At 7:04 Mayor Latta opened the Public Hearing.
Roll call was taken, W. Sharp was absent.
Planner Waldock spoke in reference to Case No. 352-070192-AA.
Applicant.: Golden Development Corporation.. Location: One quarter
1/4 mile north of 135th Street along the west side of Route 59.
Requ~.st: Annexation Agreement regarding a twenty-five (25) acre
site known as Golden Meadows Estates, Unit IV. the applicants
propose the annexation and development of a vacant twenty-five (25)
acre site north of Golden Meadows Subdivision. This development
is presented as the continuation of Golden Meadows Estates. The
project provides fifty-nine (59) single-family lots ranging from
9,030 square feet to 14,100 square feet. Single-family lot widths
range from seventy feet (70') to ninety feet (90'). Also included
are twenty-two (22) attached single-family lots (two (2) units per
building). These lots are in compliance with present zoning
regulations of the Village. The proposal also includes the
extension of Golden Meadow Drive, three (3) cul-de-sacs and a new
entrance form Route 59. Access to a small adjoining property
(owned by H. Peterson) is provided from the north (between lots 118
and 119). the subject site is a vacant agricultural property. the
site is COritlguOUS to Village boundaries and adjoins Golden Meadows
Estates, Unit III. No substantial vegetation is found on site.
The agreement does not address some items discussed during concept
plan review at an earlier Plan Commission meeting. Street tree
spacing at fifty foot (50') should be included. Facade approval
by the Village should be included. The plan does not provide
increases in open areas as discussed by the Plan Commission.
Recent discussion between the Plan Commission and Village Board of
Trustees has pointed out concern that not all Planned Unit
Developments, (PUD) need mixed residential uses and not all
developments need be PUD's. This case may illustrate this point.
The Plan Commission touched on the issue at the concept plan
discussion and now is the time to resolve it. There are
significant differences between this project and the applicants

Waite Farm proposal. The Golden Meadows, Unit IV site does not
justify attached units as easily as the Waite Farm site. Indeed,
the Comprehensive Plan calls for single-family development and does
not project attached dwelling land uses for this area. The Golden
Meadows Estates, Unit IV plan is basically a standard subdivision
with variations for lot area and width. As a trade off,
landscaping, parkway tree, and facade control improvements have
been offered. Park area/open space of 3.18 acres is provided.
Current regulations would require 1.5 acres is provided. Current
regulation would require 1.5 acres of parks with no specific open
area requirement. This is a similar ratio to Units I-III. The
Plan Commission voted 3-3 (with one absent) on this case. They
voted on the project as presented and did not vote on a version
without two_family units as suggested by Staff. The Plan
Commission felt this Plan clearly was not a PUD but simply a
subdivision with variances. The Agreement should be amended to
ahnw this_ Staff does not su~oort recapture in this case for
utility lines along Route 59 (through H. Petersens property). This
distance is too short three-hundred feet (300') to justify a
recapture, Staff is in the process of discussing all issues with
the applicants. The Plan Commission voted three to three 3-3 in
this case and therefore did not recommend for or against the
Annexation Agreement of the 25.7 acre site of Golden Meadows
Estates, Unit IV. Staff had recommended approval with the
following stipulations: 1) Include provisions for parkway trees
space each fifty feet (50') with allowance for a two and one half
inch 2 1/2" caliper (nurseryman standard measurement). 2) No tap-
on fee waivers shall be provided, 3) Sump pump connection to
storm sewers shall be required. 4) Ejector type sanitary sewer
systems in accordance with Village standards shall be required.
5) Lot area and width are acceptable as presented. 6) covenants
and restrictions shall be prepared and approved as part of this
annexation agreement. 7) Facade design approval process should
include the Village. 8) No recapture for sewer and water
extensions along Route 59. Mayor Latta stated in their agreement
they are requesting waivers on sump pumps over head sewers tap-on
fees and a recapture. There is no balance here, if we trade off
12,000 square foot lots. Ken Neumann, Representative of Golden
Meadows Estates stated 12,000 square foot lots are not what the
market wants today. We would like to work with the Village. Paul
Giusti, President of Golden Meadows Estates stated we would like
to work with the Village Engineer to solve the problems and be cost
effective. M. Lambert stated he had no problem with he engineers
working together for a solution, but it must be proven that it can
work. J. Dement stated, if it's a good concept, bring it to the
• Board (reference to the storm sewers and overhead ejector's). D.
Gullicksen stated he is unhappy with the smaller lots in one (1)
area of the subdivision. R. Rock stated, before they go through

any more work, are we gong to allow the nine thousand square foot
(9,000') lots? J. Dement stated the Village has a twelve hundred
square foot (1200') lot ordinance now, we should not continue to
circumvent it. Mayor latta stated the developers need some
direction before they leave this meeting, some direction. I have
no intent to waiver tap-on fees; lot size, T don't care to see any
lot under nine thousand square feet (9,000'). Mr. Neumann
displayed a subdivision in the Naperville area with corresponding
lot sizes and home values. The Board had much discussion on
P.U.D.'s (Planned Unit Development). D. Gullicksen stated he would
like to see something on the building permits for last year and
those issued for this year (housing permits), to get an idea where
the permits are being drawn on, what size lots. He stated he does
not feel this board is ready to give the developers any direction
until we can iron some of these problems out and the developers can
come back to the Board. After much more discussion, it was the
consensus of the Board that we do not have an ordinance to fall
back on and therefore their is no reason to discuss this project
further. The Board directed staff to place P.U.D. on the Workshop
for August 10, 1992, along with on-going Capital Projects.
The Board also agreed it would be futile to discuss Golden
Development/Waits Farm.
M. Lambert moved to adjourn the Public Hearing. Seconded by D.
Gullicksen. Voice vote. 5 yes, 0 no. Motion carried.
