RESOLUTION NO. 24-021
A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF OPA-LOCKA, FLORIDA, APPROVING THE
FINAL SITE PLAN FOR THE CONSTRUCTION OF A
TWIN HOME BUILDING ON THE PROPERTY
LOCATED AT THE CORNER OF NW 17TH AVENUE
AND OPA LOCKA BOULEVARD AND IDENTIFIED
BY FOLIO 08-2122-018-0200 IN THE R-1 ZONING
DISTRICT; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Applicant, DMG Investment Trust, LLC intends to construct a
two -unit twin home building that will provide two three -bedroom units and appropriate
parking spaces and landscaping in accordance with the City of Opa-Locka's Land
Development Regulations ("City"); and
WHEREAS, the Applicant, has submitted a request for final site plan review to
construct a two -unit twin home building that will provide two three -bedroom units in
the Single -Family Residential Zoning District (R-1); and
WHEREAS, Planning & Community Development staff for the City of Opa-Locka
has reviewed the application of DMG Investment Trust, LLC and has determined that
the applicant has provided all information required by Section 22-55(I) of the City of Opa-
Locka's Land Development Code for proper consideration by the City Commission; and
WHEREAS, the Planning and Zoning Board has recommended approval of the
Special Exception site plan request as required for this use in the R-1 zoning district, and
WHEREAS, the Planning and Zoning Board reviewed this request at a public
hearing on December 12, 2023 and recommended approval of this request for final site
plan review by a 5 — 0 vote as the site plan is provided herein as Exhibit "A"; and
WHEREAS, the City Commission of the City of Opa-Locka finds that it is in the
best interest of the City and its residents to approve the special exception request as
provided herein.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF OPA-LOCKA, FLORIDA, AS FOLLOWS:
SECTION 1. RECITALS.
The above recitals are true and correct and are incorporated into this Resolution by
reference.

SECTION 2. APPROVAL,/DENIAL.
Approval/Denial of Site Plan Review. The City Commission of the City of Opa-Locka,
Florida hereby recommends approval of this request for the Final Site Plan approval for
the Construction of a two three -bedroom units and appropriate parking spaces and
landscaping in accordance with the City of Opa-Locka's Land Development Regulations
on the property located at the corner of NW 17th Avenue and Opa Locka Boulevard
and identified by folios 08-2122-018-0200 in the R-1 Zoning District as set forth in the
Site Plan detailed in Exhibit "A" attached hereto and incorporated herein.
Section 3. SCRIVENER'S ERRORS.
Sections of this Resolution may be renumbered or re -lettered and corrections of
typographical errors which do not affect the intent may be authorized by the Interim City
Manager following review by the City Attorney, without the need of a public hearing by
filing a corrected copy of same with the City Clerk.
Section 4. EFFECTIVE DATE.
This Resolution shall, upon adoption, become effective as specified by the City of Opa-
Locka's Code of Ordinances, Land Development Regulations and the City of Opa-Locka
Charter.

Staff Summary:
The applicant, DMG Investment Trust, LLC desires to construct a two -unit twin home building
that will provide two three -bedroom units and appropriate parking spaces and landscaping on
the single-family (R-1) zoned parcel identified by folio 08-2122-018-0200. In accordance with the
City of Opa-Locka's Land Development Regulations ("City LDR"), Ordinance 15-31, to permit
the construction of a twin home on property zoned single-family. The Applicant, has submitted
a request for site plan review and provided documentation to meet the approval criteria as
required by City LDR Section 22-60, B, 1-12 to construct a two unit twin home building in the
Single Family Residential Zoning District (R-1). The Planning & Community Development staff
has reviewed the application of DMG Investment Trust, LLC and has determined that the
applicant has provided all information required by Section 22-55(I) of the City of Opa-Locka's
Land Development Code for proper consideration by the Planning and Zoning Board and has
reviewed this request at a public hearing on December 12, 2023 and recommended approval of
this request for site plan review by a 5-0 vote and a copy of the site plan is provided herein as
Exhibit "A".
Financial Impact
Approval of the Twin Home Site Plan Review will not provide any negative financial impact.
Proposed Action:
Staff recommended approval of this Resolution.

1. All individuals seeking to appear before the Planning & Zoning Board must submit a complete Planning
& Zoning Board application, with the required documents and fees totaling (as established by ordinance),
paid by check or money order to the City of Opa-locka. Failure to submit all documents and fees will result
in your case not being scheduled to be heard at a meeting.
2. If the applicant seeking to appear before the Plalnling & Zoning Board is not the property owner he must
provide an affidavit of authorization from the property owner.
3. All regular meetings are held on the first Tuesday of each month at the City of Opa-locka City Commission
Chambers, Meeting Time 7:00 P.M. (tithe and location are subject to change, please check -with the Planning and
Community Development Department for exact time and location of the meetings).
4. Application package must include all required documents per checklist and fees of The City of Opa-locka.
The application will be reviewed by the Department and will be scheduled for the next P&Z meeting upon
finding of sufficiency.

Fifteen (15) certified boundary and topographic surveys of the property (two copies size 36 x 24 inches & 13 copies
11 x 17 inches). (The submitted property survey must not exceed a maximum of two (2) years from date created in order to be considered
acceptable by the City of Opa-locka)

This narrative is written to provide a general project concept, the initial project timing, and details
regarding the overall development. The proposed project is located near the southwest corner
of NW 17th Avenue and Opa-Locka Blvd in Opa-Locka, Florida.
A site plan is included at the end of this narrative.
The project is consistent with several visions of the Opa-Locka's 20/30 Comprehensive Plan and
will revitalize that corner.
The overall lot coverage is way under the required 35% at 2,252 SF or 22%.
The project consists of two 26'X42' side -by -side Modular units manufactured by a local business.
The developer takes into consideration a 15FT easement along the south limit of the property to
allow the city access to the Pine Tree Lake for regular maintenance.

Thank you for your interest in developing the property identified by folio 08-2122-018-0200. On
December 2", 2021, we discussed your options to develop this 10,575 square foot property that is
zoned for single-family development. We know you are interested in obtaining the highest and best
use for this site and after review of the City Land Development Regulations we therefore inform you
of the following options that are available to you:
1. Option 1 - Build one single family homes that complies with the required setbacks.
(Single Family Detached) Submit building permits only.
2. Option 2 - Build two single family homes that share a common wall between the two
homes [also referred to as a twin home} and each home complies with the required
setbacks. (Single Family Attached) This path requires a formal Special Exception hearing
review before the Planning & Zoning Board and formal review and approval by the City
Commission at a public hearing. A maintenance easement for access to the lake would
need to be considered as part of the siteplan of the property.
3. Option 3 — Replat your property into two lots. Each lot will be 5287.5 sf. A maintena
easement for access to the lake would need to be considered as part of the replat of
property. Build two single family homes by right or build two twinhomes by Six
Exception. Split the property will permit you to build four single family homes wl
two [2] of each would share a common wall on each new parcel and each he
complies with the required setbacks. (Single Family Attached) This path requirc
formal Special Exception hearing review before the Planning 8c Zoning Board and for
review and approval by the City Commission at a public hearing.
4. Option 4 - Rezone the site to Duplex and build two duplexes/twin homes.
rezoning request would require formal review before a Planning & Zoning Board
formal review and approval by the City Commission at a public hearing. The site
for the proposed two duplex development would also be presented for review
approval. A maintenance easement for access to the lake would need to be conside
as part of the rezoning of the property.
Option 4 may be the most challenging as the PCD Department, by policy, is required to recomm
against any zoning change request that may not meet the criteria for recommendation to change
zoning to a higher adjacent residential zoning. We can further discuss this process if it is bi
considered.

The Applicant, DMG Investment Trust, LLC. intends to construct a twin home on this single family
10,575 square foot lot. Twin homes are permitted in the Duplex (R-2 Zoning District and in the Single Family R-
1 Zoning district after Special Exception Review approval. They also intend to provide appropriate parking and
landscaping in accordance with the City of Opa-locka's Land Development Regulations.
The applicant has submitted two application requests for the development of this site:
1. To review for special exception an opportunity to build a twin home on this site.
2. To review and consider for approval the site plan to build a twin home on this site.
To accommodate the new intended uses for this vacant residential site will require the review and
