HAMILTON -ENGINEER J. DURBIN -PLANNER At 7:06 p.m.the Public Hearing was opened and all Trustees were present. CHAMPION CREEK ANNEXATION Planner Durbin spoke describing that the developers in this case propose the annexation and development of a 121 acre farm site located along the west side of Rt. 59 north of 119th Street in Wheatland Township. The subject parcel comprises 121.4 total acres. The draft Annexation Agreement proposes to develop the property as a Planned Unit Development, including 20 acres of Commercial property in the south east corner of the site. The balance of the subject site is proposed as open spaceJparks and single-family residential. The development of the subject property and its Annexation will result in the encroachment by the Village of Plainfield into the City of Naperville's Facility Planning area north of 115th Street. Approximately 40 acres are located north of 115th Street, in the City of Naperville's Facility Planning Area. 115th Street is also the Boundary Agreement line between Naperville and Plainfield. Our agreement with Naperville is valid until the year 2007 and prohibits annexation by the Village of Plainfield north of the 115th Street Boundary Line. We are in communication at present with Naperville regarding the necessary boundary changes. The agreement proposes the establishment of residential R-1 Planned United Development zoning for 101.4 acres of the 120 acre site. The 20 acre balance is proposed to be zoned B-3, Shopping Center Commercial District. The Annexation Agreement calls for payment of the Village's $1,750 per acre Annexation Impact Fee, but the impact fee shall not be applicable to park/school sites, or open space. The agreement calls for the Village to waive the $35.00 per acre Commercial Development Impact Fee. The agreement provides for one parkway tree per lot, with three trees for earner lots. Additionally, the option al landscape package will include at least two 1 1/2 inch diameter trees per lot. Staff • recommend that this be clarified to reflect that each lot will have a minimum two trees, in . addition to the parkway trees. PLAINFIELD VILLAGE BOARD OF TRUSTEES ~-~- PUBLIC HEARING APRIL 15, 1996 PAGE TWO Discussion of boundary agreement issues related to the Wiseman-Hughes Development Project with the City of Naperville has been started with a purpose to achieve an agreement with a conclusion that we could recommend a swap of 160 acres to the City of Naperville in exchange for 220 acres to the Village of Plainfield to address property encroachments on the west side of Rt. 59 and allow the City of Naperville to recapture costs assigned as part of a benefit area for existing public improvements already in place. Director Waldock explained the water and sewer construction casts to Trustee Dement. The Annexation Agreement provides that the developer will bear the costs of extension of the utilities to the subject premises along Rt. 59. The agreement further provides that the developer will apply any and all Annexation Impact Fees and water and sewer tap on fees due the Village as direct reimbursement for those offsite utility extension costs. These refunds should not be allowed to exceed actual costs of the off-site extensions. Jim Hughes, applicant, stated their would be 6 model homes with different elevations, and 60 production pre-starts on the property subject to the permanent gravel roadbase. j. Dement questioned the Recapture paragraph. Director Waldock stated that the agreement ~-,.~-malls fpr the recapture of any costs associated with the over sizing of utility lines constructed on premises throughout the subdivision. Recapture is applicable when the over sizing is necessary to service adjoining properties and is of benefit to those properties, but not to the subject site. The agreement calls for five percent interest for a fifteen year time period for this recapture. Staff recommends approval of the Annexation Agreement for Wiseman-Hughes Enterprises, Inc. subject to the following stipulations: 1) Submittal of an application and completion of staff review of Preliminary Plat materials; 2) Compliance with the requirements of the Village Engineer; 3) Provide a site of approximately five acres for a Village water tower; 4) Compliance with provisions of the Plainfield Fire District, Park District and School District; 5) Amend the Annexation Agreement to require annexation of the subject property to the Plainfield Public Library District upon achieving contiguity; 6) Amend the Annexation Agreement to address the issue of the $3500 per acre commercial impact fee contribution and the standard $1,750 policy applicable to the remainder of the site; 7) Amend the Annexation Agreement to provide for up to 6 model homes within the subdivision in its entirety and address standard policy for the pre-starts; 8) Amend the landscape provisions to require two private shade trees along with one parkway tree; 9) Amend the Annexation Agreement to provide for installation of parkway trees and sidewalks within three years of Final Plat approval for each unit regardless of occupancy or vacancy of each lot. 10) Limit interest accrual to a ten year period that shall not commence until two years after completion of subject utility lines; 11) Provide anti-monotony requirements in the covenants and restrictions far the subdivision. . PLAINFIELD VILLAGE BOARD OF TRUSTEES PUBLIC HEARING APRIL 15, 1996 PAGE THREE REIBEL ANNEXATION Director Waldock talked about the subject site containing approximately 195 acres located along the west side of Rt. 59. The property is comprised of two parcels. A 155 acre parcel is west of Rt. 59 and south of 127th St. adjoining Riviera Estates north border. The balance of the property is located along the north side of 127th and west of Rt. 59. The property is occupied at present by a farmstead with house and agricultural buildings. A small dwelling is located on the 40 acre tract as well. The principle use of the subject site at present is agricultural. No major vegetation is located on the parcel. The annexation of the Reibel property is necessary to provide a corridor of contiguity ultimately accessing the Wiseman-Hughes development site on the Tryner farm on the northwest corner of 119th St. and Rt. 59. The Reibel property adjoins the George Fry farm which is included as part of a proposed development plan in which the Village is working on an annexation agreement with the developers and land owners. Annexation of the Reibel property will provide a "land bridge" sufficient for legal contiguity for annexations to the north. Completion of this annexation corridor will substantially solidify boundary issues: with the City of Naperville along the Rt. 59 corridor. M. Lambert moved to close the Public Hearing. Seconded by K.
