HomeMy Public PortalAboutTBM 2011-01-19DATE: Wednesday, January 19, 2011 MEETING: Board of Trustees Regular Meeting PLACE: Fraser Town Hall Board Room PRESENT Board: FRASER BOARD OF TRUSTEES MINUTES Mayor Fran Cook; Mayor Pro -Tem Steve Sumrall; Trustees: Peggy Smith, Vesta Shapiro, Scotty Brent, Joyce Burford and Eric Hoyhtya Staff: Town Manager Jeff Durbin; Town Clerk, Lu Berger; Public Works Director Allen Nordin; Police Chief, Glen Trainor Others: See attached list Mayor Cook called the meeting to order at 6:00 p.m. 1. Regular Meeting: Roll Call 2. Approval of Agenda: Trustee Burford moved, and Trustee Brent seconded the motion to approve the Agenda as amended. Motion carried: 6 -0. 3. Consent Agenda: a) Minutes January 5, 2011 Trustee Burford moved, and Trustee Brent seconded the motion to approve the consent agenda. Motion carried: 6 -0. 4. Executive Session: For the purpose of determining positions relative to matters that may be subject to negotiations, developing strategy for negotiations, and /or instructing negotiators, under C.R.S. Section 24- 6- 402(4)(e) and for a conference with Special Counsel for the purpose of receiving legal advice on specific legal questions under C.R.S. Section 24- 6- 402(4)(b); regarding current and pending water matters. Enter: 6:00 p.m. Trustee Brent moved, and Trustee Sumrall seconded the motion to open the Executive Session for the purpose of determining positions relative to matters that may be subject to negotiations, developing strategy for negotiations, and /or instructing negotiators, under C.R.S. Section 24- 6- 402(4)(e) and for a conference with Special Counsel for the purpose of receiving legal advice on specific legal questions under C.R.S. Section 24-6 402(4)(b); regarding current and pending water matters and to include TM Durbin, PWD Nordin, TC Berger, SC Thorne. Motion carried: 6 -0. Trustee Hoyhtya arrived 6:42 p.m. Attorney's Opinion Required by C.R.S. 24- 6- 40212)(d.5)(II)(B). As the Special Counsel representing the Town of Fraser, I am of the opinion that the entire Executive Session, which was not recorded, constituted a privileged attorney client ;ommunication. Trustee Burford moved, and Trustee Shapiro seconded the motion to close the Executive Session for the purpose of determining positions relative to matters that may be subject to negotiations, developing strategy for negotiations, and /or instructing negotiators, under C.R.S. Section 24- 6- 402(4)(e) and for a conference with Special Counsel for the purpose of receiving legal advice on specific legal questions under C.R.S. Updates: a) Eric Murray Kremmling Memorial Hospital District postponed b) East Grand School District postponed 7. Public Hearings: 8. Discussion and Possible Action Regarding: Page 2 of 3 a) Medical Marijuana Regulations TM Durbin and TA McGowan briefed the Board on the States current regulations for medical marijuana and the possibility of implementing regulations at the local level. b) Colorado Association of Ski Towns Vacation Rental by Owner Program Trustee Burford updated the Board on the current status of the Vacation Rental by Owner program with !street. Dianne Butler of Destination's West property management gave the Board a view of the issues caused by home owners that do not pay sales tax to the communities they rent their properties in. 9. Action Items: 10. Community Reports: Trustee Brent and Trustee Smith updated the Board on the DAC Committee /School Board meeting held on Tuesday evening. CAST meeting next week, large group attending. CAST meeting in March CU Boulder Leads School of Business presentation coming up March 17, 2011. 11. Staff Reports: Town Clerk Icebox has requested an off -site warehouse permit and tasting request. Finance Manager None Town Planner None Public Works Director None Town Manager Need a Water/Wastewater committee member. Upcoming meeting with the Winter Park Town Council and the Winter Park Fraser Valley Chamber of Commerce on February 8th. Plant Superintendent None Police Chief New officer started. 12. Other Business: Trustee Hoyhtya moved, and Trustee Burford seconded the motion to adjourn. Motion carried: 7 -0.
