HomeMy Public PortalAboutResolution No. 24-020- Resolution approving the Special Exception Request for the construction of a twin home building in the single-family residential zoning district (R-1) at the corner of NW 17 Avenue and Opa-locka BLVSponsored by: Interim City Manager RESOLUTION NO. 24-020 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA, APPROVING THE SPECIAL EXCEPTION REQUEST FOR THE CONSTRUCTION OF A TWIN HOME BUILDING IN THE SINGLE-FAMILY RESIDENTIAL ZONING DISTRICT (R-1), ON THE PROPERTY LOCATED AT THE CORNER OF NW 17TH AVENUE AND OPA- LOCKA BOULEVARD AND IDENTIFIED BY FOLIOS 08-2122-018-0200; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Applicant, DMG Investment Trust, LLC desires to construct a two -unit twin home building that will provide two three -bedroom units and appropriate parking spaces and landscaping on the single-family zoned parcel identified by folio 08- 2122-018-0200; and WHEREAS, in accordance with the City of Opa-Locka's Land Development Regulations ("City LDR"), Ordinance 15-31, Section 22-79 requires special exception review approval to permit the construction of a twin home on property zoned single- family; and WHEREAS, the Applicant, has submitted a request for special exception review and provided documentation to meet the approval criteria as required by City LDR Section 22-60(B) to construct a two -unit twin home building in the Single -Family Residential Zoning District (R-1); and WHEREAS, Planning & Community Development staff for the City of Opa-Locka has reviewed the application of DMG Investment Trust, LLC and has determined that the applicant has provided all information required by Section 22-55(I) of the City of Opa- Locka's Land Development Code for proper consideration by the City Commission; and WHEREAS, the Planning and Zoning Board reviewed this request at a public hearing on December 12, 2023 and recommended approval of this request for special exception review by a 5 —0 vote as the site plan is provided herein as Exhibit "A". WHEREAS, the City Commission of the City of Opa-Locka finds that it is in the best interest of the City and its residents to approve the special exception request as provided herein. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA, AS FOLLOWS: Resolution No. 24-020 SECTION 1. RECITALS. The above recitals are true and correct and are incorporated into this Resolution by reference. SECTION 2. APPROVAL/DENIAL. Approval/ Denial of Special Exception Review. The City Commission of the City of Opa- Locka, Florida hereby approves the request for the Special Exception for the Construction of a two three -bedroom units and appropriate parking spaces and landscaping in accordance with the City of Opa-Locka's Land Development Regulations on the property located at the corner of NW 17th Avenue and Opa Locka Boulevard and identified by folio 08-2122-018-0200, in the R-1 Zoning District, as set forth in Exhibit "A" attached to herein. Section 3. SCRIVENER'S ERRORS. Sections of this Resolution may be renumbered or re -lettered and corrections of typographical errors which do not affect the intent may be authorized by the Interim City Manager following review by the City Attorney, without the need of a public hearing by filing a corrected copy of same with the City Clerk. Section 4. EFFECTIVE DATE. This Resolution shall, upon adoption, become effective as specified by the City of Opa- Locka's Code of Ordinances, Land Development Regulations and the City of Opa-Locka Charter. A maintena easement for access to the lake would need to be considered as part of the replat of property. Build two single family homes by right or build two twinhomes by Six Exception. Split the property will permit you to build four single family homes wl two [2] of each would share a common wall on each new parcel and each he complies with the required setbacks.
