S'8'�Fee �Csa Lilly Mae Noortander .C;*522 a.e. 2 oezeeb•r1/4 Recorder of Grand Camay AN ORDINANCE VACATING A CERTAIN PART OF WINGATE AVE. IN JOHNSON SUBDIVISION IN SECTION 36, T25S, R21E, S.L.B.&M. The City of Moab hereby vacates the following part of Wingate Avenue in the Johnson Subdivision in Moab, Grand County, State of Utah, in favor of the adjoining land owners: Beginning at at point on the West line of Johnson Subdivision (East Right -of -Way of 500 West St.) which bears North 349.3 ft. and East 52.8 ft. from the S.W. Corner of Section 36, T25S, R21E, S.L.B.&M. and proceeding thence 41.07 ft. with a 229°11' curve to the left, the chord of which bears S 46°31'15" E 36.60 ft., thence with the South line of Lots 2 & 3 of Johnson Subdivision N86°25' E 164.62 ft., thence 52.45 ft. with 114°35'30" curve to the left, the chord of which bears S 7°05'58" E 50.08 ft., thence with the North line of Lots 5, 6, & 7 of Johnson Subdivision S 86°25' W 174.93 ft. thence 37.47 ft. with a 229°11' curve to the left, the chord of which bears S 43°28'45" W 34.06 ft. to the West line of Johnson Subdivision, thence with said West line N 0°32'30" E 100.27 ft. to the point of beginning and containing 0.23 acre, more or less. Bearings are based on the West line of the S.W. 4 of Section 36 (N 0°32'30" E). A twenty (20.0) ft. wide easement over the existing sewer main and a twenty (20.0) ft. wide easement over the existing water main and ten (10.0) ft. wide storm drain easement are reserved to Moab City, said easements extending the entire length of the above described abandonment, Moab City reserves the right to construct and maintain both water and sewer service lines to existing mains from all lots adjoining the Wingate Ave. abandonment. This vacation of a portion of the street shall in no wise impair the franchise rights of any public utility nor extinguish any existing municipal utility rights evidenced by or in place within the portion of the street so vacated. The City Clerk is directed to record a copy of this Ordinance in the Office of the Recorder, County of Grand, State of Utah, and to cause the same to be indexed in the name of the City of Moab, Grantor, and adjoining land owners, Grantee. This Ordinance shall take effect and be enforced from and after its passage and publication according to law.
