A RESOLUTION OF THE VILLAGE COUNCIL OF THE
VILLAGE OF KEY BISCAYNE, FLORIDA; AUTHORIZING
VILLAGE'S CHARTER SCHOOL STUDY CONSULTANT TO
PROVIDE FOR THE PREPARATION AND FILING OF AN
APPLICATION FOR A CHARTER HIGH SCHOOL, IN
ADVANCE OF COMPLETION OF PLANNING AND STUDY
ACTIVITIES, IN ORDER TO PRESERVE THE PRIORITIES
AND RIGHTS OF THE VILLAGE OF KEY BISCAYNE;
PROVIDING FOR IMPLEMENTATION; PROVIDING FOR
AN EFFECTIVE DATE.
WHEREAS, pursuant to Resolution No. 2008-23, the Village has retained Fielding Nair
International, LLC (the "Consultant") to engage in charter school planning and study activities and
has approved In Rem Solutions, Inc., as a project subconsultant (the " Subconsultant") for charter
school application purposes; and
WHEREAS, the Council finds that, in advance of the completion of the charter school
planning and study activities, it is necessary for the Consultant (acting primarily through
Subconsultant) to prepare and timely file a Charter High School Application (the "Application"), on
behalf of the Village, with the Miami -Dade County School Board, in order to preserve the priorities
and rights of the Village, subject to the Village Council's right to withdraw said Application; and
WHEREAS, the Village Council hereby finds that the adoption of this Resolution is in the
best interest of the Village.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE VILLAGE
OF KEY BISCAYNE, FLORIDA, AS FOLLOWS:
Section 1. Recitals Adopted. That each of the recitals stated above is hereby adopted
and confirmed.
Section 2. Authorization. That the Consultant, acting by and through the Subconsultant,
is hereby authorized to provide for the timely preparation and filing of the Application, upon the
written request of the Village Manager, and subject to the Village Council's approval of the
Application prior to filing, and the approval of the Application by the Village Attorney as to
conformity with the authority provided by this Resolution.
Section 3. Implementation. That the Village Manager is hereby authorized to take all
action necessary to implement the purposes of this Resolution.
Section 4. Effective Date. That this Resolution shall be effective immediately upon
adoption hereof.
