Surveying the site would entail taking tissue samples (small leaf clippings) of smooth cordgrass and observational data on plant heights, community composition, and elevation. Forces like increased storm frequency, sea level rise, and increasing temperatures threaten the ability of coastal ecosystems to provide us with invaluable ecosystem services (Barbier et al. 2011). Identifying factors that promote resiliency, the ability of a system to withstand and recover from disturbances, in our coastal habitats is therefore a crucial task. Ultimately, such work allows us to create a safer and more sustainable future. One factor that promotes resiliency is a system’s genetic diversity. Historically understudied, genetic diversity underpins a range of ecosystem dynamics and functions (Hughes et al. 2008a). Notably, greater genetic diversity increases a systems’ resistance to disturbance (Hughes & Stachowicz 2004; Reusch et al. 2005), primary and secondary production (Hughes et al. 2008b), invasion resistance (Crutsinger et al. 2008), and diversity at higher trophic levels (Zerebecki 2018). Genetic diversity is also the foundation on which evolution occurs; as such populations with greater genetic diversity are more likely to adapt to changing environmental conditions (Etterson 2004; Hoffmann & Sgró 2011). In sum, genetic diversity promotes both short- term ecological resiliency and functioning, and long-term evolutionary potential. When it comes to ecosystem restoration, we have little empirical evidence for how to restore genetically diverse populations (Kettenring et al. 2014; Basey et al. 2015). This is a demanding task; restoration is not a standard process - numerous strategies are commonly used, and we know relatively little about how specific techniques affect genetic diversity (Basey et al. 2015). Therefore, work explicitly investigating the genetic consequences of management techniques is needed to build our understanding of how to restore genetically diverse populations. Two broad types of techniques used in restoration are passive and active restoration. Passive techniques remove disturbances or stressors and then allow a system to recover on its own, while active techniques also remove the stressor but then assist recovery with additional efforts (Jones et al. 2018). Both methods are used to re-vegetate restored salt marshes in New England. Passive salt marsh revegetation constitutes removing barriers to tidal flow, and then allowing colonization from nearby habitats to revegetate the restored system; here, genetic diversity depends on the extent to which dispersal to and establishment in the restoration is possible. Active salt marsh revegetation constitutes removing barriers to tidal flow and then planting or seeding vegetation, and as such genetic diversity additionally depends on the sourced materials. Past empirical work does not lead to clear predictions about these strategies’ impact on genetic diversity 2 Intraspecific diversity in passively and actively restored salt marshes (Jones et al., 2018, Gornish et al., 2017, Crouzeilles et al., 2017); therefore specific work comparing these two techniques’ genetic outcomes is necessary. Along with genetic diversity, intraspecific variation in traits (i.e. phenotypes) can also be an important determinant of population and ecosystem dynamics. In salt marshes, S. alterniflora height typically exhibits two distinct growth forms – tall and short (Gallagher et al., 1988). Tall- form plants grow at lower elevations that experience greater inundation, and short-form plants grow at higher elevations - creating a gradient in height along the marsh profile (Pennings & Bertness, 2000). Numerous environmental conditions and plant traits vary along this gradient (e.g. Howes et al. 1981; Seliskar 1985; Lin et al. 2019), and as such, variation in S. alterniflora height has broad implications. Assessing whether passive and active restoration impacts S. alterniflora height variation as well as genotypic variation will yield a more comprehensive understanding of how restoration practice can influence intraspecific diversity. An assessment of the intraspecific outcomes of passive versus active restoration will be valuable for determining best-practices for restoration - ensuring that the methods we use to restore salt marsh plant populations meet our restoration goals (Kettenring et al., 2014). To this end, I am conducting a comprehensive observational study quantifying genetic diversity and intraspecific height diversity in passive and actively restored salt marsh restorations as well as in natural marshes across Southern New England. Questions and hypotheses • Do S. alterniflora populations differ in genotypic diversity and height variation across passively and actively restored salt marshes? • How do S. alterniflora genotypic diversity and height variation in restorations compare to S. alterniflora populations in natural marshes? Methods Study sites I am sampling passively and actively restored and natural salt marshes across Southern New England (Massachusetts, Connecticut, and Rhode Island). Ten sites of each marsh type, distributed evenly across the study area, are being sampled. Data and sample collection At each site, we will lay two transects; one will run parallel to and the other perpendicular from the creek bed. Along these transects we will collect S. alterniflora tissue samples and collect supplementary data. Transect 1 At each site, we will lay a 40m transect parallel and one meter back from the creek bed. Every 4m along this transect we will establish 10 1m2 sampling plots, from which we will collect tissue samples (Figure 1). In each sampling plot, we will haphazardly select 10 individuals from which we will clip a ~10cm long sample of leaf tissue (Figure 1). Tissue samples will be preserved via desiccation with silica for molecular analysis. Figure 1. Transect 1 sampling scheme. A 40m transect will run parallel and one meter back from the creek. Every four meters, we will collect 10 S. alterniflora leaf tissue samples from a 1m2 plot. Transect 2 At each site, we will establish a transect starting from the creek bed and running perpendicular for 100m (Figure 2). Along this transect, we will establish 20 0.25m2 survey plots every 5m. At each sampling plot, we will determine elevation using a trimble (a handheld device). In each sampling plot, we will A) measure the height (cm) of 5 S. alterniflora individuals, B) count the number of S. alterniflora stems rooted in the plot, C) estimate species percent cover, and D) collect tissue samples from 5 S. alterniflora individuals (Note: between the two transects, N=200 tissue samples from 200 S. alterniflora individuals will be collected.) The purpose of the proposed project is to remove several small areas characterized by invasive species and replant these areas with native species that will provide more valuable habitat, improve soil stability, and protect the integrity of the natural environment on site in the long term. EXISTING CONDITIONS On property there is a coastal dune abutting Cape Cod Bay that extends to the existing dwelling. Vegetated areas at the front and sides of the dwelling are primarily landscape plants. Along the east side of the property there are three non-native Leyland cypress, and along the west side of the property there is an area (250 +/- sf) of invasive species, primarily Oriental bittersweet and shrub honeysuckle. There is another small area of invasive vegetation at the top of the coastal bank (350 +/- sf), also dominated by Oriental bittersweet and shrub honeysuckle. Aerial photo courtesy of Google Earth. N A p p r o x . p r o p e r t y l i n e A p p r o x . p r o p e r t y l i n e 3 PROPOSED PROJECT ACTIVITIES This project proposes to remove existing occurences of invasive species as well as three non-native Leyland cypress. The Leyland cypress will be replaced in kind with native Eastern red cedar (Juniperus virginiana) as well as (3) Bayberry shrubs (Morella pensylvanica). The area of invasives at the top of the scarp will be replanted with American beachgrass (Ammophila breviligulata) which will provide an appropriate habitat for this type of environment and help stabilize the top of the slope. The area of invasives along the west side of the property will be replanted with native grasses including Common hairgrass (Deschampsia flexuosa) and Little bluestem (Schizachyrium scoparium), and will also be planted with (3) Beachplum shrubs (Prunus maritima) and (3) Eastern red cedar trees (Junierus virginiana). In addition to the invasive species removal, this project seeks to replace in kind the existing stockade fence on the west side of the property with a natural wood fence, to be constructed 6” off the ground to allow wildlife passage underneath. The project also proposes dune enhancement on an as-need basis. Enhancement would include sand nourishment using a compatible material to what is existing on the dune currently, as well as planting of American beachgrass. Sand nourishment would not exceed 45 yd3 annually. American beachgrass planting would be done by planting two bare root culms per hole with each hole at twelve inches on center. There is no coastal engineering structure currently on site, and dune enhancement measures would ensure that the integrity of the dune and the habitat it provides are preserved in the long term. Because removal work is proposed to occur in Spring/Summer 2022 during bird nesting season, special precautions have been outlined on the restoration plan to ensure that any active nesting sites or other valuable widlife habitat are protected properly. The restoration areas are small and in places the invasive species are sporadic so it is not anticipated that wildlife are actually using these areas for nesting habitat. Treat and remove all invasive, non-native species and approved vegetation using an appropriate herbicide (Glyphosate-based or Triclopyr-based) using a cut and wipe method. Around native trees or other species to remain, complete removal work by hand. Existing root systems to be left in place to maintain soil stability. 2. Seed any exposed soils resulting from debris removal with a native seed mix where appropriate (refer to Restoration Plan) to establish native vegetative ground cover. 3. Cover removal areas with erosion control blankets to increase seed/soil contact, improve germination, and reduce potential for erosion and runoff. 4. Rejuvenate any native shrub species uncovered in the restoration area, if needed, with regenerative pruning techniques. MAINTENANCE - 2022 - 2024 1. Monitor restoration area and perform maintenance treatments or hand weed invasive, non- native, and aggressive species that have germinated from existing seed bank, or re-sprouted from roots remaining in the soil. 2. Prune dead, diseased, broken or interfering limbs to maintain health of overstory specimens. RESTORATION PLANTING - FALL 2022 1. Restoration plantings to be installed in Fall 2022, provided invasive species levels have reached approximately 80% eradication. ONGOING MAINTENANCE 1. Property will remain under active management to eradicate invasive & non-native species through hand weeding or cut & wipe treatments as necessary. HERBICIDE APPLICATION INFORMATION All herbicide applications will be performed by a Massachusetts State-Licensed and insured pesticide applicator proficient in plant identification, both in leaf and bare-twig. Herbicide applications will be direct stem applications (cut and wipe). This method of application safeguards native and desired species from over-spray and minimizes the total volume of herbicide needed to effectively manage the target species. Herbicides used will contain Triclopyr or Glyphosate as their active ingredient. Triclopyr is a selective herbicide and will be utilized for most invasive and aggressive broad leaved target species to ensure that native grasses are not damaged. Glyphosate will be used to manage vine and shrub honeysuckle, English ivy, and monocot species as Triclopyr has been observed to have little or no effect. The highly selective herbicide applications will neutralize root materials left in the soil and inhibit new growth. (b) disturbing the vegetative cover so as to destabilize the dune; Only invasive vegetation is proposed for removal, and the areas for removal will be densely replanted with native species that will be more effective in stabilizing the dune. Immediately after removal, the areas will be seeded with a native seed mix to establish a groundcover. In addition, all areas for removal will be covered with bio-degradable erosion control blankets or a layer of sterilized chopped straw to decrease erosion potential until planting occurs. (c) causing any modification of the dune form that would increase the potential for storm or flood damage; The form of the dune will not be altered. (4) Notwithstanding the provisions of 310 CMR 10.28(3), when a building already exists upon a coastal dune, a project accessory to the existing building may be permitted, provided that such work, using the best commercially available measures, minimizes the adverse effect on the coastal dune caused by the impacts listed in 310 CMR 10.28(3)(b) through (e). Such an accessory project may include, but is not limited to, a small shed or a small parking area for residences. It shall not include coastal engineering structures. No project accessory to the existing building is proposed. (5) The following projects may be permitted, provided that they adhere to the provisions of 310 CMR 10.28(3): (a) pedestrian walkways, designed to minimize the disturbance to the vegetative cover and traditional bird nesting habitat; No pedestrian walkway is proposed. (b) fencing and other devices designed to increase dune development; A zig-zag line of snow fencing may be installed in the dune enhancement area to encourage natural sand accretion and dune development. An existing stockade fence along the property line 7 is proposed to be replaced in kind with an untreated natural wood fence. (c) plantings compatible with the natural vegetative cover. Species proposed to replace those being removed are entirely native to Barnstable County. (6) Notwithstanding the provisions of 310 CMR 10.28(3) through (5), no project may be permitted which will have any adverse effect on specified habitat sites of Rare Species, as identified by procedures established under 310 CMR 10.37. The coastal dune on site is identified as habitat of rare wildlife. The only proposed work occuring on the coastal dune is invasive species management. Disturbance of this small area will be limited to cut and wipe treatment of sporadic invasive and non-native species and planting with native grass plugs. The resulting habitat will be better able to support a diverse native habitat. 10.57: Land Subject to Flooding (4) General Performance Standards (a) Bordering Land Subject to Flooding 1. Compensatory storage shall be provided for all flood storage volume that will be lost as the result of a proposed project within Bordering Land Subject to Flooding, when in the judgment of the issuing authority said loss will cause an increase or will contribute incrementally to an increase in the horizontal extent and level of flood waters during peak flows. Compensatory storage shall mean a volume not previously used for flood storage and shall be incrementally equal to the theoretical volume of flood water at each elevation, up to and including the 100-year flood elevation, which would be displaced by the proposed project. Such compensatory volume shall have an unrestricted hydraulic connection to the same waterway or water body. Further, with respect to waterways, such compensatory volume shall be provided within the same reach of the river, stream or creek. The proposed project will not result in any flood storage volume being lost. 2. Work within Bordering Land Subject to Flooding, including that work required to provide the above-specified compensatory storage, shall not restrict flows so as to cause an increase in flood stage or velocity. No work is proposed which will alter flows. 3. Work in those portions of bordering land subject to flooding found to be significant to the protection of wildlife habitat shall not impair its capacity to provide important wildlife habitat functions. Except for work which would adversely affect vernal pool habitat, a project or projects on a single lot, for which Notice(s) of Intent is filed on or after November 1, 1987, that (cumulatively) alter(s) up to 10% or 5,000 square feet (whichever is less) of land in this resource area found to be significant to the protection of wildlife habitat, shall not be deemed to impair its capacity to provide important wildlife habitat functions. Additional alterations beyond the above threshold, or altering vernal pool habitat, may be permitted if they will have no adverse effects on wildlife habitat, as determined by procedures contained in 310 CMR 10.60. The proposed project will improve wildlife habitat by replacing existing invasive and non-native vegetation with entirely native species that support a more diverse ecosystem. (c) Protection of Rare Wildlife Species Notwithstanding the provisions of 310 CMR 10.57(4)(a) or (b), no project may be permitted which will have any adverse effect on specified wildlife habitat sites of rare vertebrate or invertebrate species, as identified by procedures established under 310 CMR 10.59. 8 The coastal dune on site is identified as habitat of rare wildlife. The only proposed work occuring on the coastal dune is invasive species management and dune enhancement through nourishment and planting. Disturbance of this small area will be limited to cut and wipe treatment of sporadic invasive and non-native species and planting with native grass plugs. Only invasive species removal and planting of native species is proposed, which will have no impact on the form or function of the dune, and will improve habitat value. (4) Any activity which is allowed under a variance granted pursuant to Section 5.01 of these regulations on a coastal dune or within 100 feet of a coastal dune shall not have an adverse effect on the coastal dune by: (a) affecting the ability of waves to remove sand from the dune; The proposed project will not affect the ability of waves to remove sand from the dune. (b) disturbing the vegetative cover so as to destabilize the dune; Only invasive vegetation is proposed for removal, and the areas for removal will be replanted with native species that will be more effective in stabilizing the dune. The proposed project will not result in the building within or upon, removing, filling, or altering of land subject to flooding. (4) Any activity which is allowed under a variance granted pursuant to Section 5.01 of these regulations on land subject to flooding shall not result in the following: (a) Flood damage due to filling which causes lateral displacement of water that would otherwise be confined within said area. Proposed work does not involve any altering, removing, or adding of material which would cause lateral displacement of water. (b) An adverse effect on public and private water supply or ground water supply where said area is underlain by pervious material. The project has the potential to improve ground water quality by replacing invasive vegetation with native vegetation containing fibrous root systems which is better able to filter out toxins. (c) An adverse effect on the capacity of said area to prevent pollution of the ground water, where the area is underlain by pervious material which in turn is covered by a mat of organic peat and muck. The project has the potential to improve pollution prevention by replacing invasive vegetation with native vegetation containing fibrous root systems which is better able to filter out toxins. 5.01: Variances Alternatives Analysis 1. Description of Project This project proposes to restore habitat by removing invasive and non-native species and replanting the area with native shrubs and herbaceous material. This project also proposes to replace an existing stockade fence in kind with an untreated natural wood fence. 2. Summary of Alternatives (1) Existing invasive vegetation could be left as is. No invasive or non-native species removal or native planting would be completed, leaving the existing naturalized areas in their current condition. The current condition creates a habitat with very little native plant species diversity inconducive of high quality wildlife habitat. The invasive 10 and non-native vegetation offers lower quality habitat value, outcompetes native species, and does not support erosion control as well as species with deep fibrous root systems. (2) The restoration project could be completed without the replacement of the existing stockade fence. Invasive and non-native species would be removed and native species of shrubs and herbaceous material would be planted to revegetate the areas of removal, and the stockade fence would remain in place. However, the stockade fence is located more upland, and only extends roughly as far as the edge of the existing deck. Removing the fence would ease the process of removing the invasive vegetation, and the fence that would replace it would occupy the same footprint as that which is existing. 3. Summary of Potential Environmental Benefits Should the project be completed, it would remove invasive and non-native species and revegetate the affected areas with native species of shrubs and herbaceous vegetation. This would eliminate invasive species that outcompete native species, creating a native habitat that supports local ecology and wildlife. Native species also have more robust root systems that have the potential to improve soil stability. Dune enhancement will provide a greater storm resiliency and increased habitat. 4. Summary of Potential Environmental Impacts Environmental impacts are temporary and short-term with the initial vegetation removal. A bird nesting survey will be conducted prior to work to ensure no impact to nesting birds occurs. The project will begin supporting a diversity of grasses only a few months after the initial disturbance. 5. Mitigation Measures In restoration areas, existing invasive and non-native vegetation will be removed while preserving native plant species where feasible. Where vegetation is to be removed around native trees or other species intended to remain, removal work will be completed by hand. Vegetation for removal will be flush-cut with root systems left in place to preserve soil stability. Vegetation will be removed and initially treated using a cut-and-wipe method with an EPA approved herbicide so as to limit soil disturbance and to retain any existing native species within close proximity. Native species remaining may be regeneratively pruned, if necessary, to encourage new, vigorous growth and reduce the potential for branch breakage and storm damage on specimens that are “leggy” after invasive species are removed. After removal of invasive and non-native vegetation, any bare spots will be seeded with a native seed mix and covered with erosion control blankets. Native shrubs and grasses will be planted to fill in areas left by invasive species removal to create a diverse native habitat. 6. Timetable INITIAL MANAGEMENT - SPRING/SUMMER 2022 1. Project Description: The Notice of Intent application is for an After the Fact filing for a violation that occurred at the above mention property. The violation was cutting and pruning within the 0'-100' buffers without conservation approval. On behalf of our client, Elizabeth Vining, a variance is requested from the Brewster Wetlands Protection Bylaw to allow work within the Bordering Vegetated Wetland and the associated 0'-100' buffer zone to the wetland resource area. The proposed project consists of restoration plantings as shown on the included plan labeled "Planting Restoration Plan", prepared for Elizabeth Vining and dated April 25, 2022. The designated area will also be cleared of any debris created by the violation. Also proposed is vista pruning within this area. This will consist of selected pruning of the understory shrubs to establish a window to Myricks Pond that extends from the deck to the property line within the confines of the "edge of clearing" as shown on the abovementioned plan. Native vegetation will be pruned but not removed and this will not include mowing. Vista pruning will be performed in a manner to promote the survivability of the low-lying shrubs and trees in the area in order to limit the adverse impacts to the bordering Vegetated Wetland. The vista pruning within the established corridor will not result in adverse impacts to the Bordering Vegetated Wetland (BVW) resource area and associated 100' buffer. The BVW will still be significant to wildlife, groundwater control, flood control, storm damage prevention and prevention of pollution. Construction Protocol: The seed mix will be spread first then covered with an erosion control blanket. The proposed shrubs will be located and planted after the spreading of the seed mix. Temporary irrigation will be installed. All work will be done by hand. GOV Notice of Intent Filing Checklist OFFICE OF CONSERVATION COMMISSION Before you submit your Notice of Intent to the Conservation Commission and other applicable agencies, please complete and sign this checklist, showing that you understand and have completed all of the forms and procedures required for a Notice of Intent filing. The Conservation Commission will not open the hearing if the filing is not complete. The Conservation Commission requires one (1) complete electronic copy and three (3) complete paper copies of the Notice of Intent and attached plan(s) for each filing. Include each item of the application, with pages numbered consecutively and in the order designated on this checklist. Staple these pages together, and attach the plan(s) with a paper clip. Collectively, each item of the application and the plan(s) represent one complete copy. This list will provide the names of all direct abutters to the property (first abutters), all that abut the first abutters (second abutters) if they are within 300 feet of the lot lines of the property, and lot(s) directly across the street from your lot. The street is the first abutter and lots directly across, second abutters. If abutters are in another town, obtain a certified list of these abutters from the assessors' office in that town, and submit it and the appropriate assessors' map in the application also. 2. Notify all abutters on the list of your proposed project on the "Notice to Abutters" form letter, by certified, return receipt mail before or on the day of filing, and submit the Certified Mail Receipts (Form 3800) as part of the filing. Submit the Certified Mail Receipt of the application sent to the DEP and, if applicable, the MA Division of Fisheries and Wildlife's Natural Heritage & Endangered Species Program. Include a professional site plan, scale, 1" = 20", clearly showing: • In color, the wetland line (green), fifty foot buffer zone (red) and one hundred -foot buffer zone (dark blue) delineations, • wetland flags numbered to correspond with each Field Data Form, • topography (minimum 2 foot), contour line and spot elevation, • the insignia of the applicable professional(s) who designed the plan, in compliance with the Brewster Conservation Commission Policy for Plans for Wetlands Permitting of 3/8/05. All site plans; original and revised, shall show the wetland and buffer zones in color. 16. Include elevation drawings of the proposed structure(s) on paper of 8 1/2" x 11" or 11" x 17". 17. If the lot is an undeveloped, secluded, or otherwise unidentifiable area, identify the lot on the plan by the number of the nearest telephone pole or the nearest road intersection. If there is no pole on the lot, describe the lot's proximity to the nearest; for example, "the lot is twelve feet east of telephone pole no.167". 18. Fold each plan separately, right side out with title visible, and attach it to each copy of the a plication. 19. Include signed Site Access Authorization Form. Conservation Commissioners and Department s ff will inspect the site. 20. Properly stake and flag the project site to identify all required portions of the project, prior to the day of filing. • Clearly stake all boundaries and limits of work. • Clearly identify all stakes and flags in the field, showing the one hundred foot and 50 foot buffer zones and all wetland areas. • Designate each wetland type on the flag as "BVW" (bordering vegetated wetland), "TOB" (top of bank), "LSF" (land subject to flooding), etc. Unless a holiday interferes, the filing deadline for all applications is noon on the Thursday at least ten (10) business days before the hearing. The hearing must be advertised in a local newspaper (at this time, the Cape Codder Newspaper) no less than five business days before a hearing. When a holiday interferes with the Friday production, the newspaper will notify the town of its earlier deadline. Additional information or revised plans for continued hearings must be submitted no later than Monday at 4:00 PM, eight (8) days prior to the hearing.
