CALL TO ORDER AGENDA ITEM 7.A-3 Mayor Sternquist called the City Council Regular Meeting to order at 7:30 p.m. in the Council Chambers located at 5938 Kauffman Avenue, Temple City. 2. ROLL CALL PRESENT: Councilmember - Chavez, Vizcarra, Yu, Blum, Sternquist ABSENT: Councilmember - None ALSO PRESENT: City Manager Pulido, City Attorney Murphy, City Clerk Kuo, Administrative Services Director Hause and Community Development Director Persico 3. INVOCATION Pastor Frank Wang from Bethlehem Lutheran Church provided the Invocation. 4. PLEDGE OF ALLEGIANCE Mayor Sternquist led those present in the Pledge of Allegiance to the Flag. 5. CEREMONIAL MATTERS AND PRESENTATION A. Certificate of Recognition - 2013 Librarian of the Year City Council presented a certificate of recognition to the Los Angeles County, 2013 Librarian of the Year, Catherine Seneris. B. Older American Month Proclamation City Council proclaimed the month of May as Older American Month and presented a proclamation to Betty Strobehn, Temple City's 2013 Outstanding Older American of the Year. C. Parks and Recreation Super STARS Dance/Drill Team City Council Minutes May 7, 2013 Page 2 The City's Parks and Recreation Super STARS Dance/Drill Team performed their State Championship Routine for the City Council. D. Building Safety Month Proclamation City Council proclaimed the month of May as Building Safety Month and presented a proclamation to Mark Persico, Temple City Community Development Director. E. Sheriff's Monthly Report Deputy Alvarez gave City Council an update regarding the Sheriff's activities for the month of April. F. Alameda Corridor East (ACE) Construction Authority Mark Christoffels, Deputy Chief Executive Officer/Chief Engineer of the Alameda Corridor -East Construction Authority, provided City Council an update regarding upcoming construction on Baldwin Avenue, between north of the 10 freeway and Valley Boulevard in EI Monte. This section of Baldwin Avenue will be closed starting May 13 and be in construction for approximately for 24 months. 6. PUBLIC COMMENTS ON ITEMS NOT LISTED ON THE AGENDA — None 7. CONSENT CALENDAR City Clerk Kuo pulled item 7A to correct meeting adjourn time. Mayor Pro Tem Blum moved to approve the Consent Calendar, seconded by Councilmember Chavez and unanimously carried. A. APPROVAL OF MINUTES The City Council is requested to review and approve: 1) Minutes of the City Council Regular Meeting of April 16, 2013; and 2) Minutes of the City Council Special Meeting of April 24, 2013. Action : Approved. B. PLANNING COMMISSION ACTIONS — MEETING OF APRIL 9, 2013 The City Council is requested to review the Planning Commission Actions of April 9, 2013. PUBLIC SAFETY COMMISSION ACTIONS — MEETING OF APRIL 10, 2013 The City Council is requested to review the Public Safety Commission actions of their meeting of April 10, 2013. PARKS AND RECREATION COMMISSION ACTIONS — MEETING OF APRIL 17. 2013 The City Council is requested to review the Parks and Recreation Commission actions of their meeting of April 17, 2013. Action: Received and filed. E. THIRD AMENDMENT TO THE CONSULTANT SERVICES AGREEMENT WITH WILLDAN ENGINEERING TO ASSIST IN CLOSING OUT PREVIOUS HOME IMPROVEMENT PROJECTS AND RE - APPROPRIATE $40,000 OF UNEXPENDED FUNDS FROM THE PRIVATE/SPECIAL CONTRACT SERVICES ACCOUNT (MANAGEMENT SERVICES) TO PRIVATE/SPECIAL CONTRACT SERVICES ACCOUNT (COMMUNITY DEVELOPMENT - HOUSING PROGRAMS) The Third Amendment with Willdan Engineering will authorize the consultant to conduct additional inspections for potential substandard work on past Home Improvement Projects (HIP) projects and provide the additional services to close-out previous HIP projects. Willdan will facilitate any close-out work to ensure that items are limited to work outlined in the original contract. The revised total budget estimate for the project close-out is $65,000, which requires the re -appropriation of $40,000 from the Private/Special Contract Services account (Management Services Department) to the Private/Special Contract Services account (Community Development Department — Housing Program); $7,000 for service delivery and $33,000 to correct potential substandard work. If the amendment is not executed and the additional funds are not allocated, this work would likely remain unaddressed. Since the HIP participants are on fixed incomes and they would be unable to do the repairs at their own expense. Action: 1. Reviewed and approved the Third Amendment (Attachment "A") in the amount City Council Minutes May 7, 2013 Page 4 of $7,000 to the consultant services agreement with Willdan Engineering (Attachment "B") to provide housing consultant services to close-out previous Home Improvement Program (HIP) projects; 2. Authorized the City Manager to execute the Third Amendment with Willdan Engineering (Willdan) with an amount not to exceed $7,000; and 3. Re -appropriated $40,000 (i.e., $7,000 for Willdan's Third Amendment, $33,000 to close-out remaining substandard work) of Private/Special Contract Services account (Management Services Department) to the Private/Special Contract Services account (Community Development Department — Housing Programs). F. VISA CARD REPORT The City Council is requested to review, receive and file the Visa Card Report. Action: Received and filed. G. ADOPTION OF RESOLUTION NO. 13-4909—APPROVAL OF PAYMENT OF BILLS The City Council is requested to adopt Resolution No. 13-4909 authorizing payment of bills. Action: Adopted Resolution No. 13-4909. 8. UNFINISHED BUSINESS — None 9. NEW BUSINESS A. ADOPTION OF RESOLUTION NO. 13-4908 TO UPDATE THE HOUSING ELEMENT OF THE GENERAL PLAN (Attachments A e C D E F G J Per state law, cities are required to update their housing elements periodically (i.e., every four to eight years) and the state's Department of City Council Minutes May 7, 2013 Page 5 Housing and Community Development (HCD) is required to review draft housing elements and report to the City preparing the draft whether it meets a number of state statutes applicable to local housing element content. HCD will "certify" adopted local elements that do so. City Council adoption of the proposed housing element update will establish policies and programs to meet the housing needs of all segments of the community and to accommodate the City's share of regional housing need in a manner consistent with state statutes. Moreover, adoption of the housing element update would entail a significant step toward an update of the Temple City General Plan as a whole, which is a priority project scheduled to begin in the next fiscal year. Community Planning Manager Deibel and City consultant Karen Warner, gave a brief presentation regarding the proposed City Housing Element. Mayor Sternquist opened public hearing. Jerry Jambazian, Temple City business owner, asked for clarification on how often the housing elements needed to be updated. Mayor Sternquist closed public hearing. Mayor Pro Tem Blum made a motion to approve the Initial Study of Environmental Impact and adopt the Mitigated Negative Declaration; and adopt Resolution No. 13-4908 approving the City of Temple City 2008-2014 Housing Element, seconded by Councilmember Yu and unanimously carried. 10. COMMUNICATIONS — None 11. RECESS TO SUCCESSOR AGENCY TO THE TEMPLE CITY COMMUNITY REDEVELOPMENT AGENCY MEETING At 8:38 p.m., the City Council recessed to the Successor Agency Meeting. Minutes of the Successor Agency Meeting are set forth in full in the Successor Agency's records. RECONVENE AS CITY COUNCIL The City Council meeting was reconvened at 8:39 p.m. with all Councilmembers present. 12. ACTIONS TAKEN BY CITY AS SUCCESSOR AGENCY TO THE TEMPLE CITY COMMUNITY REDEVELOPMENT AGENCY — None City Council Minutes May 7, 2013 Page 6 13. UPDATE FROM CITY MANAGER City Manager Pulido announced upcoming City events: May 8, application for Habitat with Humanity projects will be available starting tomorrow at Live Oak Park, Temple City Library and on the City's website; May 9, Neighborhood Watch Meeting, 5:30 p.m. at La Rosa Elementary School (For Area 8 residents bound by Olive St., Temple City Blvd., Encinita Ave. and the UPRR tracks); May 11, 18 and 25, Community Emergency Response Trainings (CERT), 9 a.m. in City Hall. The classes are free and open to residents ages 18 years and older. For more information, contact the Public Safety and Services Division at City Hall; May 14, Jazz Concert at the Park, 6 p.m. in the Temple City Park. Admission is free; May 4 Strategic Planning Session on May 20, 6 p.m., in the Council Chambers. City Manager Pulido also announced that since September, 2012, the City has received six awards at the national, state and local levels, recognizing the City Council and staffs efforts at elevating community services and promoting civic engagement. The City is now awaiting word from the Government Finance Officers Association on an award of excellence in financial reporting and transparency. 14. MATTERS FROM CITY OFFICIALS — None 15. Council Chamber Renovation Ad Hoc Committee (Councilmember Vizcarra and Mayor Sternquist) — Formed 1/15/2013 Councilmember Vizcarra announced that the Ad Hoc Committee has selected new chairs for the audience. G. Strategic Planning Ad Hoc Committee (Councilmember Yu and Mayor Pro Tem Blum) — Formed 4/2/2013 None H. Budget Ad Hoc Committee (Councilmember Vizcarra and Mayor Sternquist) — Formed 4/2/2013 The Ad Hoc Committee has met to reviewed the City's FY 2013-14 Budget. City Manager Performance Goal Ad Hoc Committee (Mayor Pro Tem Blum and Mayor Sternquist) — Formed 4/16/2013 None J. School District/City Standing Committee (Councilmember Chavez and Mayor Pro Tem Blum) — Formed 1/03/2012 The Standing Committee meeting in April was cancelled. A new meeting will be scheduled in May. K. Rosemead Boulevard Improvement Project Standing Committee (Councilmember Yu and Mayor Pro Tem Blum) — Formed 6/3/2011 None L. City Code Review Standing Committee (Councilmember Chavez and Vizcarra) — Formed 11/06/2012 City Council Minutes May 7, 2013 Page 8 The Standing Committee reviewed a proposed Ordinance relating to the City's Video Franchise Fees, Customer Services and Other Video -Related Matters. 16. COUNCIL ITEMS SEPARATE FROM THE CITY MANAGER'S REGULAR AGENDA A. COUNCILMEMBER CHAVEZ Reported on the Southern California Association of Government Conference he attended last week. B.
