Mayor Latta reported this Public Hearing is for the purpose of
the Grover Criss Annexation Agreement.
Planner Waldock stated the subject site, in this case, was
previously reviewed for a county special use permit to allow
flood plain development. Related to the request was a four lot
residential subdivision which included modification of Van Horn
Estates Subdivision's storm detention basin. The 3.87 acre site
currently is occupied by the storm control basin and a single-
family home. The Annexation Agreement now proposed for this site
include s provision for subdivision as previously reviewed with
the County Special Use permit. The subdivision would not be
served with village utilities as none are presently accessible to
the site.. The Agreement would allow division without
improvements including storm sewer, curb, gutter, street pavement
widening, sidewalks, street lights, sewer or water. School and
park donations are to be provided. The owners had previously
agreed to also pay a road donation of $500 per new lot as part of
their County Special Use request. The owners have agreed to add
this provision to the agreement. Funds could be placed in escrow
for future road improvements (pavement, curb, gutter or sidewalk)
along the frontage of the subject site. Zoning proposed for the
site is Residence A which conforms to Village Comprehensive Plan
projections. The term of the agreement if five (5) years. The
subject site, in this case, is part of the Court approved
annexation area along Route 59 south of the present Village
limits. Contiguity with the Village boundary will be
accomplished by annexation of the Court approved area. Since the
site is not accessible to Village sewer and water services, a
County type subdivision would not be unreasonable at this
location. Surrounding development uses septic and well services

and is of a compatible lot area to that as proposed. Staff is
recommending that this Public Hearing be continued to August 21st
to allow for proper notification of adjacent land owners. There
will be a revised Annexation Agreement far the continued Public
Hearing showing the changes by adding the following: 1) the
owners are to provide a $500 road donation for each new lot
platted on site; and 2) to provide far development according to
grading plans as approved by the Village Engineer.

August 21, 1989. Seconded by D. Gullicksen. Voice vote. 5 yes,
0 no. Motion carried.
