Board Thursday September 20 th , 1917 , at 9 b' clock A. M. All the members of said Board being .present , Messrs , .Bavis , MMMarlatt aid • McMinn. The -following, proceedings were had , to-wit The City Civil Engineer, reported the completion of con- tract under Improvement Resolution No. 542-1917 , for the construction of Sewage Disposal Plant for Glen View Add . Corner South 23rd & Main Street . The Board accepted the same and ordered assessment roll prepared, as per agree- ment the ci ty to pay 40% and property 60 0 of cost . • The City Civil Engineer, reported the following reserves retained due , as follows , to -wit : - Schneider Bros. , nesoluti(on No . 506-191.6 , amount i658 .75 Schneider Bros . , Resolution No. 523-1916 , amount 11. 76 • Daniel G. Burkhardt , so luti.on No . 500-1916 , " -- '128.52 F.. E. Slick, Resolution No. 446--1915 , ----amount----c293 .15 • F. E. Slick, Resolution No.' 509-1916 , ----amount • '45. 77 The Board direct the Finance Department to pay the above named contra ctsrs the amounts as above specified. • • In the matter of claim of Dr. S. G. • Smelser , against the City for professional services rendered Ross Manning , a former fireman , in the sum of 30.00 , which was referred to the City Attorney for investigation as to the City' s • . liability , The City Attorney , filed the following opinion to-wit : - Richmond , Indiana , September 18th , 1917 . To the Board of Public W or ks : - According to this bill, the services were rendered on April 4th of this year . No bill has heretofore been render- ed the City , which paid the fireman wages for three months , • or until he recovered, if he recovered pri or to such time . The City in operating its fire department , acts in a • • go ve rnmental capacity and. in my opinion is not liable under the present vorkmens Compensation Act . I therefore do not believe there is any legal liability upon the part of the City to pay th.i s bill. It should be pa i d by Mr . Man ni ng , who has- te(ce-ived his wages from the City durir.g the time of this injury . - • Yours t m ly , Wm. A. Bond , City Atty. , The Board on motion accepted the opinion of City attorney , and reface to allow the bill, and .air ect the Clerk to give Dr Smelser a verbatum of the above report . The Board approved the various payrolls to Sep. 15th ,1917 . Claims to the amount of 4)3256 . 78 were allowed & ordered paid.
