COMMISSION CHAMBERS OF THE TOWN HALL, 100 SEA ROAD, GULF STREAM, FLORIDA. I. CALL TO ORDER Mayor Morgan called the meeting to order at 12:05 P.M. II. PLEDGE OF ALLEGIANCE Mayor Morgan led in the pledge of allegiance. III. ROLL CALL Present and Scott W. Morgan Mayor Participating: Thomas W. Stanley Vice Mayor Paul Lyons Jr. Commissioner Joan K. Orthwein Commissioner Donna S. White Commissioner Also Present & Gregory Dunham Town Manager Participating: Edward Nazzaro Staff Attorney Rita Taylor Town Clerk IV. COMMISSION ACTION A. Agreement to Bore Additional Undergrounding Conduit - wilco LLC Town Manager Dunham explained that the Commission had approved up to $25,000 at the Commission Meeting held on November 13, 2020 for Wilco to finish the AT&T undergrounding work. The proposal, which was a piggy -back on a Longboat Key undergrounding job, came in at $47,140.00, thus needing Commission approval, he added. Mayor Morgan stated it was work that needed to be done and wilco did a good job previously. Town Manager Dunham stated that AT&T would begin work the week after Thanksgiving. Commissioner Lyons was happy to hear that AT&T would be completing the project. Mayor Morgan reminded everyone that the purpose of the lawsuit against AT&T was to get the work completed. He added the Town was being held hostage by AT&T to an exorbitant surcharge on their original contract, which was excessively high compared to Comcast and what they are trying to do is force the Town into paying additional sums, the legitimacy of which are being questioned by the Town. He added that AT&T wanted the Town to attend mediation on the amounts they claim the Town owes and the Town has made it clear that the Town will not meet until the work is substantially completed. 1 Commissioner Orthwein made a motion to approve the $47,140.00 contract with Wilco to bore additional undergrounding conduit. The motion was seconded by Commissioner White with all voting AYE at roll call. V. ADJOURNMENT Mayor Morgan adjourned the meeting at 12:17 P.M. i Renee Basel ` Assistant Town Clerk 2
