PUBLIC HEARING

Mayor Latta opened the Public Hearing at 7:30 p.m. Roll call
was taken, D. Gullicksen was absent.
Mayor Latta stated the purpose of this Public Hearing is for the
proposed Annexation Agreement of the June S. Foster Farm.
Planner Waldock stated this property is located along both sides
of Indian Boundary Road (south of Renwick Road). The site
consists of about 270 acres. They requested septic and well under
County regulations, then they would transfer to Village water
and sewer when available. The agreement states there would be
improvements to Indian Boundary Road. The development would be
regulated under County Building Cordes and present Village Building
Codes after Annexation. If Village Building Codes became more
restrictive, it would not apply to this property. There has been
concerns of surrounding property owners of flooding conditions
on this site. The Plan Commission has considered the annexation
request and by a vote of 3-2, they recommend to deny this request.
Attorney James Babcock, representative for the petitioners, stated
the petitioners are willing to pay any fees at the time, such
as tap-ons or permit fees, as long as it applies to everyone at
the time. You (Board) had another concern under development
standards. We suggest, under paragraph 11 of the annexation
agreement, add "not withstanding the above provisions that the
owner shall and will comply with the then current building code
requirements for all buildings". There was concern of the Board
of who's responsibility of the cost of oversizing of the sewer
line which would come down Indian Boundary Road sometime in the
future. J. Dement stated, in the agreement you referred to
"excluding labor" costs when laying the sewer pipe down Indian
Boundary Road. The words excluding labor" should be removed.
There was much more discussion on the cast and extending the sewer
and water lines out Indian Boundary Road. Also, who would extend

the lines. L. Ke11y questioned the cost of extending water and
sewer dawn Indian Boundary Road. Engineer Ruettiger stated in
excess of $750,000, with 10" lanes and lift station. K. Callahan
stated she is not ready to approve County subdivisions with well
and septic systems within 1~ miles of our Village. L. Kelly
stated he as not in favor of a subdivision within this area going
well. and septic. If it's allowed, we will reach a point of them
never going with Village water and sewer. D. Lewin stated he
concurrs, well and septic subdivisions are not welcome. Attorney
Babcock stated since the Village is unable to spend any money
up front to run these lines, there as no paint in negotiating
further.
J. Dement moved to adjourn the Public Hearing on the June S.
Foster Farm. Seconded by J. Bootz. Vote by roll call. Lewin,
yes; Kelly, yes; Callahan, yes; Dement, yes; Bootz, yes. 5 yes,
0 no. Motion carried.
