At 7:00 p.m. Mayor Latta opened the Public Hearing.
Roll call was taken, D. Gullicksen was absent.
Planner Waldock spoke stating we have several annexation
agreements which are part of court regulated annexation petitions
which were approved by the courts in early 1989;
Marilyn Gehrke Annexation Agreement Public Hearing is
scheduled for January 18, 1990.
Mary Stephens Annexation Agreement, approximately
thirty-five (35) acres. This agreement includes a ten
(10) year period and it is a standard agreement
compared with other agreements approved by the Village.
This agreement has a de-annexation of all except the
west 300 feet of the parcel (#2); approval of continued
use of the land.
Friendship Partnership Agreement (Chicago Title & Trust
#1079888), approximately 120 acre site. This agreement
is similar to others approved by the Village. Far a
twenty (20) year period; includes the Village to
recapture the extension of the sewer/water main along
Route 59 (extension within two (2) years). Property
will be annexed as Residence A zoning.

Gary Lichtenwalter (First Midwest Bank & Trust #189)
Agreement, approximately 188 acres. Includes a Village
recapture on the water/sewer extension (this extension
will be within twa (2) years). There are specific
zonings requested within this property, B-3 Business
zoning (approximately eighteen (18) acres - Frazier
Road); B-4 Highway Business. zoning (approximately
eighteen (18) acres - corner of Route 59 and Frazier
Road); balance Residence A Single-Family.

Bernard and Rosemary Hayes Agreement - approximately
ten (10) acres; ten (10) year agreement; similar to
other agreements.
Planner Waldock stated there is one (1) change on the
Lichtenwalter Agreement, page 7, article 9 (at end of paragraph,
add - ;(semicolon) said rebate shall. remain in force for
undeveloped portions.
Attorney Niznik spoke on behalf of James Bush and Jane Van Horn.
He stated they have concerns of no buffer zone between the
existing homes and the proposed development. Also in the
audience concerned of the buffer zone were other people of the
area, Mr. Rial, Mrs. Lindall and Mrs. Wise. Planner Waldock
explained that in September, 1989, the Board adopted the "Site
Plan Review Ordinance" which requires a detailed review of all
construction applications, which will include specific. site
details of any development, large or small. Storm water drainage
will be investigated; buffering and screening will be reviewed;
lighting will be checked. This ordinance is intended to protect
the adjacent properties.
L. Kelly moved to adjourn this Public Hearing. Seconded by J.
Dement. Voice vote. 5 yes, 0 no. Motion carried.
