Gaylord, J. Dement, W. Sharp, J. Ray, M. Lambert, D. Gullicksen. ALSO PRESENT: D. P. D. J. H. C. VanVooren, Village Administrator J. Waldock, Village Planner Bennett, Police Chief Harvey, Village Attorney Countryman, W/S Superintendent Jania, Deputy Clerk Mayor Latta called the meeting to order at 7:00 p.m. Roll call was taken. A11 members were present. Case No. 315-61291AZ - Public Hearing - Helen Birkett, Owner Annexation Agreement including establishment of single-family and business zoning. Location: Southwest corner of Route 30 and 135th Street. Mr. Waldock summarized his report to the Board dated July 12, 1991 as follows: Subject site is a 120-acre parcel. The owners were approached by the Village to gain contiguity to the Fry property. Birkett annexation discussions have been taking place for some time. The annexation proposal includes a 15-acre area for B-3 commercial zoning in the northeast portion of the tract. Residence A would be the zoning far the remainder of the property. Single-family development is proposed at a density of no less than 12,000 sq. ft. per lot - 105 total acres of residential area and about 19 acres for flood plain. Applicants are asking for adequate utility capacity. Liquor licenses cannot be guaranteed or assured by an annexation agreement. Therefore, language regarding this cannot be provided for in the agreement. It is suggested this issue is better addressed in land use approval. The agreement provides for waiver of the Village portion of property taxes until the site is developed; also waiver of annexation fees. Regarding ordinances, the site is to be subject to the same development regulation generally required by the Village. Village Board of Trustees Public Hearing July 15, 1991 Page Two As to roadway improvements, applicants are asking for commercial access to both 135th and Route 30. This is .subject to IDOT approvals. Applicants are willing to provide for costs of development of the south half of 135th St. as part of their development. They are also looking for limitations on the costs for signalization of Route 30 anal 135th St. Asking this be limited to one-quarter of the Village costs. The annexation agreement is a 20-year agreement. Mr. Doug Slansky, Attorney for Helen Birkett, stated turn lanes on Route 30 were discussed but never reached an affirmative conclusion to incorporate into the agreement. This is something that still needs to be discussed. Mayor Latta referred to page 4 - 6(b) of the agreement stating water and sewer lines are addressed along Route 30, but not 135th Street. Attorney Slansky stated 135th St. was discussed but he has not had an opportunity to look at the proposed intergovernmental agreement with the School District or the proposed annexation agreement of the Fry parcel. Attorney Slansky suggested all four parties need to sit dawn with the Village to make sure all parties are in concurrence. J. Dement ask if 12,000 sq. ft. lots will be maintained. Attorney Slansky stated the basic idea is for 12,000 sq. ft. lots. There may be a request for some minor variations on some of the lots. This. needs to be discussed further. J. Dement stated downsizing our zoning ordinance is a great concern of his. Mayor Latta asked the Board for their opinion regarding liquor licenses. Attorney Slansky briefly discussed developments that would need liquor licenses. The Board expressed concern about issuance of five licenses as stated in the agreement and discussed various businesses that would request liquor licenses. The Board agreed to put language in the agreement excluding bars. Mayor Latta stated, in summary, items that still need to be addressed are recapture agreements on the road, and sewer and water. Mr. Todd Faulkner, Attorney for Plainfield School District, commented that no matter haw 135th St. is improved (urban profile or rural) it may be necessary for the existing Swale on the Birkett property to be improved in order to handle the impact on the area as a result of the improvement of 135th St. • Village Soard of Trustees Public Hearing July 15, 1991 .Page Three Mr. VanVooren, Village Administrator, added - what if anything needed to be done by the Petitioner on the Route 30 turn lanes; recapture of the public improvements off site as well as 135th St.; a need to firm up the buildable lots and size of those lots; and language as to specific uses regarding liquor licenses.
