AUTHORIZATION TO RECRUIT FOR NEW POSITIONS AND APPROVAL OF CONTRACT TO PERFORM RECRUITMENT Overview Increasing demands from RCTC staff due to ongoing commitments as well as future changes in staffing as a result of impending retirement plans of senior staff members is a concern which needs to be addressed. It is proposed that the Executive Committee provide authorization to recruit for new positions and to approve a contract to assist in the recruitment. 4. RCTC POLICY PROHIBITING EMPLOYMENT OF EX -OFFICIO, NON -VOTING BOARD MEMBERS Overview In reviewing policies in place for several major transportation organizations, they do not have a policy in place wherein a governor's appointee is not eligible to seek employment from these organizations. This item is on the Executive Committee to be discussed. However, since the Commission is charged with approving its Personnel Rules and Regulations, this is on the agenda for the full Commission for action. I 5. AMEND FEES FOR RECORD REQUESTS Overview Requests for records continue to increase due to a number ongoing and upcoming projects and studies. It has been a number of years since the Commission has reviewed the cost to produce records. It is proposed that the Commission amend the fee it charges for copies of records from 50 cents for the first page and 10 cents for each subsequent page(s). 6. ADJOURNMENT The next meeting is scheduled to be held at 8:00 a.m., Wednesday, February 9, 2005, RCTC Conference Room "A", 4080 Lemon Street, 3rd Floor Conference Room, Riverside. e e e AGENDA ITEM 3 • • • RIVERSIDE COUNTY TRANSPORTA TION COMMISSION DATE: January 12, 2005 TO: Executive Committee FROM: Eric Haley, Executive Director SUBJECT: Authorization to Recruit for New Contract to Perform Recruitment Positions and Approval of STAFF RECOMMENDATION: That the Executive Committee authorize the recruitment of new positions and approve a contract with Dr. Bill Mathis to perform recruitment. BACKGROUND INFORMATION: RCTC, as an organization, has a deserved, high profile reputation within California as an effective and innovative regional policy body. We are fully engaged in regional and statewide forums both at the technical and decision -making levels. Over the last seven years, RCTC has broadened its commitments in all of its program areas and has created new, rapidly expanding, policy and financing initiatives, e.g., four Community and Environmental Transportation Acceptability Process (CETAP) corridor efforts, Transportation Unified Mitigation Fund (TUMF) partnership projects, and the Measure "A" 2009-2039 early development work. These new focus areas are additive to the ongoing commitments to meet our goal to have all of our 1989-2009 Measure "A" Work Program projects completed or underway by April 1, 2009. RCTC Commissioners and Executive Staff feel considerable pride in the fiscal responsibility and efficiency demonstrated by the lean, non -bureaucratic staffing structure that has been part of RCTC's culture since its inception. Indeed, while RCTC's revenues, budget, and the number of projects initiated and overseen has dramatically expanded in the last decade, the staffing levels have stayed within the 20-25 staff range since the mid -1990's. The last major revision of the staffing structure was accomplished in 1999. Over the last 5.5 years, the only substantial changes were the addition of Public Information Officer, the deletion of the 50% commitment to a Government Relations/Legislative position, and the addition of a Program Manager for our Commuter Services Programs. Of note, the Government Relations position responsibilities were assumed by the Director of Public Information. Agenda Item 3 At this point in RCTC's evolution, I am recommending that the Executive Committee authorize up to three new positions, a new Deputy Director level position, responsible for programming and administration, and entry-level analyst positions to support our programmatic work areas. I request the authority to initiate a recruitment for the Deputy Director position upon your approval of this request; to be followed within three months by a recruitment for the analyst positions. The primary duties of the new Deputy Director would be responsibility for RCTC's STIP Program and Interregional Transportation Improvement Program (ITIP) interests, RCTC's TUMF Program, and RCTC's regional funding and programming commitments with the Southern California Regional Rail Authority (SCRRA) and the Mobile Source Reduction Review Committee (MSRC). The administration portion of the position will oversee the Chief Financial Officer and her responsibilities including budgeting, project financing, payroll, and contract management and purchasing. The major change embodied in the recommended new position and realignment of responsibilities is recognition of the huge expansion of RCTC's advanced planning/CETAP Corridor commitments. Cathy Bechtel, who currently is making both full-time commitments to CETAP projects as well as programming issues, would focus on the expanding demands of all CETAP efforts and continue to be responsible for oversight of transit issues and the new Transit Policy Committee. Many critical decisions involving the Mid -County Parkway and the Riverside County -Orange County Corridor will be made over the next year. Additionally, the first RCTC financed acquisition of MSHCP mitigation properties will take place in 2005. Hideo Sugita will continue as Deputy Executive Director overseeing all elements of project delivery, providing direct liaison with our Bechtel contractor and oversight of the advanced planning/CETAP arena. I view the compensation level as likely to fall between that of the Chief Financial Officer and the Deputy Executive Director, Hideo Sugita. In reviewing the modest impact of the new positions on our 2004-05 budget and our anticipated revenues for 2005-06, I'm comfortable that the new positions' costs will fit within the Commission's 1% maximum Measure "A" administrative salary cap and 4% overall cap. Attached is an assessment of the fiscal impacts of the proposed new hires. Also attached is a proposed announcement along with anticipated costs of a focused recruitment conducted by Bill Mathis, of Bill Mathis and Associates. Dr. Mathis has a unique understanding of RCTC's history and staff culture, having • Agenda Item 3 • • • served as a management consultant facilitating our staff organizational retreats periodically since 1998. As such, his input will enhance our opportunity for a successful hire. A final thought: Given the high regard afforded RCTC on a regional and statewide basis, we have an opportunity to attract some excellent applicants both initially for the Deputy Director position and, subsequently, for the analyst positions. I feel we have an immediate need of additional staff resources and also the opportunity to substantially strengthen our staff at both ends of the career ladder. I will include Part I (Deputy Director) and Part II (two analyst positions). Part I: Deputy Director of Programming and Administration (new position) This proposal will be aimed at a quick and focused recruitment of a specialist who meets rather stringent requirements. Cost should be approximately half that charged for a full recruitment (i.e., $20,000 + expenses). Proposal: a) Prepare recruitment brochure b) Prepare ads for immediate placement — Jobs Available c) Work with Executive Director in identifying appropriate invitations in addition to those found via advertisements d) Mathis to offer specific invitations to key candidates e) End acceptance of candidates and set date for interviews f) Consultant will provide management profiles for finalists and preliminary screening (4-5) g) Executive Director makes final selection after Dr. Mathis completes background investigation by the end of February 2005 Costs: $10,0100, plus actual expenses Recruitment Proposal Part II: New Positions - Analysts/Transportation This proposal is for hiring two staff analysts for support of RCTC Managers and may require special interests and skills not generally available in general recruitments. In addition to selection by the Executive Director, both executive managers will participate in drawing up specific traits and requirements for the support positions (analysts). Proposal: a) Meet with Executive Director and key managers of RCTC to determine traits and desirable skills desired for these roles (Transit and Legislative) b) Develop recruitment brochure c) Prepare ads for recruitment in California and set recruitment schedule with Executive Director d) Prepare specific invitations for focused recruitment e) Director to set date for screening interviews with Consultant and executive managers f) Executive Director to approve final selection and process while consultant completes background check. Costs: $12,000, plus actual expenses RWM • • • Riverside County Transportation Commission Deputy Director of Programming and Administration This is a new position authorized by Riverside County Transportation Commission that will report directly to the Executive Director, Eric Haley. The successful candidate must be experienced in management skills and operations/planning in general transportation issues. Our candidate must possess advanced transportation knowledge of California networks and knowledge of funding sources/planning at a macro level. RCTC is Riverside County's primary transportation agency charged by state law with the responsibility of planning and funding improvements. This public agency was created in 1976 as one of four County Transportation Commissions in Southern California to provide more local control and input over transportation matters. The Commission is overseen by a 30 -member Board comprised of an elected official from each of the County's 24 cities, all five County supervisors and an ex -officio member that is appointed by the Governor. Salary: DQ; favorable benefit package. Prefer BA, advanced degree/engineering or management; experience of 10 yrs. minimum. BACKGROUND INFORMATION: Over the next several years, it is probable that RCTC's senior staff will experience several retirements. In order to encourage the best available candidates to seek employment at RCTC, we should remove impediments to top level California Department of Transportation employees who may consider seeking employment at RCTC. In recent years several major transportation organizations, including the San Diego Association of Governments (SANDAG), have hired individuals who have served as the Governor's ex -officio, non -voting representative. RCTC's policy is a local discretionary policy. It should be noted that the Governor's representative is non -voting, is ineligible to serve on the Executive Committee, does not serve on policy committees, and does not receive the Commissioner per diem or mileage and expense reimbursement. Attachment: Legal Counsel Memorandum Agenda Item 4 LAW OFFICES OF BEST BEST & KRIEGER LLP • • • January 4, 2005 MEMORANDUM To: EXECUTIVE DIRECTOR FROM: LEGAL COUNSEL RE: RCTC POLICY PROHIBITING EMPLOYMENT OF EX OFFICIO, NONVOTING BOARD MEMBERS You requested that we research whether there are policies that prohibit an ex officio, nonvoting Commissioner from being employed by the Commission after resigning as a Commissioner. Section 3.10(2) of the RCTC Personnel Policies and Procedures Manual provides as follows: Members of the Commission Board are ineligible for employment with the Commission while serving on the Commission and for one year after their service on the Commission ends. You have asked if this section applies to ex officio, nonvoting members of the Commission. While the RCTC Personnel Policies and Procedures Manual does not provide a specific answer to this question, we believe that there is a strong argument that ex officio, nonvoting members are currently included in this prohibition. The Commission's Administrative Code, as well as the State law defining membership in the Commission, uses the term "member" to refer to both voting and nonvoting members. Further, in practice, the Commission routinely refers to its ex officio, nonvoting members as "members." Therefore, we believe that as currently drafted the prohibition in Section 3.10(2) applies to ex officio, nonvoting Commissioners. You have also asked if RCTC can amend this prohibition. If amended, the provision would allow a nonvoting, ex officio member to be employed by the Commission immediately after leaving his or her position as a Commissioner. We conclude that the Commission may amend its personnel policies to exempt ex officio, nonvoting members from the requirements of Section 3.10(2). State law does not provide any strict prohibition in this regard, so the Commission is free to establish its own local rule. In addition, as a matter of policy, the prohibition appears to be intended to restrict voting members from using their power and influence while on the Board to affect decisions which would benefit them upon leaving the Board. In this case, the ex officio, nonvoting member does not have the same power or influence as a voting member, and therefore, from a policy standpoint, it does not appear that the same considerations would apply. LAW OFFICES OF BEST BEST & KRIEGER LLP In short, the Commission's Personnel Policies currently appear to prohibit RCTC from employing an ex officio, nonvoting member for 12 months after he or she leaves the Commission. However, this prohibition can be modified or eliminated by the Commission. Steven C. BACKGROUND: The Riverside County Transportation Commission has a number of ongoing and proposed construction projects and studies, and with the new Measure "A" in place, that will continue to increase. The projects involve a large number acquisition of properties with some of the acquisitions that undergo legal process. Requested records that go through legal process are usually 20 pages to 600 pages, and we have had a number of these kinds of requests. It has been five years since the Commission has reviewed the actual cost to produce copies of records. As required by the State, the fee charged for records shall be for materials, not staff time. As the Commissioners are aware, RCTC has limited staff resources but staff has met all of the requests from the public, legal counsel and the court, to produce records so far. Even then, the cost of paper and copier -associated materials has increased over the years. The current fee charged by the Commission is 50 cents for the first page and 5 cents for each subsequent page. The proposed increase is very modest but it reflects the cost of the material to produce each page of record requested. The proposal is to continue to charge 50 cents for the first page and to raise the fee from 5 cents for each subsequent page to 10 cents each for subsequent page. Agenda Item 5
