HomeMy Public PortalAboutResolution No. 24-013 - Resolution authorizing a sole source contract with Hydra Service Inc for the purchase of two submersible replacement pumps for pump station no. 14Sponsored by: Interim City Manager RESOLUTION NO. 24-013 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA, AUTHORIZING THE INTERIM CITY MANAGER TO ENTER INTO A SOLE SOURCE CONTRACT WITH HYDRA SERVICE, INC., IN AN AMOUNT NOT TO EXCEED FORTY-ONE THOUSAND, TWELVE DOLLARS ($41,012.00), FOR THE DIRECT PURCHASE OF TWO SUBMERSIBLE REPLACEMENT PUMPS FOR PUMP STATION NO. 14., WITHIN THE CITY; PROVIDING FOR INCORPORATION OF RECITALS; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, two new pumps are required for Pump Station #14 within the City of Opa-Locka ("City") and the Interim City Manager recommends the purchase of two ABS pumps from Hydra Service, Inc. in the amount of Forty -One Thousand, Twelve Dollars ($41,012.00); and WHEREAS, Pump Station #14 was designed for ABS pumps; and WHEREAS, two pumps were installed in 2012 and their expectancy was ten (10) years has expired with one pump having failed and the other routinely overheating; and WHEREAS, Pump Station #14 is operating with a lower horsepower backup pump to avoid the Pump Station being placed in moratorium due to insufficient capacity; and WHEREAS, to ensure the availability of reliable sufficient capacity, two new pumps must be procured; and WHEREAS, because the Pump Station was designed for ABS pumps only, the new pumps must be from the same manufacturer to avoid costly pump station modifications; and WHEREAS, Hydra Service, Inc. is the only authorized ABS pump dealer in the State, necessitating these pumps be procured through this vendor as a sole source; and WHEREAS, Hydra Service, Inc., located in Debary, Florida, is a sole source distributor contracted for Selzer wastewater (formerly ABS) products, which territory includes the entire State of Florida; and WHEREAS, the price for these two pumps is Forty One Thousand, Twelve Dollars (S41,012.00); and Resolution No. 24-013 WHEREAS, the Interim City Manager recommends the purchase of two XFP150G- CB1.8PE185/43PH 230V 17BORPM 40' cable submersible pumps from Hydra Service, Inc. for Forty- One Thousand, Twelve Dollars ($41,012.00); and WHEREAS, Pursuant to Section 2-318(1)(b) and 2-318(1)(c) of the City's Purchasing Ordinance 20-07, "b. A contract may be awarded without competition when the city manager makes a written determination, after conducting a good faith review of available sources, that there is only one (1) source for the required supplies or contractual service. The city manager shall conduct negotiations as appropriate to price, delivery and terms. A record of sole source procurement shall be maintained as a public record and shall list each contractor's name, amount and type of each contract, and the identification number of each contract file; c. All sole source procurements, where the cost of the supplies or contractual services exceeds twenty- five thousand dollars ($25, 000. 00), shall be authorized by the city commission"; and WHEREAS, the City Commission finds that it is in the best interest of the City and its residents to purchase two Submersible Replacement Pumps for Pump Station No. 14. within the City from sole source supplier Hydra Service, Inc. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF OPA LOCKA, FLORIDA: Section 1. RECITALS ADOPTED. The recitals to the preamble herein are incorporated by reference. Section 2. AUTHORIZATION The City Commission of the City of Opa-Locka, hereby authorizes the Interim City Manager to enter into a sole source contract with Hydra Service, Inc., in an amount not to exceed Forty -One Thousand, Twelve Dollars ($41,012.00), for the direct purchase of two Submersible Replacement Pumps for Pump Station No. 14, within the City and in a form approved by the City Attorney. SECTION 3. SCRIVENER'S ERRORS. Sections of this Resolution may be renumbered or re -lettered and corrections of typographical errors which do not affect the intent may be authorized by the City Manager following review by the City Attorney and without need of public hearing, by filing a corrected copy of same with the City Clerk. Section 4. EFFECTIVE DATE. However, on the agenda for this meeting there is a separate project for $25,000 for an odor control system, leaving $106,351 available for these pumps.
