DARNELL, K. O'CONNELL, 5. RATHBUN. TRUSTEE R. SMOLICH WAS ABSENT. OTHERS PRESENT: S. JANIK -CLERK T. BURGHARD -ADMINISTRATOR C. WISE -ATTORNEY D. BENNETT -CHIEF OF POLICE H. HAMILTON -ENGINEER P. WALDOCK -DIRECTOR At 7:00 p.m. President Rock called the meeting to order with roll call. Trustee R. Smolich was absent, all other Trustees were present. Clerk Janik then led the pledge to the flag. There were no Presidential Comments made. Public Comments: Mark Perle owner of Mark Peters Jewelry and Dancing Pizza Restaurant spoke regarding the proposed lights at the end of existing Ft. Beggs Street. President Rock announced that this discussion will be placed on the Agenda for our next meeting regularly scheduled for August 18, 1997. Committee Reports: Trustee Dement questioned Chief Bennett regarding the disturbance that took place on Pratt Drive and Newkirk Drive over the weekend. Chief Bennett explained that there were no arrests made in reference to the incident. He spoke to the homeowners and there were no complaints made against the disturbance. J. Dement moved to open a Public Hearing on Arbor Creek Annexation Agreement to consider public comments. Seconded by K. Stalzer. Director Waldock stated that we are here tonight to focus on the text of the agreement. The subject site is located along the Interstate 55 Frontage Road south of Winding Creek Subdivision. The site is adjoining the Commonwealth Edison Right-Of--Way and is south of U. S. Route 30. The site is contiguous to the Village Boundaries and is also contiguous to the limits of the City of Joliet. The site is about 70 acres in area. The proposal includes 84 single family lots, 30 duplex units and 90 Townhouse units. The Preliminary Plat is being reviewed, but has not yet been presented to the Board. Variances included in the project requested through the PUD are Minimum lot size of 10,000 square feet, setback parameters are generally consistent with the • PLAINFIELD VILLAGE BOARD OF TRUSTEES AUGUST 4, 1997 PAGE TWO codes with the exceptions of 20 foot exterior side yazd and the 40 feet side to back of building. The developer agrees to pay the $1,750 impact fee per acre and the agreement is written to exclude the park area to be donated. They have amended the annexation agreement to seek a six month prior notice far increase in building permit fees. The Plan Review has also been revised to not reflect any deviation from Village Ordinance or policies. Subject site is requesting a two location project identification sign. One of the more important aspects or results of the Planning Commission's Public Hearing was a discussion regarding the extension of Winding Creek Drive into the project site. The result of that Public Hearing was the agreement of construction of a 10 to 12 foot emergency access road, with access controls only for emergency vehicles, will be a component of the first phase of development; a 28 foot road surface will be constructed in future, however, this cannot occur until the development is substantially complete; the road will not be extended until a traffic signal is installed on Rt. 30, understood to be planned far the frontage road intersection; the road will not be extended until the road surface of the frontage road is improved. The developer will pay cash in lieu of a school site and will provide a park site and/or cash to the park district. Comments from ublic: Keith Gillian, 23063 Judith Drive had concerns with regard to stagnant water in the retention ponds. Kathy Gillian also requested information about berms on the northside of the Commonwealth Edison lines. Dave Fazaghen, 16436 Winding Creek Road, Robert Moore, 16462 Winding Creek Rd., Tom Naumann, 16504 Winding Creek Rd., Gary Millard, 16513 Winding Creek Rd., Peggy Pfaltzgraff, 16639 Winding Creek Rd., had questions regarding the extension of Winding Creek Drive south into Arbor Creek and addressed concerns of a majority of Winding Creek residents. They thought that the baazd would only consider making the stub a through street once a traffic signal was installed, the access frontage road was paved and Arbor Creek was fully built. Their main concerns were a substantial increase in traffic through their subdivision. After hearing the above comments Trustee Stalzer favored opezung the street far vehicular traffic. The village policy is to have connecting streets between subdivision. He strongly suggested that every stub street in the village should have a sign that states it would be connected to a developing area in the future. Director Waldock explained to the public that it is our desire to make the above referenced Annexation Agreement consistent with the Planning Commission discussion in every way passible. J. J. Dement moved that we approve the Agenda with an amendment to add a Discussion on the Annexation Agreement for Arbor Creek as Item #2A. Seconded by S. Rathbun. Vote by roll call. DISCUSSION -ARBOR CREEK ANNEXATION AGREEMENT. Director Waldock told the Board that the Annexation Agreement is consistent with discussions that Staff has had with the applicants attorney. There is nothing in the update that changes the items of discussion that we talked about at the Planning Commission level. The changes were all summarized in the Public Hearing this evening. Trustees had questions about the park azea, the bicycle path; entrance signs, building fee payments and whether or not the $1,750 per acre impact fee was in line with other communities. Attorney John Phrllipchuck, representing the developer, Beechen and Dill Builders, Inc. was present and joined in the discussions. K. Stalzer moved to table this discussion to the Planning and Development Committee Meeting to be held on August 13, 1997 at 5 p.m. for them to review the agreement in more detail. Seconded by J. Motion carried. #3 DISCUSSION - BERNARDI WILL COUNTY SPECIAL USE PERMIT to consider a motion to forward a letter of no objection to Will County regarding Special Use Permit to operate a retail showroom at 12407 South Rhea Drive (Walf Creek Industrial Park) until his current lease expires on 9/30/99. S. Rathbun moved to forwazd a letter of no objection to Will County regarding Special Use Permit at 12407 South Rhea Drive. Seconded by J. Dement. Motion carried. • PLAINFIELD VILLAGE BOARD OF TRUSTEES AUGUST 4, 1997 PAGE FOUR #4 DISCUSSION -LIQUOR LICENSE FOR GOURMET JUNCTION, to direct the Attorney to amend Class G Liquor License to read "There shall be no more than one (1) Class G license issued at any one time". J. Darnell questioned the Board if this enables Gourmet Junction to purchase liquor at the retail level. Administrator Burghard stated that if that is the pleasure of the Board it can be included in the Ordinance. It was suggested to make the Ordinance correspond to the state statutes. S. Rathbun moved to approve the addition of one (1) Class "G" License issued to Gourmet Junction. Seconded by J. Dement. ADMINISTRATOR' S REPORT Administrator Burghard stated that State Sen. Ed Peka reported a Village request for an interim school zone designation and stop signs at Route 30 and 135th Street has been rejected by the Illinois Department of Transportation. Nearby residents want to slow traffic near Walker's Grove Elementary School, The Village has authorized engineering plans for traffic signals. • ENGINEER' S REPORT No report at this time. PLANNER' S REPORT Director Waldock presented to the Board a Crossing Agreement between LAKEHEAD PIPE LINE COMPANY, LIlVIITED PARTNERSHIP and the VILLAGE OF PLAINFIELD. The Agreement allows road construction to proceed across the Lakehead Pipe Line Company's easement an Heritage Meadows Drive in Pasquinelli's Eagle Pointe Subdivision. The Board had questions as to liability on the part of the Village. Attorney Harvey had no concerns with regard to indemnification on the Crossing Agreement. J. Dement moved that we approve the execution of the Grassing Agreement when our administrator is satisfied and the language has been reviewed by our attorney. Seconded by J. Darnell. PLAINFIELD VILLAGE BOARD OF TRUSTEES AUGUST 4, 1997 PAGE FIVE Director Waldock presented a letter from J. Boada Associates with regard to a request of issuance of a grading permit prior to the approval of the Final Plat which is being processed with the Planning Commission. They have submitted a $20,000 restoration bond. The Board agreed to their request. Director Waldock spoke regarding a Public Hearing process in the Village of Bolingbrook to consider rezoning from Will County A-1 Agricultural to the Village of Bolingbrook R-3 Single Family Residential and a Special Use Permit for a Planned Maixed Use Development. Project Number 416.97 for the Village of Bolingbrook. The hearing was scheduled to be held an August 6, 1997 and has Haw been postponed to August 20, at the Planning Commission level. The Special Use Permit is for the purpose of gravel Honing, including blasting. This is not consistent with, the Village of Plainfield's Land Use Plan for that side of the highway, and for adjoining property. Our residents have expressed serious concerns about this issue. K. Stalzer moved to appear at the Public Hearing scheduled on August 20th before the Planning Commission, and object to the mining based on previous Boundary Agreements made with Bolingbrook.
