A SPECIAL ORDINANCE VACATING A PUBLIC WAY
WHEREAS, J. Scott Porter, President, First Richmond Corporation has petitioned Common Council of Richmond, Indiana, requesting a portion of a public right of way commonly known as a
twenty foot (20’) wide alley spanning North and South between North B Street (formerly Mulberry Street) and North C Street (formerly Sasafras Street). A copy of a map showing the parcel
to be vacated is attached hereto as “Exhibit A”; and
WHEREAS, the abutting landowners are as follows:
Tice Soft Water Sales & Service, 221 North 8th Street, Richmond, IN 47374 (marked in orange on attached Exhibit A).
Howard F. Tice, 221 North 8th Street, Richmond, IN 47374 (marked in orange on attached Exhibit A).
Insurance Company of North America, P.O. Box 41484-TK31L, Philadelphia, PA 19103 (marked in pink on attached Exhibit A).
Insurance Company of North America, P.O. Box 41484-TL31L, Philadelphia, PA 19103 (marked in pink on attached Exhibit A).
First Richmond Corporation, 5555 National Road East, Richmond, IN 47374 (marked in yellow on attached Exhibit A).
WHEREAS, the roadway proposed to be vacated is currently developed as an alley; and
WHEREAS, Common Council, pursuant to Indiana Code 36-7-3-12, conducted a public hearing on said petition _November 21, 5005_____, 2005, after publishing legal notice thereof at least
ten (10) days in advance of said hearing as required by statute; and
WHEREAS, the Richmond Advisory Plan Commission, pursuant to Richmond Code 155.04(b), conducted a public hearing on said petition _November 16______________, 2005 after publishing legal
notice thereof at least ten (10) days in advance of said hearing as required by ordinance; and
WHEREAS, it is desirable to vacate said public way.
NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana, that subject to the preservation of easements for existing utilities, the portion of public way
described in attached Exhibit A is hereby vacated and that ownership of such land shall vest in the abutting property owners.
