GAYLORD, M. LAMBERT, J. RAY, J. DEMENT, W. SHARP. D. GULLICKSEN WAS ABSENT. OTHERS PRESSENT: D. VAN VOOREN - ADMINISTRATOR V. KRNAC _ VILLAGE CLERK J. HARVEY - ATTORNEY P. WALDOCK - PLANNER D. BENNETT - POLICE CHIEF H. HAMILTON -- ENGINEER At 7:00 p.m. Mayor Latta opened the Public Hearing with the pledge to the flag. Roll call was taken, D. Gullicksen was absent. Planner Waldock spoke in reference to the Sari/Smolich Annexation Agreement. The annexation of this property was originally discussed in July 1990. This is in connection with the Sari Subdivision which established three (3) single family lots on Naperville/Plainfield Road (2211, 2237, 2281 Naperville/Plainfield Road). The property is not contiguous to the Village boundaries at this time. The annexation agreements for these properties are consistent with the Boards wish, back in July 1990, except paragraph D on page 3 of each agreement, they chose to continue using their private wells for exterior use only. It was the consensus of the Board that if they wanted to tap-on to Village water they must cap their well per the Village ordinance. Mr. Smolich objected to capping his well. He has only used his well for three (3) or four (4) months and the cost to drill the well was $3,000. He stated he will have to put in a lawn and shrubbery and that's the reason he needs the well. After some discussion, Administrator Van Vooren suggested allowing Mr. Smolich to keep his well and not tap-on to the Village water. But they could tap--on to the well for the water going into the house for sewer usage, for all three (3) lots. After some discussion, Mayor Latta stated the Board has agreed to permit the use of a private well until such time the public water supply has been tapped-on, at that time, the well will be capped. The interior use of the well water will be metered for sewer usage. This agreement will go for all three (3) properties for twenty (20) years. Mr. Smolich was told his sewer rate per month will be two and a half (2.5) times (non--resident rate) the monthly rate because his property is not in the Village.
