile system and would most likely require seasonal adjustment of the piles, which would negate the avoidance of the seasonal installation of the pads. As part of the variance request, we offer the following: • Cost of the dock will be approximately $15,000 +/-. • Time to install the dock and stairway will be approximately 2 weeks from start to finish. Vista Corridor, Invasive Removal and Re -Planting Areas: Although these alterations require a variance from the Commission, the Applicant is hoping the commission sees these proposals as positive steps in ensuring a diverse native habitat. The removal of the invasives from the area of the dock will enhance the native plant species. The vista corridor proposal is in keeping with the policies of the Commission for other corridor proposals. The Re -Planting area will result in a more diverse native vegetation which in turn will benefit the habitat in the area. It is the opinion of J.M. O'REILLY & ASSOCIATES, INC, the project meets the conditions of a variance. The project can be approved with conditions which will ensure the protection of the interests of the Brewster Wetland By -Law. (Please refer to the locus map within this filing) A two-story mixed use structure with associated appurtenances currently exists on the site. The existing building was built in 1976. Currently there is a doctor's office on the first floor and apartments on the second floor. The project is the construction of an addition along the back of the existing building within the 100 foot buffer zone to an inland wetland resource area. The purpose of the addition to provide storage space, a conference room and private office space for the doctors' office. Inland Wetland Resource Areas/Bordering Vegetated Wetland and Ditch The project site is overlapped by a small section of bordering vegetated wetland and a ditch in the easterly portion of the lot. The bordering vegetated wetland was formerly a cranberry bog according to the 1973 subdivision plan; currently the bog is currently a wooded swamp. There is a head wall at the drainage ditch at the northerly end of the old bog. Project Description / Construction Protocol The project is construction of a 14' x 42' (588 square foot) one story addition on the back of the existing building underneath the footprint of an existing second story deck. The proposed addition will have a frost wall foundation. The stairway serving the existing deck will be re -located to the southerly side of the building. Installation of Erosion Control Prior to any disturbance on the site, erosion control, in the form of a silt fence barrier will be installed. The silt fence barrier is intended to act as a limit of work and shall remain in place until all disturbed areas from construction have been stabilized upon completion of the project or returned to their original condition. Disturbed areas will be seeded and revegetated upon completion of the project. The silt fence barrier is also intended to act as a work limit / limit of disturbance. Details and location of the erosion control barrier are shown on the site plan. Driveway / Construction Access and Staging The existing driveway and parking areas will provide construction access and construction staging area. Construction Access / General Construction Housekeeping Construction debris will be removed offsite daily or as required to a facility licensed to accept construction debris. There will be no construction debris stockpiling within the work limit. Septic System No changes to the septic system are necessary in conjunction with the project. The project has been designed to prevent adverse impacts from construction and on -going use of the property. Erosion and siltation concerns have been addressed by providing temporary and on -going structures such as the silt fence barrier and the use of drywells to collect roof runoff. It is our opinion that the construction project as proposed and in conjunction will not have a significant adverse impact on the resource areas or the values protected by the Brewster Wetlands By -Law and the Massachusetts Wetlands Protection Act.
