HAMILTON -ENGINEER P. WALDOCK -DIR. OF ZONING J. DURBIN -PLANNER At 7:17 p.m. the Public Hearing was opened. All members of the Board were present. WALLIN WOODS ANNEXATION AGREEMENT AMENDMENT Planner Durbin stated that changes in the setback provisions are proposed to reduce the sideyard setbacks on certain lots. The floor area ratio is redefined to provide a maximum FAR which excludes the garage area. The minimum home size is amended to provide for a minimum split level at 1,800 square feet. The tree preservation section is amended to remove the homeowners association's authority to approve the removal of trees. The timing of construction of pedestrian improvements is changed from the occupancy of the first residEntial unit to prior to July 1, 1997. The applicants have proposed additional language that would allow the Village to approve all or a portion of those funds toward pedestrian pathways and/or a pedestrian overlook. A number of the covenants are proposed for changes to be more consistent with Village codes and to avoid conflict with those codes. The changes actually increase the number of homes that will have masonry on the front elevation while reducing the minimum percentage on each from 75% to 50%. All homes now will have masonry except for the possibility of 10% aluminum/vinyl siding. The required parkway and site planting quantities are changed from a per frontage foot quantity to a minimum count per lot. Trustee Rock stated many concerns he had regarding the changes mentioned above. Trustee Dement questioned the status on the property we had the option on? Attorney Harvey stated that it is in the process of review by attorneys. Trustee Heimerdinger also had same questions regarding the Landscape Plan changes. Mr. Paul Lehman, Moser Enterprises, Inc. explained the changes, and addressed concerns. All trustees were concerned regarding the original intent of the bicycle path/pedestrian bridge joining Whispering Creek/Indian Oaks Subdivision to town through this path.
