HARVEY -ATTORNEY D. BENNETT -CHIEF OF POLICE Planner Durbin spoke regarding the applicant, Peter Lagios, is seeking a Will County Special Use permit to operate a golf driving range and practice facility on a 20 acre property located at the northwest corner of 127th Street and 248th Street. The proposed project and county application is subject to Village review because it is within 1.5 miles from the Village boundaries. Staff expressed concerns related to a commercial land use located in a residential district and the floodlights associated with the proposed use. Towards these concerns, the applicants have agreed to enter into apre-annexation agreement for the property whereby the property would be annexed upon contiguity. Upon redevelopment or expiration of the agreement, the property would be rezoned and put to a use compatible with the then current Comprehensive Plan. Staff and the Plan Commission recommend that the Village Board concur with the following findings: 1) The subject site is a logical extension of Village boundaries; 2) The subject site can be served by Village services; 3) The annexation of the site is important toward implementing the Village Comprehensive Plan and FPA; 4) The annexation of the subject site is important toward securing the northern and western Village boundaries. Staff and Plan Commission recommend annexation of the subject property; they also recommend that the Village file a letter of no objection to the proposed special use permit with Will County subject to execution of apre-annexation agreement. Steve Rhoades, of the Law Firm of Dommermuth, Brestal, Cobine and West, Ltd., attorneys representing applicant, Peter Lagios, spoke regarding the potential annexation. Trustees questioned any contributions made by developer to Village; a possibility of incorporating into Annexation Agreement charges for Amusement Tax for the driving range; issues relating to extension of easements, and concerns with lighting of the site and proposed dedication right-of- way to the Village. L PLAINFIELD VILLAGE BOARD OF TRUSTEES PUBLIC HEARING NOVEMBER 18, 1994 PAGE TWO Comments from Public: Ed Waldridge, co-owner of property just north of this development had concerns as to the change in valuation of their property. Mr. Shahbaz Rahmanian, also adjacent property owner, had concerns regarding legal issues where procedure might not have been followed in notification of adjacent property owners. Mr. Fred Strohue also had similiar concerns. Homeowners within a quarter of a mile are totally against the development, with concerns about lights, traffic and that it does not fit in with the Comprehensive Plan. Those stating their concerns were: Rosemary Anderman and D. Keeley. Due to the fact that some adjacent property owners were not properly notified according to our Zoning Ordinance, President Peterson asked that the Public Hearing be closed. K.
