1 The Common Council of the City of Richmond, Indiana, serving as a Board in charge of the operations of the
2 Richmond Power & Light Plant met in regular session at 7 p.m. Monday, September 7, 1993, in the Municipal
3 Building in said City. Vice Chairperson Elstro presided with the following Councilmembers in attendance: Lundy,
4 Donat, McBride, Parker,Allen, Dickman and Hutton. Absent was Chairperson Brookbank.The following business
5 was had to-wit:

7 APPROVAL OF MINUTES OF AUGUST 16.1993

9 Councilmember McBride moved to approve the minutes of the previous meeting as prepared, seconded by
10 Councilmember Hutton and on unanimous voice vote the motion was carried.

14 Upon recommendation of the Finance Committee, Councilmember Allen moved to approve the following bills for

9 STREET LIGHT COMMITTEE REPORT

11 Councilmember McBride had no report but reminded those wanting street lights that they have to have a petition
12 on file.

14 REPORT BY GENERAL MANAGER

16 Stating that General Manager Irving Huffman was in Atlanta,Ga.at the EPRI meeting, Herschel Philpot, RP& L's
17 financial manager, noted that he had given all Councilmembers copies of the Indiana Municipal Electric
18 Association newsletter and reminded them of the upcoming meetings September 28 through 30 at the Quality Inn.

22 City Attorney Thomas Milligan said he had distributed copies of the summary of the present status of the litigation
23 involving the City of Richmond doing business as RP&L. In highlighting the facts of the case, he said the
24 Department of Justice did file suit August 23, 1993 and it wasn't until Friday,Aug.27,that the U.S.Clerk's office
25 contacted Tony Sullivan of Barnes&Thornburg and advised him that it had been filed.Then,Sullivan sent a copy
26 by fax to Attorney Jim Puckett and Huffman. He said the firm of Barnes&Thornburg had entered an appearance
27 for the City doing business as RP&L and the City is now in the position of responding to interrogatories that were
28 submitted with the complaint.The first two pages, he said, summarize that federal lawsuit as well as some
29 progress that has been made on the new particulate rule. He said as far as the lawsuit that was filed recently by
30 RP& L against the Indiana Department of Environmental Management,that is in the process of discovery as well,
31 and that lawsuit seeks to set aside the rule as being invalid and erroneous in its original promulgation in 1980.A
32 copy of the complaint naming the City as defendant, he said, is attached. He said it is important to note that
33 Puckett explains in this account that there was no contact between the Department of Justice,the EPA and the
34 City after the August 11 meeting. Milligan said the City representatives left with the understanding that the
35 Department of Justice would be in contact with them after reviewing the information submitted at that meeting.
36 There was no contact and the next thing they were advised of on August 27 was that the lawsuit had been filed on
37 August 23,twelve days after the August 11 meeting.Vice Chairperson Elstro asked if.the Board members had
38 any questions and there were none.
