WHEREAS, the Opa-Locka Community Development Corporation, Inc. d/ b/ a Ten North Group ("OLCDC") intends to conduct a seven-day event to highlight the City of Opa- Locka's transformation in the Downtown Opa-Locka area. The event will be held from December 3rd through the 9th, 2023 to coincide with Art Basel Miami Beach 2023; and WHEREAS, OLDC is seeking the issuance of Special Event permits to hold the event and to allow sale of alcoholic beverages. The sale of alcoholic beverages at Special Events must be approved by the City Commission. This request is being made in accordance with Ordinance 17-19 and Resolution 21-9859 referencing temporary events occurring over multiple days; and WHEREAS, the City Commission has reviewed the permit applications, along with the criteria for an exception from the prohibition of consumption of alcoholic beverages, as provided herein, pursuant to the City's Code of Ordinances; and WHEREAS, the City Commission finds that it is in the best interests of the City to approve the sale of alcoholic beverages and two Special Event Permits, attached hereto as Composite Exhibit "A", for "The Art of Transformation" hosted by the Opa-Locka Community Development Corporation, Inc. d/b/a Ten North Group (OLCDC) and the City of Opa-Locka. NOW THEREFORE BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF OPA LOCKA, FLORIDA: Section 1. The recitals to the preamble herein are incorporated by reference. Section 2. The City Commission of the City of Opa-Locka hereby approves the sale of alcoholic beverages and two Special Event Permits, attached hereto as Composite Exhibit "A", for "The Art of Transformation" hosted by the Opa-Locka Community Development Corporation, Inc. d/b/a Ten North Group (OLCDC) and the City of Opa- Locka. Section 3. Sections of this Resolution may be renumbered or re -lettered and corrections of typographical errors, which do not affect the intent of this Resolution may be Resolution No. 23-179 authorized by the City Manager, following review by the City Attorney, without need of public hearing, by filing a corrected copy of same with the City Clerk. Staff Summary: The Opa-locka Community Development Corporation, Inc. intends to conduct a seven-day event to highlight the City's transformation in the Downtown Opa-locka area. The event will be held from December 3rd through the 9th , 2023 to coincide with Art Basel Miami Beach 2023. This request is being made in accordance with Ordinance 17-19 and Resolution 21-9859 referencing temporary events occurring over multiple days. OLDC is seeking the issuance of Special Event permits to hold the event and to allow sale of alcoholic beverages. Sale of alcoholic beverages at Special Events must be approved by the City Commission. This family -friendly event will be free of charge for attendees. Financial Impact: There will be no City expense associated with this event since the Opa-locka Community Development Corporation will cover all expenses. Security will be provided by off -duty City Police paid for by OLCDC. Special Event fees will be waived since the City is also hosting the event. Staff recommends the City Commission approve of the sale of alcoholic beverages and the Special Event Permits for the seven-day event, "The Art of Transformation" hosted by the Opa-locka Community Development Corporation, Inc. and the City of Opa-locka. Due to the holiday season, the next anticipated Regular Commission Meeting will be held on December 13th, 2023. After reviewing the Special Events Permit, it was determined the host is requesting to sell alcoholic beverages. This request will require the approval of the City Commission at the Regular Commission Meeting scheduled on November 81,2023. Per Opa-Iocka City Code Sec. 4-15. Public consumption of alcoholic beverages prohibited; exceptions. (a) It shall be unlawful for any person to consume or to carry in any cup, glass, can, bottle, or other open or uncovered container any alcoholic beverage in any park or recreational area open to the public or on any public street, sidewalk, trail, alley, or contiguous city property within the city. This section shall not apply to any premises duly licensed pursuant to state law on which is permitted on -premises consumption of alcoholic beverages, or on any privately owned property not within the public right-of-way. (b) Exceptions. (1) Any person, organization or corporation who or which wishes to be excluded from the prohibition of the above subsection (a) for a period of time not to exceed fourteen (14) days may apply to the city commission for an exception. The criteria to be used by the city commission shall include: a. The purpose for which the exception is requested. b. The dates, times and locations of such purpose. c. Provisions for security and crowd control. d. Proximity to residential areas. (2) The exception may be granted if the above criteria tend to lessen the impact of such public consumption on any neighboring residential property, and tend not to disturb the health, safety, welfare, peace and comfort of the citizens of the town. The less likely the exception to create a nuisance based upon the above criteria, the more likely the exception is to be granted. (3) This section shall not apply to events to be held on city property with the city administration's knowledge and consent that alcoholic beverages will be consumed on the premises. END OF MEMORANDUM PART 11 - CODE OF ORDINANCES Chapter 4 ALCOHOLIC BEVERAGES Chapter 4 ALCOHOLIC BEVERAGES' ARTICLE 1. IN GENERAL Sec. 4-1. Definitions. Words and terms used in this chapter shall have the meanings ascribed to them by Florida Statutes. Sections 561.01, 563.01, 564.01 and 565.01. (Code 1955, § 3-1) Sec. 4-2. Duty to permit police inspections. it is unlawful for any person to refuse or prevent, or attempt to prevent reasonable inspection of any portion of premises at which alcoholic beverages are dispensed by the police officers of the city during any hour in which the premises are open for business. (Code 1955, § 3-13) Sec. 4-3. Hours of sale generally. Except as otherwise provided herein, a distributor or vendor of alcoholic or intoxicating beverages shall only sell, serve, offer to sell, allow to be consumed, or deliver any alcoholic or intoxicating beverages to any person over the age of twenty-one (21): (1) Vendors operating stores primarily for the sale of products other than alcoholic beverages (excepting such stores as are nonconforming under the zoning regulations) may make sales of beer and wine in sealed containers for consumption off the premises during such hours as their stores legally remain open for the sale of other goods. Created: 2021-05-11 10:41:07 [EST] patrons are being served food seated at tables within the restaurant or hotel dining room enclosures; and provided further that such sale of alcoholic or intoxicating beverages is strictly incidental to the main business of operating a hotel or restaurant. Such sales must be made within the hotel or restaurant premises, in a room or enclosure where there is no visible bar or other counter set up for the purpose of dispensing alcoholic or intoxicating beverages over the bar or counter to the public, and where no such bar or counter is visible to any person seated within the room or enclosure, and such beverages must be prepared for service within a kitchen or at a fixed service bar, and not otherwise. There shall be no illuminated signs of any kind exhibited or displayed to the outside at hours when other licensees are prohibited from selling beverages, denoting that alcoholic or intoxicating beverages are obtainable in such hotel or restaurant. Provided, however, that nothing in this chapter shall prevent the sales of alcoholic or intoxicating beverages to guests in hotels, as defined herein, within their respective rooms at any hour for consumption on the premises, and provided further, that such hotels and restaurants do not advertise in any way that alcoholic or intoxicating beverages are obtainable in such hotels and restaurants on Sunday. (Code 1955, § 3-35) Note(s)—See note following § 4-3Note(s)—. Sec. 4-5. Hours for nightclubs. Nightclubs shall be governed by the restrictions hereinabove set forth, except that no nightclub or owner, operator or employee thereof shall admit customers to its premises, nor sell, serve, offer to sell, allow to be consumed or delivered any alcoholic or intoxicating beverages to any person or persons between the hours of 5:00 a.m. and 11:00 a.m. on weekdays and between the hours of 5:00 a.m. and 5:00 p.m. on Sundays. Nightclubs may remain open one-half hour after the sale and consumption of alcoholic or intoxicating beverages is prohibited herein. (Code 1955, § 3-36) Note(s)—See note following § 4-3Note(s)—. Sec. 4-6. Hours for private clubs. Clubs licensed under the provisions of subsection (4) of Section 565.02, Florida Statutes, or licensed or defined under any other provisions of the State Beverage Law, shall be governed by the restrictions hereinabove set forth, except that no club, officer or employee thereof shall admit customers to its premises, nor sell, serve, offer to sell, allow to be consumed, or deliver any alcoholic or intoxicating beverages to any person or persons between the hours of 2:00 a.m. and 7:00 a.m. on weekdays, and between the hours of 2:30 a.m. and 1:00 p.m. on Sundays. The sale of alcoholic or intoxicating beverages by clubs, by either package or sealed container, is prohibited during the hours that the sale is prohibited to other licensees. The hours of closing set forth in this section shall not apply to New Year's Eve. (Code 1955, § 3-37) Note(s)—See note following § 4-3Note(s)—. Sec. 4-7. Hours for package sales by nightclubs, restaurants, hotels. The sale of alcoholic or intoxicating beverages by nightclubs, restaurants and hotels, by either the package or sealed container, is prohibited during the hours in which the sale is prohibited to other vendors. Hereafter no intoxicating beverages to be consumed either upon the premises or off the premises shall be sold from a place of business located within one thousand (1,000) feet of a church, park or public school. Beer and wine to be consumed off the premises may be sold from a place of business located five hundred (500) feet or more from a church, park or public school. The method of measurement that shall be applied to determine whether or not a place of business is within or without the required distance from a church or public school, shall be by measurement from the main front entrance of said church or school to the main front entrance of said place of business, along the route of ordinary pedestrian traffic. (b) Hotels, restaurants. Hotels containing not less than fifty (50) guest rooms shall be exempt from the provisions of this section forbidding the sale of liquor to be consumed on the premises within one thousand (1,000) feet of a church or school, as aforesaid. Dining rooms and restaurants, meeting the requirements set forth in section 3-35 where the sale and service of liquor is strictly incidental to the serving of food, which dining rooms and restaurants do not exhibit any sign or display on the outside denoting that liquor is sold or obtainable therein, are likewise exempted from the provisions of this section forbidding the sale of liquor to be consumed upon the premises at a place of business within one thousand (1,000) feet of a church, parks or public school, it being intended hereby that such hotel and restaurant and dining room shall not be prohibited from the sale of liquor for consumption upon the premises by reason of their location within one thousand (1,000) feet of a church, parks or public school. (c) Locations otherwise prohibited. Nothing in this section shall be interpreted to permit the sale of alcoholic beverages in or adjacent to districts where such sale is now prohibited by other ordinances of the city. Grandfather clause. The limitation provisions of this section shall not apply to establishments lawfully in operation and dispensing alcoholic beverages during the year beginning October 1, 1960, provided that such establishment remains in continuous operation. (e) Incidental sale of beer and wine for off -premises consumption. Businesses, such as grocery stores, and other commercial establishments, whose principal business is not the sale of alcoholic beverages, but includes as incidental thereto, the sale of beer and wine to be consumed off the premises, shall be exempt from the provisions of this section. It is intended hereby that such a business shall not be prohibited from the sale of beer and wine for consumption off the premises by reason of its location or proximity to a church, parks or public school. (f) Restaurants selling beer and wine. Restaurants, as defined in section 13-47 of this Code, whose principal business is not the safe of alcoholic beverages, but includes as incidental thereto the sale of beer and wine to be consumed on the premises only, shall be exempted from the provisions of this section. No package store shall be located within one thousand five hundred (1,500) feet of any other package store located within the city limits. The method of measurement that shall be applied to determine whether a package store is within or without the required distance from any other package store shall be by measurement made or taken from the main front entrance of one package store to the main front entrance of the other along the route (Sup). No vendor shall allow or permit, between the hours of 11:00 p.m. and 7:00 a.m. of the following morning, instrumental music, singing or other forms of entertainment, in any room where alcoholic beverages are sold or offered for sale, indoors or outdoors, unless such room is soundproofed, in order that the noise therefrom may not disrupt the peace and quiet of the neighborhood, it being intended hereby that in soundproofed rooms music, singing and other forms of entertainment may be conducted during the hours that alcoholic beverages may be sold, but at no other hours. (Code 1955, § 3-7) Cross reference(s)—Noise generally, § 15-73Cross reference(s)— et seq. Sec. 4-11. Vaudeville, theatricals prohibited after 10:00 p.m.; exceptions. It shall be unlawful for any person to have, permit or allow, after 10:00 p.m. on any night, any vaudeville, theatrical or similar entertainment upon any premises in the city where alcoholic or intoxicating beverages are sold, served or consumed. No alcoholic beverages shall be sold or served to persons for consumption in automobiles and all curb service of alcoholic beverages for consumption in automobiles is hereby prohibited. (Code 1955, § 3-43) Sec. 4-13. Sale of liquor and wine from trucks. All sales of liquor and wine at wholesale shall be made by orders taken at the place of business of the distributor, or of a vendor, or received at such place of business, and no sales of liquor and wine shall be made from any truck or conveyance operating within the city, it being intended hereby to prohibit the sale of liquor and wine from trucks and other conveyances. (Code 1955, § 3-41) Sec. 4-14. Setups prohibited on premises not licensed for liquor. No vendor who is not licensed by the state to sell liquor to be consumed upon the premises shall knowingly furnish or provide any setups, glasses or other service to any person for the purpose of consuming liquor in, at or upon the licensed premises. TOTAL OR PARTIAL NUDITY AND SEXUAL CONDUCT IN ALCOHOLIC BEVERAGE ESTABLISHMENTS Sec. 4-16. Definitions. The following words and phrases, when used in this article, shall have the meanings respectively ascribed to them as follows: (1) Alcoholic beverage, beer and wine shall have the meanings set forth in Florida Statutes Sections 561.01(4), 563.01, and 564.01 respectively. (2) Alcoholic beverage establishment means any establishment located in the City of Opa-locka, Florida at which alcoholic beverages, beer or wine are offered for sale for consumption on the premises. (Supp. No. 65) Para K r,fA Created: 2021-05-11 10:41:07 (EST] (3) Nudity, partial, means the exhibition by any female person to any other person of any portion of her breasts falling below the areola, or any simulation thereof (which definition shall include the entire lower portion of the human female breast, but shall not include any portion of the cleavage of the human female breast exhibited by a dress, blouse, shirt, leotard, bathing suit, or other wearing apparel, provided the areola is not so exposed). (4) Nudity, total, means the showing of all or any portion of the cleft of the human male or female buttocks with less than a full opaque covering; the showing of all or any portion of the female areola; the depiction of covered male genitals in a discernible turgid state; the exhibition by any person to any other person, of his or her genitals, public area, vulva, anus, anal cleft or cleavage, or any portion of the foregoing specified anatomical areas, or any simulation thereof. Person means an individual, corporation, firm, partnership, limited partnership, association, joint stock association, estate, trust or business entity. (6) Sexual conduct means any sexual intercourse, masturbation, sodomy, bestiality, oral copulation, flagellation, any sexual act which is prohibited by law, touching, caressing or fondling of the breasts, buttocks or any portion thereof, anus or genitals or the simulation thereof. (Ord. No. 90-6, § 2, 3-28-90) (5) Sec. 4-17. Total or partial nudity and sexual conduct prohibited. (a) It shall be unlawful for any person maintaining, owning, managing or operating an alcoholic beverage establishment to knowingly, or with reason to know, suffer or permit total or partial nudity or sexual conduct to occur on the premises of that alcoholic beverage establishment. (b) It shall be unlawful for any person, while on the premises of an alcoholic beverage establishment, to expose to public view those portions of his or her anatomy, defined herein as total or partial nudity, or engage in any sexual conduct. (c) It shall be unlawful for any person maintaining, owning, managing or operating an alcoholic beverage establishment to knowingly, or with reason to know, suffer or permit the exposition of any graphic representation to public view, including photographs, videotapes or film projection, which depicts total or partial nudity or sexual conduct. Section 4-17 of this article shall be enforced as provided in section 18-5 of the city Code and violations of section 4-17 shall be punished as provided in city Code section 1-7. (Ord. Please submit your completed application to your local district office at least seven (7) days prior to the first date of the event to insure the permit is issued by the event date. This application may be submitted by mail, through appointment, or it can be dropped off. A District Office Address and Contact Information Sheet can be found on AB&T's page of the DBPR web site at the link provided below. Local ABT Licensing Offices This application is used for obtaining a One, Two, Three Day Permit to sell alcoholic beverages for consumption on the reported premises only. A special sales license may also be obtained by the use of this application for the sale of alcoholic beverages for a period of up to three days. This license does not permit the sale of alcoholic beverages for consumption on the premises and only allows package sales in the manufacturer's original sealed containers. GENERAL INSTRUCTIONS Submitting Your Application The Division of Alcoholic Beverages and Tobacco, Bureau of Licensing, accepts applications for one, two, and three day events and special sales licenses. Please complete all required information. All questions must be answered fully and truthfully. You must provide an original application and supporting documentation that may be required by the local authorities. All signatures must be original. Contact Person All communications regarding your app►ication will be sent to the applicant at the mailing or email address provided. However, if you would like for us to communicate with someone other than the applicant regarding your application, please provide the name and contact information for that person in the "Permit or License Information" section. Your named contact person will be permitted to make changes to the application paperwork on your behalf and we will communicate directly with them regarding any application issues or deficiencies. You will not be copied by the division with the correspondence. Sketch of Premises A complete sketch of the premises, drawn in ink or computer generated (letter size) which includes all permanent walls, doors, windows, counters, labeling each room and area. When the event of the non profit organization is being held at a location that is already licensed for the sale of alcoholic beverages, a sketch of the entire premises must be submitted. If the event does not include the entire premises, the sketch must identify the area of the licensed premises where the event is to be held and must be a separate room or enclosure. The attestation included with this application must have the original signature of the permanent license holder and must be submitted by the non-profit group as part of the completed application.
