HEIMERDINGER, R. ROCK, M. LAMBERT, J. DEMENT, R. SMOLICH, K. STALZER. OTHERS PRESENT: D. VAN VOOREN - ADMINISTRATOR S. JANIK - CLERK D. BENNETT - POLICE CHIEF J. HARVEY - ATTORNEY H. HAMILTON - ENGINEER P. WALDOCK - DEVELOPMENT/ZONING J. DUBBIN -- PLANNER At 7:00 p.m. President Peterson called the meeting to order. RoJ~1 call was taken, R. Smolich was absent, all other Trustees were present, he then led the pledge to the flag. 7:05 p.m. Trustee Smolich arrived for the meeting. President Feterson proclaimed the month of October as Breast Cancer Awareness Month. Clerk Janik spoke briefly and told the Board programs that have been planned for the month to help increase public understanding of this disease. She also requested a matched donation from the Village for the cost of the planned luncheon on October 24, 1995. This item was added to the Agenda for discussion. President Peterson made a short statement regarding the issue of controlled growth, and community character. He also requested if a discussion on this matter could be put on the Workshop Agenda for next Monday, October 9th. PUBLIC COMMENTS: Barb Pitney, Administrator of the Library District, spoke regarding the proposed utility tax, and requested that the President and Board of Trustees would consider exempting all local units of governments from the utility tax. Mr. John Madia, resident at 24918 Blakely, in the Walkers Grove Subdivision, spoke on behalf of his friends and neighbors, addressing the situation of the exorbitant sewer and water bills in their area. He asked that the Board appoint a special committee to review the methods of residential water rates, and a different billing situation for severe weather conditions, such as a waiver of late payment fines. Also present was Donna and Eric Scherner, 13300 Flagg Drive in Walkers Grove Subdivision. This matter was referred to the Public Works Committee for review. Mr. Sam Slocum, resident of Indian Oaks Subdivison, requested some information regarding the proposed utility tax and would like to PLAINFIELD VILLAGE BOARD OF TRUSTEES OCTOBER 5, 1995 FAGE TWO see a list of what the Village thinks is needed to necessitate the 3~ utility tax. Trustee Heimerdinger addressed the Board and Public making a statement regarding a sign that was placed by his house regarding the proposed utility tax. (attached and made a part hereof) Trustee Dement also addressed the Board and Public in rebuttal of Trustee Heimerdinger's statement. He also thanked the residents of Plainfield for allowing him to attend the Illinois Municipal League Conference last weekend. President Peterson told the Board that Item #8 Discussion an Sweetwood Development was cancelled and added in it's place was a discussion on the Donation for the Breast Cancer Awareness Fund. He also requested an Executive Session for real estate acquisition not to reconvene. M. Lambert moved to approve the Agenda as amended. Seconded by R. Smolich. Voice vote. 6 yes, 0 no. Motion carried. 7:29 p.m. Trustee Heimerdinger left the meeting. 7:30 p.m. M. Lambert moved to adjourn the regular meeting and to go into the Public Hearing. Seconded by J. Dement. Lambert moved to adopt RESOLUTION NO. 1121 EXPRESSING SUPPORT FOR THE CONSOLIDATED SCHOOL DISTRICT 202 SCHODL SITE LOCATION PLAN. Seconded by R. Smolich. Vote by roll call. Dement, yes; Lambert, yes; Rock, yes; Smolich, yes; Stalzer, no. 4 yes, 1 no, 1 absent. Motion carried. ~4 DISCUSSION - LIOUID SLUDGE REMOVAL CONTRACT A. Persons told the Board that during the past month Hamilton Engineering has received bids for the removal of liquid sludge from the Village's Wastewater Treatment Plant. This removal contract is designed to provide periodic removal of sludge from the plant during the next ~.5 months. On September 20, 1995 Hamilton Engineering opened the bids for the proposed sludge removal work. The Village Staff recommends that the Village Board award the 15 PLAINFIELD VILLAGE BOARD OF TRUSTEES OCTOBER 2, 1995 PAGE 3 month Sludge Removal Contract #59354 to Terry Jacobs at a bid price of $0.0265 per gallon. J. Dement moved to approve the award for the 15 month Sludge Removal Contract to Terry Jacobs at a bid price of $0.0265 per gallon. Seconded by M. Lambert. Vote by roll call. Motion carried. ~5 DISCUSSION - ZONING TEXT AMENDMENTS Director Waldock talked about the Text Amendments being the results of Staff's findings during the new Zoning Ordinance start up period (initial six months of use). Several adjustments have been suggested by residents, applicants, and the Development Committee. Test Amendments to the Zoning Ordinance for the following: 1) Bed and Breakfast facilities as Special Use in residential districts; 2) Yard requirements for accessory structures in the R 1 Overlay District; 3) Front yard requirements in the R 1 Overlay District; 4) Rear yard requirements in the R 1 Overlay District; 5) Setback requirements in residential districts related to uncovered patio's and decks; 6) Parking regulation amendments; 7) Special Use permit requirements for Farmstands and Open Air Businesses; 8) Establishment of Adult Entertainment regulations as a Special Use in the B-4 District. . Chief Bennett spoke to the Board regarding temporary Solicitors Licenses. Trustee Rack suggested an article in the neighborhood newspaper regarding permitted licensed solicitors. M. Lambert moved to direct the attorney to prepare the zoning ordinance amendments. Seconded by R. Smolich. Vote by roll ca1.1. Motion carried. ~6 DISCUSSION - KOZUH SPECIAL USE PERMIT FOR HOME OCCUPATION Planner Durbin stated that Ms. Kozuh operates 59 Hair Design as a Home Occupation per the provisions of the Zoning Ordinance. The 59 Hair Design facility appears to meet the standards and provisions of the home occupation regulations and currently operates as a permitted use classified as a beauty shop. Under the provisions of the Ordinance, Barber/Beauty Shops operating as home occupations are permitted uses if limited to one operator of whom shall be a resident of the dwelling unit in which the home occupation is located. The special use request is in accordance with Ms. Kozuh's desire to add one additional operator to the salon. The Flan Commission recommends approval of the special use request for an additional operator subject to the following stipulations: 1) Compliance with the provisions of the Plainfield Fire Protection District; 2) Compliance with the home occupation provisions of the • Zoning Ordinance; 3) The applicant provide a sidewalk from the rear C~ • PLAINFIELD VILLAGE BOARD OF TRUSTEES OCTOBER 2, 1995 PAGE FOUR entry to the municipal parking lot; 4) The applicant pursue dedication of a portion of the subject property towards supplementing the municipal parking lot; 5) Site lighting, if provided, shall meet the requirements of the Site Plan Review Ordinance such that is shall be shaded, directed or otherwise designed so as to avoid glare onto adjacent properties. R. Rock moved to approve the Special Use Permit for Sandra Kozuh at 712 N. Division to add one additional operator to her salon. Seconded by M. Lambert. Vote by roll call. Motion carried. ~7 DISCUSSION - MAIN STREET PROGRAM Planner Durbin discussed with the Board that Plainfield is now eligible far participation in the Illinois Main Street Suburban Program. Communities apply for acceptance into this program on an annual basis. In return for commitment to the revitalization of the community's downtown, the state provides free technical assistance. Staff would recommend this as an excellent opportunity to work towards the enhancement of the existing downtown and would also greatly benefit the westward expansion of the downtown across the river. #~8 DISCUSSION - DONATION TO BREAST CANCER RESEARCH FOUNDATION M. Lambert moved to approve matched funds for the cost of the Luncheon to be held on October 24, 1995, not to exceed $600.00. Seconded by J. Dement. Vote by roll call. ADMINISTRATOR'S REPORT Administrator Van Vooren state that the Village received notice from Senior Services Center that it will be closing the Nutrition site in Plainfield. The Board discussed their concerns that the public does not have a clear understanding of how the community would benefit from revenue generated by a proposed utility tax. President Peterson expressed a desire to obtain figures on what the financial impact would be an the Village taxing bodies, as well as an the industrial users north of downtown on Routes 59 and 30. As a result of these concerns, Board members invited residents to call them to discuss the proposed tax. President Peterson stated that there will be a forum for discussion held at a later date. Concerned that proper documentation would not be prepared in time to enact the tax on January 1, 1996, a formal motion was made. PLAINFIELD VILLAGE BOARD OF TRUSTEES OCTOBER 2, 1995 PAGE FIVE M. Lambert moved to authorize the Village Attorney to draft a Ordinance for a utility tax. Seconded by K. Stalzer. Vote by roll call. President Peterson asked Administrator Van Vooren to set up a discussion from the Village regarding the Utility Tax at the next Community Council Meeting, held on Thursday, October 12 at 7:30 p.m. at the Plainfield School District Administration Center. PLANNER'S REPORT Director Waldock informed the Board that James and Carol Knotts have requested an extension on a variance that was granted on October 3 , 1994 for a side yard setback requirement for the purpose of constructing an attached two car garage. Presently, there is a one year tame limit on this variance. J. Dement moved to approve the request far an extension for the variance. Seconded by K. Stalzer. Vote by roll call. Dement, yes; Lambert, abstain; Rock, yes; Smolich, yes; Stalzer, yes. 4 yes, 1 abstain, 0 no, 1 absent. Motion carried. Director Waldock spoke briefly on a request received September 22, 1995 by Dan and Karen Rapachuck for the extension of their temporary Certificate of Occupancy for a home they built in Walkers Grave Subdivision. I ask that this request be submitted to the Development Committee for discussion. POLICE CHIEF'S REPORT Chief Bennett passed out to the Trustees the Police Mission Statement along with survey, and he asked the Board to fill out and respond by Friday, October 6. The Public Safety Committee has requested that the October 9, 1.995 Workshop be on the Police Departments Goals and Objectives. K. Stalzer moved to adjourn the meeting and go into Executive Session after a 5 minute break. Seconded by J. Dement. Vote by roll call. '~ .. ."'SUSAN JANTK, VI GE CLERK Heimerdinger Statement at Village Board Meeting October ~, 1995 I knew when I suggested a new tax at last weeks Workshop Meeting there would be -- from same circles -- an outcry. But T thought there could be civilized discussion, and civilized disagreement. I did not expect to be called a Nazi. I did not expect a citizen of this town to proudly put up a sign labeling me -- and other members of this board -- as Nazis. What is going on here? Obviously the legacy of Plainfield's past is still with us, We have driven a Postmaster out of town, we turn our heads to the problems our teenagers face, and the problems they cause. We watch kids pass out racially bigoted material -- and think of it as a prank. And some even think a sign with the word Nazi on it is funny -- at least in this context. I do not think the word "Nazi" is humorous. Since I have been on the Village Board, my safety has been threatened, someone offered to burn a crass on my front lawn, and now this. Interestingly, the individual who authors this protest probably has spent more money on the sign, than the new tax will cost. He has chosen not to quote Patrick Henry, nor the heroes of the Revolution to express his displeasure -- but instead has labeled us as Nazis. We can now add it to the lexicon of Plainfield "N" wards, or maybe it was there all the time. What kind of people are we. What kind of people publicly express attitudes like this. This man has strategically placed this sign on a major street. Scores of little children pass it daily on their way to school. It reminds me of the song,.,"you have to be carefully taught." Where is the condemnation. Where is the public displeasure. Haven't we learned anything from the lengthy trial in Los Angeles. This Village Board may have an easy time dealing with growth, for if this sign reflects the sophistication of this community, who in the world would want to move here...who would want to raise their children here? To the gentleman who put up the sign, T say..."' this is nvt Nazi Germany." But then I must also ask, what is it?
