10. 1 attest to you that I am willing to provide payment for these records, up to the amount

copy of pages actually duplicated onto paper; a service charge for remote electronic access

11. Note well, venturing to an off -site storage or retrieving documents from back-up
documents, is not chargeable as a special service charge. "[T]he decision by the police
department to store its older records off -site relates to the nature of the record itself, so as
to justify the imposition of the special service charge. Instead, the determination to store its
older records off -premises would appear to be a policy decision by the public agency as to
how to maintain its public records in light of certain space restrictions.... [W]here a specific
fee has not been prescribed by a statute, a municipal police department may only charge
the actual cost of duplication for copying public records and may not charge for travel time
and retrieval costs for those records stored off -premises." Fla. Att'y Gen. Op. 90-07
(1990)0p. Att'y Gen. Fla. 90-07 (1990) (police department may not charge for travel time and
retrieval costs for public records stored off -premises); Op. Att'y Gen. Fla. 88-23 (1988) (state
attorney is not authorized to impose a charge to recover part of the costs incurred in
production of a training program; rather, fee to obtain copy of videotaped program is
limited to actual cost of duplication of the tape); 85-03 (1983) and 89-93 (1989).

12. Nor can special service charges be applied for time spent redacting documents. Op.
Att'y Gen. Fla. 84-81 (1981) (stating that the special service charge may not be routinely
imposed; thus, the special charge could not be imposed merely because the records
requested contained exempt material). See also Op. Att'y Gen 76-34 (the right of citizens to
inspect public records may not, in the absence of a statute, be conditioned upon the
payment of search fees).
13. "When calculating the "actual costs of duplication," charges may not be made for labor
costs or associated overhead costs.... The fact that the request involves the use of
information technology resources is not sufficient to incur the imposition of the special
service charge." Fla. Att'y Gen. Op. 2013-03 (2013). The statute clearly provides that if an
agency maintains a record in a particular medium and that medium is requested for the
copy, the agency "must provide a copy of the record in the medium requested[.]" The
statute also provides that "the agency may charge a fee in accordance with this chapter."
Id. As no charge has been established by law for providing copies by electronic mail in lieu
of photocopying, section 119.07(4)(a) 3., Florida Statutes, authorizes "the actual cost of
duplication of the public record" to be charged. "Actual cost of duplication" is defined in
section 119.011(1), Florida Statutes, to mean "the cost of the material and supplies used to
duplicate the public record, but does not include labor cost or overhead cost associated with
such duplication." Id.

14. Please promptly provide an invoice for any charges expected to be greater than $25.00,
so that I can remit payment ahead of time, as per your public records request policies, of a
portion, or the entire expected charges. See, Woodard v. State, 885 So.2d 444, 445-46 (Fla.
4th DCA 2004) ("When a custodian receives a written request by mail for public records and
for information regarding copying costs, the custodian has a duty to respond with the
amount of the fee and, once the requester has forwarded the fee, to produce the records.");
see also Wootton v. Cook, 590 So.2d 1039, 1040 (Fla. 1st DCA 1991).
15. However, "requiring payment before an invoice cannot excuse the delay in providing
[public] records." Office of the State Attorney for the Thirteenth Judicial Circuit of Florida v.
Gonzalez, 953 So.2d 759, 765 (Fla. 2d DCA 2007).
16. An unlawful denial of access can occur in many different ways, including delay. See, e.g.,
Tribune Co. v. Cannella, 458 So.2d 1075,1079 (F1a.1984) ("The only delay permitted by the
Act is the limited reasonable time allowed the custodian to retrieve the record and delete
those portions of the record the custodian asserts are exempt."); see also Barfield v. Town
of Eatonville, 675 So.2d 223 (Fla. 5th DCA 1996) ("An unjustified delay in complying with a
public record request amounts to an unlawful refusal under section 119.12(1), Florida
Statutes."). It may also occur by excessive special services charges. See, e.g., Carden v. Chief
of Police, City of Clewiston Police Dep't, 696 So.2d 772, 773 (Fla. 2d DCA 1996) ("An
excessive charge could well serve to inhibit the pursuit of rights conferred by the Public
Records Act").Morris Pub. Group, LLC v. State, 154 So. 3d 528, 533 (Fla. 1st DCA 2015).

As you are surely aware, the 11th Circuit Court of Appeals opinion in DeMartini v. Town of
Gulf Stream recounts the scheme perpetrated by CAN and Martin O'Boyle wherein frivolous,
deliberately -vague public records requests would be filed with the town, with litigation and
excessive settlement demands following the Town's all -but -guaranteed -noncompliance. The
Court of Appeals' opinion contains the following statements:
In July 2014, Chandler met with Sweetapple, the Town's special counsel, and provided
Sweetapple with documents and a sworn statement detailing CAFI's fraudulent conduct.
Chandler also gave Sweetapple a sworn video statement concerning his involvement with
CAFI, O'Boyle, and the O'Boyle Law Firm. Chandler advised Sweetapple about CAFI's two-
step "windfall scheme" of (1) issuing deliberately vague and ambiguous public records
requests to the Town and other entities and (2) then demanding excessive amounts of
attorney's fees and other costs to settle the dispute when the Town or other entities failed
to respond to the public records requests in a timely manner.
On October 27, 2014, Sweetapple, as the Town's special counsel, obtained Chandler's
affidavit, which outlined the existence of O'Boyle's "windfall scheme" and DeMartini's
participation.
I request a copy of the referenced sworn statement, sworn video statement, and affidavit.
If possible, please transfer responsive records to me over the internet.
