I 18 -98 1 Date of Adoptio �' 3, 2018 RESOLUTION OF THE BOROUGH OF CARTERET, IN THE COUNTY OF MIDDLESEX, NEW JERSEY AUTHORIZING PLANNING BOARD TO CONDUCT A PRELIMINARY INVESTIGATION AND MAKE RECOMMENDATION AS TO WHETHER CERTAIN IDENTIFIED PROPERTIES CONSTITUTE AN AREA IN NEED OF REDEVELOPMENT, RE: BLOCK 402, LOT 24 & 25 AND BLOCK 301, LOTS 3,4 & 5 WHEREAS, the Borough of Carteret (the `Borough ") is authorized under the New Jersey Local Redevelopment and Housing Law, N.J.S.A. 40A:12A -1 et seq. (the "Redevelopment Law ") to determine whether certain property is in need of redevelopment; and WHEREAS, the Borough desires to authorize and direct the Borough's Planning Board (the "Planning Board ") to undertake an investigation to determine whether the area consisting of Block 301, Lots 3, 4 & 5, and Block 402, Lots 24 & 25 (collectively, the "Study Area ") constitutes an area in need of redevelopment under Section 5 of the Redevelopment Law; and WHEREAS, if the Study Area is determined to meet the criteria for designation as an area in need of redevelopment and the Borough so designates the Study Area, then the Borough shall be authorized to use all the powers provided under the Redevelopment Law for use in a redevelopment area, other than the power of eminent domain. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Carteret, County of Middlesex, State of New Jersey, as follows: 1. The aforementioned recitals hereof are incorporated herein as though set forth at length herein. 2. The Planning Board is hereby authorized and directed to undertake a preliminary investigation and conduct a public hearing to determine whether the Study Area is in need of redevelopment under the Redevelopment Law. 3. The Planning Board, following said preliminary investigation and hearing(s), is further authorized and directed make a recommendation to the governing body of the Borough, pursuant to N.J.S.A. 40A: 12A-6, as to whether the Study Area should or should not be determined by the governing body to be an area in need of redevelopment. In the event the governing body shall designate the Study Area as a redevelopment area, the Borough shall be authorized to use all the powers provided under the Redevelopment Law for use in a redevelopment area, other than the power of eminent domain. 5. A copy of this Resolution shall be forwarded to the Planning Board for action consistent therewith. Adopted this 3r day of May, 2018 and certified as a true copy of the original on May 4, 2018.
