RECOMMENDATION:
That the Commission:
1. Establish funding priorities for major capacity -enhancing projects including
the reconstruction of the 60/91/215 interchange, selected 1-10 interchanges
in the Coachella Valley, improvements at Green River near Route 91, and the
widening of Route 60 between Valley Way and 1-15. The priorities should be
placed in two tiers with the 60/91/215 interchange being designated as the
paramount priority;
2. Direct staff to work closely with the California Transportation Commission
and the California Department of Transportation to ensure maximum funding
capability and flexibility in paying for the Commission's top priority project;
3. Direct staff to consider the use of federal funding programs such as the
Surface Transportation Program (STP) and Congestion Mitigation and Air
Quality (CMAQ) program to backfill state funding that might be lost and
return to the Commission for approval of any funding shifts;
4. Suspend discretionary STIP calls for projects that are tentatively scheduled
for 2004, 2006 and 2008; and,
5. The STIP Ad Hoc Committee and staff provide monthly reports on the status
of the State funding crisis.

BACKGROUND INFORMATION:
Transportation agencies throughout the State currently face one of the most vexing
challenges ever posed by California's economic uncertainty. Obviously, the State's
situation is bleak; due to lower tax receipts, combined with higher levels of
spending California faces a significant budget crisis. Estimates of the State's
budget debt have been between $24 and $35 billion. To further complicate
matters, the California Transportation Commission has announced that its estimate
of available funding in the five-year State Transportation Improvement Program
(STIP) will fall $4 billion short of its previous projections over the next 4.5 years.
Instead of reaping an anticipated 4 percent annual growth in STIP revenues, the
stark reality is that STIP revenue has actually declined. In fact, the CTC is
currently forecasting that only $200 million will be available statewide during the
next six months with a total of $1.8 billion by the end of FY 2003-04. Once
needed maintenance and other statutory commitments are made, very little STIP
money will be left to fund new projects during the next 18 months. (See
Attachment A)
The challenging component of the crisis is that critical decisions have yet to be
made by the Legislature or the California Transportation Commission. To this date,
the amount of severity of the budget crisis is still in dispute and there are serious
disagreements in some parts of the State regarding what the state's transportation
direction should take in the coming months.
Obviously, significant cuts will be necessary on the state level and at the local
level. While Riverside County is in better shape than many counties given the
electorate's approval of the Measure "A" extension, a number of our projects will
face potential funding shortfalls and could be delayed or unfunded. The problem is
that without more information and with important decisions yet to be made by
many key players, how can the Commission best craft a comprehensive strategy?
STAFF RECOMMENDATIONS:
1. Establish Top Priorities — Tier 1 (60/91/215 Interchange) and Tier 2
The first recommendation is for the Commission to establish a handful of
projects as absolute priorities. These projects must be so important to the
Commission that every effort is made to fund them regardless of the funding
environment. These are projects that provide added transportation capacity,
are consistent with voter direction and are ready to be built now or in the
very near future.

In staff's view, the top priority list should be split in two tiers. Only one
project qualifies as a Tier 1 priority above all others and that would be the
reconstruction of the 60/91/215 interchange in Riverside. From the
beginning, this has been the cornerstone project of the Measure "A"
program. Given its impact on the entire county's transportation network,
this project must be completed as soon as possible. The good news is that
it is ready for construction and it has a unique status as a design -sequencing
project that is garnering significant attention from the Governor's office.
Some preliminary construction has already begun just south of the main
interchange in Downtown Riverside. More extensive construction is set for
later this year and the entire project could be completed by 2007.
While the 60/91/215 interchange should remain as the paramount priority for
the Commission, staff recognizes that a number of major projects are also
extremely important in many regions of the county and should receive major
attention for funding. This includes 1-10 interchanges in the Coachella
Valley, widening of Route 60 between Valley Way and 1-15, improvements
at Green River Road and Route 91, connections between Route 71 and 91
and the widening of Route 91 from Mary Street to the 60/91/215
interchange in Downtown Riverside. Ideally, these projects will remain on
track and every effort should be made to shift available forms of funding to
pay for these projects. In doing so, staff recommends retaining the current
formula split between Western Riverside County, the Coachella Valley and
Palo Verde Valley to ensure geographic balance and equity.
2. Maintain Flexibility
Establishing these projects as Tier 1 and Tier 2 priorities will provide a clear
direction of what must be funded first, but it will only be accomplished by
creating flexibility for the Commission to move funding sources around to
ensure project delivery. The Commission receives funding from a variety of
sources that include federal, state and local dollars. While funding sources
have been identified for most projects, the changes in the state budget might
require moving funds around. There is also the possibility that a number of
projects could be funded within the next few months before more significant
cuts are sought in intervening years. The problem is that the information
seems to change on a daily basis. The Commission should defer any
permanent decisions on project status outside of the priority projects until
clear direction is formulated by the CTC and the Legislature. (See
Attachment B)

RCTC has 25 local STIP projects that are not on the State highway system
and are valued at approximately $42 million. These projects were selected
through our internal discretionary STIP project selection process. While
many of these projects are especially important to local communities, they
are looked on as a lesser priority by Caltrans and the California
Transportation Commission, especially in the financially constrained
environment that we currently face. This forces RCTC to consider alternative
sources of dollars to pay for them. (See Attachment C)
3. Use of Federal Funds
A possible approach would be to fund these off -system projects with federal
discretionary formula funding. The sources of these dollars are the federal
Surface Transportation Program (STP) and the federal Congestion Mitigation
& Air Quality Program (CMAQ). The funding for these programs will be
renewed by Congress as part of the reauthorization of the federal
transportation bill later this year. The first year of funding from the
reauthorization could be Fiscal Year 2003-04, but federal funding could be
impacted by other pressures from military action.
The second component of this approach will involve Caltrans and California
Transportation Commission cooperation to realign our STIP funding capacity
to support our prominent Measure A projects. We also expect to garner
additional funding through projects savings and by withdrawing the non -
system projects from the STIP program.
4. Suspend Discretionary STIP Calls for Projects
Finally, RCTC should consider suspending its 2004, 2006 and 2008
discretionary STIP funding calls for projects. This would mean that we would
distribute STIP dollars solely on a formula basis to the Coachella Valley and
Western regions of the county without having a competitive discretionary
process for the near future.
All of the actions that are part of this approach are designed to keep existing
projects on schedule. With so many projects so close to construction, we
should only consider letting delivery schedules slip if we fail to accrue
adequate funding. This approach should ensure the funding we need to keep
going.

5. Provide Reports on Status of the State Funding Crisis
The success of this approach will require ongoing communication between
staff and the STIP Ad Hoc Committee and the Commission as a whole. The
STIP and State budget problems will continue well into next fiscal year and
probably into the following year as well. When actions are necessary by the
Commission, staff will call meetings of the Ad Hoc Committee when
direction is necessary and staff will bring action items to the Commission as
quickly as possible.

Guiding Principles:•
Provide economic stimulus.
• Provide funding for projects ready to break ground.
• Provide needed match for Federal and local funds.
Maintain existing STIP/SHOPP programming and allocation process.
Act in accordance with statutory priorities (Streets and Highways Code Section 1.67).
Work with Caltrans and regional agencies to identify project priorities.
Maintain equity in process.
feral Allocation Plan Priorities:
Limit the initial Allocation Plan to STIP and SHOPP projects programmed for
FY 2002-03 and projects with extensions to FY 2002-03. Limit the Allocation Plan to
projects that Caltrans and regions confine can be delivered within that period. Exclude
projects dependent on unallocated TCR Program funds.
Give first priority to the following categories, as programmed:
o Federal TEA program projects (100% Federal TEA funds only).
o SHOPP projects (Department -identified SHOP? project criteria to be
and approved by the Commission).
o Required STIP mitigation projects for construction projects already allocated.
Then give priority to any included STIP project (i.e., project programmed in 2002-03)
at significant risk of losing other funding if not allocated within the fiscal year.
Then give priority to STIP projects according to project type: first to capacity
increasing projects; then to planning, programming, and monitoring; then to non -
capacity projects, including local road and transit rehabilitation.
Within each project type (i.e., capacity and non -capacity), allocate first to projects for
construction (including equipment acquisition or rehabilitation), then to other
components for projects with construction programmed in a later fiscal year, then to
projects with no construction component programmed.
Within each category above, consider the following for individual projects on a case -
by -case basis, as necessary:
o Regional and Caltrans priority.
o Season -sensitivity of project (if not voted no «v, project misses the construction
season).
Allocations to projects requiring PTA funds or State only funding are subject to a
determination that sufficient funds of the appropriate type are available.
The Commission will regard project components brought for a vote as meeting STIP
timely use of funds deadlines, even if an allocation vote is not possible for lack of
funds. The Commission will consider time extensions on a case -by -case basis only.

STAFF RECOMMENDATION:
That the Commission receive and file the report on financing options.
BACKGROUND INFORMATION:
Listed below are financing options that are available. Staff will review each of the
options at the meeting.
Tax -Exempt Commercial Paper: Overview
• Tax-exempt commercial paper ("TECP") is a short-term promissory note
backed for liquidity purposes by a dedicated source of immediately available
funds.
• TECP program constitutes a continuous offering or re -issuance of debt, with
same -day settlement of funds.
• TECP is usually structured with a maximum maturity of 270 days, but is
generally sold in the 30 to 90 day maturity range.
• Maturing TECP is "rolled -over" or replaced by a new issue of TECP at
prevailing interest rates.
• The process is repeated until the TECP program is either refunded with
permanent long-term financing or paid off from other sources.
• Fees associated with starting the program could range from $150,000 to
$250,000. Ongoing costs could range from $25,000 to $60,000.
• Current rates are around 1.50% - 2.00%. Over the last 10 years the
average rate has been 3.50%.

Capital Appreciation Bonds (CAB's): Overview
• CAB's are fixed rate bonds that accrue and pay interest at maturity. They
will accrue and compound interest due semi-annually.
• CAB's offer the ability to generate cash proceeds today and not have to
make any interest or principal payments until the New Measure A
commences sales tax revenues in 2009.
• CAB's typically carry a yield premium as the investor will not receive any
cash flow on their investment until maturity.
• The yield difference between current interest bonds and CABs typically
ranges 15 to 50 basis points.
• Fees are dependent upon the size of the Bond, however, are typically around
1% of the issue.
• Current CAB rates are at 5.0%.
