Present: Mayor, Thomas Anderson; Councilmembers, Thomas Crosby, Sarah Lutz, William Reiser, Wilfred Scherer; Clerk -Treasurer, Donna Roehl; Planning and Zoning Administrator, JoEllen Hurr; Public Works Director, Ron Duran; Police Chief, Charles Hoover; Attorney, Richard Schieffer; Engineer, Paul Pearson; Planner Chuck Riesenberg. 1. ADDITIONAL AGENDA ITEMS Councilmembers agreed to discuss the following additional items: Appointment of Department Heads Personnel Policy Cable TV Long Lake/Medina Water 2. MINUTES OF DECEMBER 15, 1981 Motion by Reiser, seconded by Scherer to approve minutes of December 15, 1981, as presented. Motion declared carried 3. POLICE DEPARTMENT Loretto Police Contract Motion by Reiser, seconded by Scherer to enter into contract with the City of Loretto to handle their police matters during 1982 for a fee of $13,500. Motion declared carried Metropolitan Animal Patrol Contract Police Chief Hoover recommended that the contract be approved with the stipulation that there be no monthly patrolling until such time as he so directs. Motion by Scherer, seconded by Lutz to approve contract with MAPSI for 1982 with the provision recommended by the Chief of Police. Motion declared carried Professional Interviewing Class Motion by Lutz, seconded by Scherer to authorize Robert Anderson to attend a Professional Interviewing class during February, at a cost of $75.00. Motion declared carried 4. PUBLIC WORKS DEPARTMENT Utility Rates Council reviewed preliminary budget reports regarding income and expenditures for 1981 and anticipated expenses for 1982. Discussion as to how residents would pay for major repairs that had been made in Medina- Morningside and the need for another well in the Hamel area. Motion by ,Crosby, seconded by Scherer to set water rates at $1.35 and sewer rates at $1.50 par 1000 gallons, for the Hamel, Independence Beach and Medina Morningside areas. Motion carried Voting No -Lutz Robert Hosp Wilfred Scherer reported on meeting held to review the area with representative of DNR, Ron Duran and himself. He stated that if Lake Ardmore were to be lowered to improve drain- age of the area a public hearing would need to be held after notification of property owners within 350 ft. Richard Schieffer explained that if the city were to become involved in doing the work it could be considered a Special Assessment project. Robert Hosp stated that he would like the lake level at the elevation that it had been two years ago and the work involved was a bigger job than he could handle. Discussion of the fact that some of the lots involved are state owned lots and permission would need to be secured from them. Mr. Hosp stated that he would investigate whether or not the ditch is a County Ditch and if so whether or not an easement exists. 5. PLANNING AND ZONING DEPARTMENT Comprehensive Sewer Plan Chuck Riesenberg reviewed itinerary for review of Comprehensive Plan by Metro Council, stat- ing that there are two issues involved, one being the fact that the plan allows for lots to be smaller in the rural areas than Metro would like them to be so perhaps the plan should speak to an annual maintenance program for On -Site septic systems. Discussion regarding the possibility of revising the ordinance to include annual inspection of on -site systems. Mr. Riesenberg stated that the second issue to be considered is whether or not an alternate to the Hamel sewer area should be submitted which would allow for a much greater area to be sewered. He reported that such a request could be submitted within a few years. Paul Pearson presented revisions that had been suggested at the December 15th Council meet- ing. Motion by Reiser, seconded by Scherer to accept the Comprehensive Sewer Plan and ask that Chuck Riesenberg submit the proposal to the Metropolitan Council for review along with the Comprehensive Plan. Motion declared carried Mark Franklin, Conditional Use Permit JoEllen Hurr and City Council completed resolution regarding the granting of a Conditional Use Permit and variance for radio towers; January 26, 1982, the date by which the height of the tower must be reduced; January 12, 1982, the date by which the building permit must be secured and February 15, 1982, the date by which a survey attesting to the correct height of the antenna must be presented. It Council agreed that Mr. Franklin should pay a proportionate share of the cost involved and that all costs should be compiled by the January l9th City Council meeting. Thomas Crosby stated that a correction should be made in the minutes of December 15, 1982 whereby Mr. Franklin is allowed a 47 ft. tower and a 60 ft. tower with a 10 ft. mast. Motion by Crosby, seconded by Scherer to adopt Resolution 82-1, granting Mark Franklin a Conditional Use Permit and a variance for radio towers. Motion declared carried M and P Utilities JoEllen Hurr recommended approval to release all but $147.00 of the escrow amount being held for completion of the M and P Utilities project at 2402 Hwy. 55. She stated that the $147.00 would cover engineering and administration fees spent in inspecting the project. Ms. Hurr also reported that Paul Pearson had recommended that M and P secure the advise of an engineer for their land alteration project due to the fact that building materials have been hauled in and they may wish to build on the property at some future date. She explain- ed that some of the materials that have been dumped are similar to what others in Medina have been stopped from dumping. Motion by Reiser, seconded by Crosby to release $4653.00 of the $4800.00 being held in escrow, to M and P Utilities. Motion declared carried Motion by Reiser, seconded by Crosby to direct the Zoning Administrator to investigate the M and P Utilities filling operation, to secure a new application and collect fees incurred. Motion declared carried Parker Building JoEllen Hurr reported that a request had been made for a third office in the Parker Build- ing on Tower Dr. She stated that she would prefer to handle such requests because answers areusually needed immediately. She stated that if there was a difficulty either she or a potential renter would take the problem to the Council. Undersized lots JoEllen Hurr reported that the Planning Commission would be considering several applicat- ions for setback variances, etc. on undersized lots. Discussion of the possibility of requiring substandard lots to be combined so as not to work with variances. Richard Schieffer stated that an amendment to the zoning ordinance could be considered. Motion by Reiser, seconded by Scherer to declare a moritorium on development of sub- standard lots in sewered areas. Motion carried Voting No- Crosby 6. CONSENT AGENDA Cigarette Licenses Motion by Reiser, se onded by Crosby to approve 1982 cigarette licenses for Rolling Green Country Club, Pat's Liquors and Countryside Cafe. Motion declared carried Colonial Drive -In Theatre Motion by Reiser, seconded by Crosby to approve the 1982 license for the Colonial Drive -In Theatre. Motion declared carried Official Newspaper Appointment Motion by Reiser, seconded by Crosby to appoint the Crow River News as the cities official newspaper for 1982. Motion declared carried Official Depository Motion by Reiser, seconded by Crosby to appoint the Farmers State Bank of Hamel as the Official Bank Depository for 1982. Motion declared carried Commissioner Appointment Motion by Reiser, seconded by Crosby to appoint the following Commissioners for 1982: Public Safety, William Reiser; Public Works, Wilfred Scherer; Health and Welfare, Sarah Lutz; Special Projects, Thomas Crosby. Motion declared carried Acting Mayor Motion by Reiser, seconded by Crosby to appoint William Reiser as Acting Mayor for 1982 in the abscense of Mayor Anderson. Motion declared carried 7. WAGES Council discussed wages of various employees. Motion by Crosby, seconded by Reiser to set the following wages for 1982: Janitorial Service - Verna Hoover - $ 6.00 per hour Clerk -Treasurer - Donna Roehl 10.41 " Ass't. BURLINGTON - NORTHERN RAILROAD Richard Schieffer stated that he would like 30 days to resolve the yearly payment of ease- ment fee issue with Ornon and Long Lake. He explained that if it is considered a maintenance fee all three cities would share the cost and if an easement fee only Orono and Medina would share the cost. 9. CABLE TELEVISION JoEllen Hurr reported that several South Shore communities are interested in joining into an agreement for Cable Tv service and that at an area Mayors meeting it was agreed that perhaps better service would be provided if a larger area were to be served. 10. LONG LAKE - MEDINA WATER Thomas Anderson reported that the City of Long Lake would like to meet with him to discuss future water service plans. He stated that he would not want the city to become involved if it would not be advantageous to Medina residents. 11. DEPARTMENT HEADS Motion by Crosby, seconded by Reiser to appoint the following Department Heads for 1982: Police Chief, Charles Hoover; Public Works Director, Ronald Duran; Planning and Zoning Administrator, JoEllen Hurr; Clerk -Treasurer, Donna Roehl. Motion declared carried 12. MILEAGE Motion by Scherer, seconded by Reiser to set mileage reimbursement for 1982 at 20 cents per mile or the current IRS fee. Motion declared carried 13. MEETING ATTENDANCE FEE Motion by Scherer, seconded by Reiser to set meeting attendance fees for 1982 as follows: Police Chief and Public Works Director - $15.00 per meeting Clerk -Treasurer and Planning and Zoning Adminstrator - $30.00 for Council and $20.00 for Planning Commission meetings. Motion declared carried 14. PARK COMMISSION Anne Heideman, Chairperson of the Park Commission ststed that William Nelson would be sending a proposal for the sale of lots across the street from the city park. 15. BILLS Motion by Crosby, seconded by Scherer to pay the bills; Order Checks # 9976-9999 and #1000-1022 in the amount of $169,569.65 and Payroll Checks # 6501-6523 in the amount of $8513.40.
