Chairman Simmons called the meeting to order at 7:30 p.m. Roll call
was taken.
There being no .additions or corrections, Chairman Simmons declared the
minutes of the April 17, 1990 meeting approved as presented.
Chairman Simmons introduced Ms. Dee Norris as the new Plan Commission
and Zoning Board of Appeals Board .member. Ms. Norris is replacing
Mr. James Anderson.
Mr. Waldock introduced Mr. Bob Zimmerman as a new Ex-Officio member
to the Plan Commission.
Ms. Norris and Mr. Zimmerman were appointed at the Village Board
meeting on May 7, 1990.
Case No. 265-41790V - Dale Ballinger
Requesting a variance from the Village zoning regulations to allow
a 6 ft. high screening fence along the exterior side property line
where a 30 foot setback is required. Location: 405 Joseph Street.
Mr. Waldock reported the request is for the installation of a 6 foot
high screening fence to be located along the exterior property line
of a corner lot located at the northwest corner of Route 59 and
Joseph Street. The site is required by ordinance to maintain 30 ft.
setbacks for 6 ft. high fences from the front and the exterior side.
In this case, along Route 59 there is impact noise and the general
activity of Route 59 within close proximity to the house.
Houses to the north of the subject site already have 6 ft. high
screening fences. Mr. Ballinger's fence would be compatible with those
fences and would indeed actually become adjacent and virtually connect
to the adjacent fence to the north. The fence style is a stockade
design and is intended to provide screening as well as noise insulation
for the rear yard area.
It is the finding of staff that hardship in this case relates to the
visual and audible impact of Route 59 on the subject site; the fence
as proposed is compatible with adjoining properties to the north; no
negative impacts are expected as a result of the proposed fence.
Therefore, staff's recommendation is for approval of the variance for
Dale Ballinger at 405 Joseph St. to allow a 6 ft. fence within one
foot from the east property line along Route 59.

The Police Department has examined the area for traffic safety and
has determined that there is no negative impact for visual sight lines.
Chairman Simmons asked how close the fence would be to the new
right-of-way in the future when Route 59 is widened.
Mr. Waldock explained at this point we are not anticipating that
IDOT will require additional right-of-way to this side. There is
vacant land to the east, and if additional right-of-way is required, the
Village would recommend to IDOT that they seek that additional
right-of-way on the east side of the road.
No comments or objections have been received from adjacent landowners.
M. Krippel moved to recommend to the Village Board to approve the
variance for 405 Joseph Street to allow a 6 ft. fence within one foot
from the east property line along Route 59. Seconded by J. Sobkoviak.
Vote by roll call.
Schempf, yes; Sobkoviak, yes; Krippel, yes; Bayer, yes; Mentzer, yes;
Norris, yes; Simmons, yes. 7 yes, 0 no. Motion carried.
