PUBLIC HEARING — A ZONE VARIANCE TO ALLOW A 1,144 SQUARE FOOT ADDITION TO AN EXISTING SINGLE FAMILY RESIDENCE DEVIATING FROM THE REQUIRED SIDE YARD SETBACK OF 6'-6" TO ESTABLISH A LESSER SIDE YARD OF 5-4". THE SUBJECT SITE IS ZONED (R-1) SINGLE FAMILY RESIDENTIAL AND IS DESIGNATED LOW DENSITY RESIDENTIAL BY THE GENERAL PLAN. Acting—Chairman Cordes opened the public hearing. Jackie Fona, applicant, briefed the Planning Commission regarding the reasons why the proposed request should be supported. Mary Kokavko, resident, spoke in opposition of the proposed request. Lunasena Dina, resident, did not have objections to the proposed request. Acting—Chairman Cordes closed the public hearing. Commissioner O'Leary made a motion to deny Zone Variance 13-1827 and find the project categorically exempt, seconded by Commissioner Curran and unanimously carried. B. PUBLIC HEARING — THE PLANNING COMMISSION WILL CONSIDER AND MAKE A RECOMMENDATION TO THE CITY COUNCIL TO CONSIDER AN UPDATE TO THE HOUSING ELEMENT OF THE CITY'S GENERAL PLAN. PROJECT SITE: C.n"turb]: RECOMMENDATION: 1) HEAR STAFF REPORT Planning Commission Minutes April 9, 2013 Page 3 2) HEAR THOSE FOR AND AGAINST 3) RECOMMEND THAT THE CITY COUNCIL APPROVE THE HOUSING ELEMENT Community Development Director Persico reported that in December 2012, the California Department of Housing And Community Development had verbally approved the proposed Housing Element. Community Development Project Manager Deibel and Karen Warner of Karen Warner Associates were introduced to the Planning Commission as the presenters of the Housing Element. Karen Warner, consultant, and Community Development Project Manager Deibel briefed the Planning Commission about the proposed Housing Element and gave a PowerPoint presentation. Both briefed the public regarding the Housing Element process and proposed modifications to the Downtown Specific Plan and the R-3 Zone. Key programs of the proposed Housing Element include zoning code modifications to allow mixed use housing in the Downtown Specific Plan area and amendments to the R-3 zone to allow increased density at locations not abutting the R-1 zone. Other programs included in the proposed Housing element are housing for special need groups, emergency shelters, and single room occupancy in the C-3 zone as well as provisions for transitional housing. Density bonus incentives in the municipal code will be updated so as to be consistent with California State law. Regarding the Initial Study (environmental review), the city is working with AQMD and SCAG on the recommended air-quality impact mitigation measure. Completion of the Housing Element is due prior to the end of the current state -designated housing planning cycle in February 2014. Community Development Director Persico, expressed that City Manager Pulido is aggressive in applying for grants. The State of California now has tied applying for grants with a compliant housing element. Commissioner Curran, observed the resolution recommending approval to the City Council includes the adoption of a General Plan amendment to significantly change the Housing Element. Though there have been slight amendments to the Housing Element document since September there are specific properties involved. The draft Housing Element document was not presented in the staff report, therefore he felt concern that city residents have not been properly educated regarding the proposed Housing Element. He asked if the Housing Element was online as of March 26, 2013. (Staff confirmed that the document has been posted on the City's website since then.) He also expressed concern regarding the public's knowledge regarding the possibility of units being converted into low income housing and retirement homes along the easterly side of the city near Las Tunas Drive. He indicated that Sunnyslope Water Company who provides one third of the water supply service to the city, cannot support substantial development growth. Planning Commission Minutes April 9, 2013 Page 4 Community Development Director Persico, assured Commission Curran that the city has gone above and beyond required measures to educate the public regarding the Housing Element. Community Development Project Manager Deibel, explained that certain policies are mandated by the State of California so that specific housing types, such as affordable housing, would not be precluded by local regulations. The document points to how housing needs in the community could be accommodated, however development at increased density is not guaranteed, as this depends on the market demand for such housing to be developed. In response to Commissioner Curran's concern about water availability, reference was made to the environmental study discussion of water availability for new development and that the city requires a proposed development to document that it has a sufficient source of domestic water supply in order to be approved. Appendix D (pages D-20,21) in the Housing Element gives an overview of utility service availability in the community. The utility requirements for all development projects will be addressed as projects come through the City's review and approval process. Acting -Chairman Cordes, inquired about elimination of the Conditional Use Permit requirements and high density developments. Community Development Project Manager Deibel, addressed that the California Department of Housing and community Development precluded having a public hearing component to the higher density housing approval process so that affordable housing could be facilitated. The state has certain criteria as to what qualifies as affordable housing. An affordable housing developer can come to the counter and request an inventory of sites that would allow for affordable housing without a public hearing. These are steps necessary to achieve an inventory of sites that meets the regional housing needs allocation in all of the affordable housing categories. Community Development Director Persico, further addressed that the state of California is prohibiting the use of conditional use permits for affordable housing in all cities. The goal of the California Department of Housing and Community Development is to let the market dictate housing requirements. The public hearing process adds to the cost of the final product of a housing development. The other component is the land value per unit is lower if the housing density is higher. While there are income requirements for affordable housing, the state does not ask for the price point for the unit. The state presumes that if a project is built at a certain density, it is becomes more affordable by default. Acting—Chairman Cordes opened the public hearing Jim Clift, resident, shared concerns with Commissioner Curran regarding water service supply. He spoke in opposition of not requiring a public hearing Planning Commission Minutes April 9, 2013 Page 5 for increased housing density. He asked Community Development Director Persico how the City of San Marino handles the housing element. Director of Community Development Persico stated that several cities, including the City of San Marino have made no attempt to comply with housing laws. The City of San Marino has now made effort to comply with housing laws. Mary kokavko, resident, spoke in opposition of intensifying housing density and is opposed to affordable housing. Acting—Chairman Cordes closed the public hearing. Commissioner O'Leary made a motion to recommend that the City Council adopt the update to the Housing Element and to approve the Mitigated Negative Declaration, seconded by Acting -Chairman Cordes and carried by the following roll call vote. UPDATE FROM COMMUNITY DEVELOPMENT DIRECTOR made the following announcements: the next Planning Commission Meeting of April 23, 2013 will be cancelled due to no scheduled items and a report on the downtown parking study will be ready for Planning Commission review on May 14, 2013. Asked the Planning Commission for the following items: participation by two commissioners in a Planning Commission Bylaws meeting and if there are reports created by staff that could be improved.
