An ordinance narrowing a portion of a street known as Hill—
side Drive in the City of Moab, SWk, Section 6, T26S, R22E,
S.L.B. & M., Grand County, Utah.
WHEREAS, HESCO, Inc., a subsidiary of Heritage Savings
and Loan Association, a Utah Corporation, resident of the City
of Moab, County of Grand, State of Utah, as adjacent property
owners, petitioned the City Council, City of Moab, to vacate
a portion of a street known as Hillside Drive;
BE IT ORDAINED by the City Council, City of Moab, Grand
County, Utah, that the petition of HESCO, Inc. be granted as
follows:
1. That a certain tract of land located in the SW4i Sec—
tion 6, T26S, R22E, S.L.B. & M., Grand County, Utah,
being that portion of a street named as Hillside Drive
and described as follows:
Beginning at the NW corner of Arches Subdivision which
bears East 60.0 ft. from the NW corner, NE 4 SW 4,
Section 6, T26S, R22E, SLB&M, and proceeding thence
South 441.43 ft. with the West boundary of said Sub—
division to the SW corner of said Subdivision, thence
West 15.0 ft., thence North 441.43 Ft., thence East
15 ft. to the point of beginning. A 7.0 ft. wide util—
ity easement is reserved along the West side of this
tract;
this vacation of a portion of said Hillside Drive
shall in no way impair the franchise rights of any
public utility nor extinguish any existing municipal
utility rights evidenced by or in place within the
portion of Hillside Drive so vacated.
2. The City Recorder is directed to record a copy of
this Ordinance in the Office of the Recorder, County
of Grand, State of Utah, and to cause the same to
be indexed in the name of the City of Moab, Grantor
and HESCO, Inc., Grantee.
3. This ordinance shall take effect and be enforced from
and after its passage and publication according to
law.
