RESOLUTION NO. 23-178
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
OPA-LOCKA, FLORIDA, AUTHORIZING THE INTERIM CITY
MANAGER TO EXECUTE THE MUNICIPAL PARKING FINES
REIMBURSEMENT PROGRAM AFFIDAVIT TO ALLOW THE
CITY TO BE REIMBURSED FOR IMPROVED ACCESSIBILITY FOR
PERSONS WITH DISABILITIES AND CONDUCT DISABILITY
AWARENESS PROGRAMS; PROVIDING FOR INCORPORATION
OF RECITALS; PROVIDING FOR AN EFFECTIVE DATE
WHEREAS, Miami -Dade County is currently offering reimbursements
for the Municipal Parking Fines Program. The program is funded through
monies recouped from drivers illegally parked in handicapped spaces; and
WHEREAS, the reimbursed funds shall be used to improve
accessibility and equal opportunity to qualified persons in the municipality
who have disabilities and to conduct disability public awareness programs;
and
WHEREAS, the Interim City Manager has determined that the
Municipal Parking Fines Program will assist the City of Opa-Locka ("City") in
fulfilling previously passed Resolution 23-071, which directed the Interim
Manager to conduct a thorough evaluation of all City -owned facilities for
Americans with Disabilities Act (ADA) deficiencies and remediate; and
WHEREAS, in order to participate in the program, each municipality
must submit an executed Interlocal Agreement and the annual Affidavit to the
Miami Dade County ADA Office but because the City has already entered into
an interlocal Agreement recognized by Miami -Dade County, the City only
needs to submit the Affidavit in the form attached as Exhibit "A"; and
WHEREAS, the City must return funds to the County if the project is
not successfully completed and allow the Miami -Dade County Internal
Services Department to audit projects and conduct site visits; and
WHEREAS, the City Commission of the City of Opa-Locka finds that it is in
the best interest of the City and its residents to authorize the Interim City Manager
to execute the Municipal Parking Fines Reimbursement Program Affidavit,
attached hereto as Exhibit "A", to allow the City to be reimbursed for improved
accessibility for persons with disabilities and conduct disability awareness
programs and take actions required by the Affidavit.

NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF OPA LOCKA, FLORIDA:
SECTION 1. RECITALS ADOPTED.
The recitals to the preamble herein are incorporated by reference.
SECTION 2. AUTHORIZATION
The City Commission of the City of Opa-Locka hereby authorizes the Interim City
Manager to execute the Municipal Parking Fines Reimbursement Program
Affidavit, attached hereto as Exhibit "A", to allow the City to be reimbursed for
improved accessibility for persons with disabilities and conduct disability
awareness programs.
SECTION 3. SCRIVENER'S ERRORS.
Sections of this Resolution may be renumbered or re -lettered and corrections of
typographical errors which do not affect the intent may be authorized by the City
Manager, following review by the City Attorney and without need of public
hearing, by filing a corrected copy of same with the City.
SECTION 4. EFFECTIVE DATE.
This Resolution shall take effect immediately upon adoption and is subject to the
approval of the Governor or his designee.

Staff Summary:
The City of Opa-locka entered into an Interlocal Agreement with Miami -Dade County which allows the City to
remain eligible for Community Development Block Grant (CDBG) funding. Miami -Dade County is currently
offering reimbursements for the Municipal Parking Fines Program. The program is funded through monies
recouped from drivers illegally parked in handicapped spaces. The reimbursed funds shall be used to improve
accessibility and equal opportunity to qualified persons who have disabilities in the municipality and
to conduct disability public awareness programs. The Municipal Parking Fines Program will assist

Miami -Dade County is commencing the next cycle of reimbursements for the Municipal Parking Fines
Program. In order to participate in the program, each municipality must submit an executed Interlocal
Agreement and the annual Affidavit. Because your municipality previously submitted an Interlocal
Agreement, you will only need to submit the Affidavit (see email attachment.)
The Affidavit states that the funds reimbursed shall be used to improve accessibility and equal
opportunity to qualified persons who have disabilities in the municipality and to conduct disability public
awareness programs. The Affidavit -- which must be sworn to by your municipality's highest
administrative official -- must be submitted within 60 days of the date of this letter to receive these
funds.
In accordance with Section 30-447 of the Code of Miami -Dade County, parking fine funds generated from
the misuse of marked spaces for people with disabilities are used in the following manner:
• One-third of the funds are to be used to defray the Clerk of Courts' administrative expenses
• Two-thirds of the funds are distributed to the County and municipalities
Funds are to be used to improve accessibility and equal opportunity to qualified physically disabled
persons and to provide funds to conduct public awareness programs concerning physically disabled
persons.

known to me to be a credible person and of lawful age, who being by me first duly
sworn, on [his or her] oath, deposes and says:
The municipal parking fines funds reimbursed shall be used to improve
accessibility and equal opportunity to qualified persons who have disabilities in
the municipality and to conduct public awareness programs in the municipality
concerning persons who have disabilities.
If only a portion of the project or program is being promoted to benefit people
with disabilities, then only that portion of the project or program will be funded
with these monies.
The municipality shall return funds to the County if the project is not successfully
completed and allow the Miami -Dade County Internal Services Department to
audit projects and conduct site visits. Any such audits or inspections shall be
conducted in such manner and at such times so as not to unreasonably interfere
with the day-to-day operation of the parties.
