HAMILTON -ENGINEER P. WALDOCK -DEVELOPMENT/ZONING J. DURBIN -PLANNER 7:16 p.m. Open Public Hearing. Previous roll call stands. DRINKALL ET AL. PRE-ANNEXATION AGREEMENT DISCUSSION Planner Durbin stated to the Board that the applicants are pursuing a Will County Rezoning which is subject to Village consideration because it is within one and one-half miles of the current Village boundary. The rezoning application considered by the Village Board at the November 20, 1995 Board meeting, Staff identified concerns related to this rezoning and provided a report from the Plan Commission. The Board directed the applicants to work with staff toward preparing apre-annexation agreement that could mitigate the concerns regarding the rezoning as presented by Staff. Staff presented the following findings for consideration by the Plan Commission: 1. This rezoning could be described as spot zoning and therefore should be discouraged; 2. The rezoning application is contrary to the provisions of the Intergovernmental Agreement between the Village of Plainfield and Will County and NIPC's Areawide Water Quality Plan. 3. The proposed development would result in inefficiencies in the Village's Utility Planning; 4. The proposed development does not meet the provisions of the Draft Comprehensive Plan; 5. The proposed development does not meet the provisions of the Draft Transportation Plan; Staff recommended, for the above reasons, that the Plan Commission recommend that the Village forward a Letter of Objection to the Will County Land Use Department. The Plan Commission disagreed with staff's analysis and recommendation. The Plan Commission supported the following findings: 1. The rezoning would not provide a negative impact on surrounding properties; 2. The rezoning is an effort to address existing conditions at the property. The applicants indicate a desire to design the easterly house so as to allow for a side load garage that will allow for relation of the driveway in the future. This is proposed as an additional means of addressing the impact of 127th Street an the property. r1 LJ PLAINFIELD VILLAGE BOARD OF TRUSTEES PUBLIC HEARING MARCH 18, 1996 PAGE TWO Several members of the Board addressed concerns regarding tap-on fees, recapture on line charges that were not stated in the pre-annexation agreement and believe that the above should be incorporated into the agreement. Planner Durbin told the Board that after conclusion of the Public Hearing, the Board could authorize the execution of the pre-annexation agreement. M. Lambert moved to adjourn the Public Hearing.
