PUBLIC HEARING

Mayor Latta opened the Public Hearing at 7:00 p.m. for Clark Oil,
Roll call was taken, all members were present,
Planner Waldock spoke in reference to Case No. 236-101889AZ.
Applicant ~ Clark Oil and Refining Corporation. Location - 23200
West Lincoln Highway. Request - annexation and establishment of
B-4 Highway Business District zoning. Clark Oil and Refining
Corporation has requested annexation and establishment of B-4
zoning in accordance with an annexation agreement as attached
with this report, The subject site is fully developed with an
operational motor fuel station including limited convenience
items (snacks, cigarettes, etc.). Easements were recently
granted by Clark Oil to accommodate the Village utility
extensions through the Route 30 south commercial corridor. The
key features of the annexation agreement include: 1) The B-4
zoning to accommodate the existing fuel station use; 2)
Provisions to waive or grant variances for setback requirements
to the rear lot line; 3) Provisions to waive tap-on fees for
sewer and water connections. The Plan Commission recommends
approval of the annexation agreement far Clark Oil and Refining
Corporation and establishment of B-4 Highway Business District
zoning subject to the following stipulation: 1) Fire walls of a
four (4) hour rating or other safety measures be provided along
building sides not greater than 5' from adjoining property lines.
Also, they have provided us with a site plan. They are proposing
a face-lift in the near future. After some discussion, it was
the consensus of the Board that the variance shall be no less
than ten feet (10') (instead of 5') to adjoining properties from
the Clark property. Mr. Ed Peek, representative of Clark Oil
spoke requesting a waiver from further Site Plan Review on their
proposed canopy because the plan has been reviewed extensively.
The plans show the pump islands are being moved back 25'6" away
from Route 30. He also stated he would not be opposed to moving
the entrance further east on McClellan away from Route 30

intersection. The Board agreed a blanket Site Flan Review is
unacceptable, but the Board had no problem with bringing the
plans for moving the canopy to the Plan Commission tomorrow
evening (May $, 1990).
L. Kelly moved to adjourn the Public Hearing on Clark Oil.
Seconded by D. Gullicksen. Voice vote. 6 yes, 0 no. Motion
carried.
