PUBLIC HEARING

At 7:30 p.m. Mayor Latta opened the Public Hearing.
Roll call was taken, D. Gullicksen was absent.
Mayor Latta stated the purpose of this Public Hearing is the
Annexation Agreement of the James Chobar Trust property .(1720 Van
Dyke Road).
Planner Waldock stated the Chobar Trust has requested annexation
of a triangular parcel located along the east side of Van Dyke
Road north of 143rd Street. The subject site is developed with a
large storage building (for a towing business), a house and
detached garage. A towing business is the current use of the
property with a properties residence. The Annexation Agreement
recognizes existing land uses and provides for their continuance.
Industrial zoning is proposed which is consistent with the
Comprehensive Plan and surrounding uses. The Plan, Commission
recommends approval of the annexation and establishment of I-1
zoning far the Chobar Trust property on Van Dyke Road north of
143rd Street, and the subdivision of the site as proposed with
stipulation that the pool be relocated to the subject property.
The residence will be used by the proprietor of the towing
business. Mayor Latta questioned can we subdivide this lot in
the Annexation Agreement? Attorney Harvey stated when the
Village approves the final plat, this could be included in the
Annexation Agreement. The property owners must have the final
plat recorded and that will finalize the subdivision. It was the
consensus of the Board to strike section 11, page 5 should read:
The final plat as submitted this date and dated June 3, 1989 as
Exhibit B.
Mayor Latta stated tonight's regular meeting will be continued to
June 12, 1989 at 7:00 p.m. for the purpose of the approval of the
ordinance approving annexation, ordinance approving zoning,
ordinance approving the annexation agreement and the approval of
the final plat.

Lewin. Voice vote. 5 yes, 0 no. Motion carried.
