HomeMy Public PortalAboutResolution No. 24 -024 - Resolution authorizing the placement of signage near or around the entry of the Wilmington Street canalSponsored by: Commissioner Kelley RESOLUTION NO. 24-024 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA, AUTHORIZING THE INTERIM CITY MANAGER TO TAKE THE REQUIRED STEPS FOR PLACEMENT OF SIGNAGE NEAR AND AROUND THE ENTRY OF THE WILMINGTON STREET CANAL; PROHIBITING THE USE WATERCRAFTS AND OTHER WATER ACTIVITIES WITHIN THE CITY LIMITS OF THE CANAL; PROVIDING FOR INCORPORATION OF RECITALS; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Chapter 16, Article II, Division 2, Section 16-63 of the City of Opa- Locka's Code of Ordinances provides: "No person shall swim, ski, dive, surf, scuba dive, fish or use boats in any area in any park or recreational area unless such area is specifically designated for such purpose"; and WHEREAS, the Wilmington Street Canal is located within the City of Opa- Locka ("City") and is a restricted canal from water activities and excessive use of watercraft in an area that has become a nuisance and poses a potential safety hazards; and WHEREAS, several verbal warnings have been issued to visitors, but have gone ignored by those who desire to frequent the area for boating, jet skiing and rafting; and WHEREAS, to ensure there is visible indication that these activities are prohibited, the Interim City Manager shall take all steps necessary to place signage near and around the entrance of the Wilmington Street Canal; and WHEREAS, violators shall be subject to enforcement as set forth in relevant sections of the City's Code of Ordinances; and WHEREAS, there are two entrances to the Wilmington Street Canal. It is estimated that in order to establish the appropriate signage of sufficient size at both entrances to the canal, the signage will cost Three Hundred Dollars ($300.00) per sign for a total of Three Thousand Dollars ($3,000.00), and Two Thousand, Five Hundred Dollars ($2,500.00) for material to restore berms that now impede access to the water; and WHEREAS, the City Commission of the City of Opa-Locka finds that it is in the best interest of the City and its residents to direct the Interim City Manager to take the required steps for placement of signage near and around the entry to the Wilmington Resolution No. 24-024 APPROVED AS TO FORM AND Burnadette Norris - City Attorney Street Canal prohibiting the use watercrafts and other water activities in the canal. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF OPA LOCKA, FLORIDA: SECTION 1. RECITALS ADOPTED. The recitals to the preamble herein are incorporated by reference. SECTION 2. AUTHORIZATION The City Commission of the City of Opa-Locka hereby directs the Interim City Manager to take the required steps for placement of signage near and around the entry to the Wilmington Street Canal and continue prohibiting the use watercrafts and other water activities within the canal. SECTION 3. SCRIVENER'S ERRORS. Sections of this Resolution may be renumbered or re -lettered and corrections of typographical errors, which do not affect the intent of this Resolution may be authorized by the Interim City Manager, following review by the City Attorney, without need of public hearing, by filing a corrected copy of same with the City Clerk. SECTION 4. This Resolution shall take effect upon the adoption and is subject to the approval of the Governor or Governor's Designee. EFFECTIVE DATE PASSED and ADOPTED this 15th day of Februar 2024. Staff Summary: Section 16-63 of the Code of Ordinance states "No person shall swim, ski, dive, surf, scuba dive, fish or use boats in any area in any park or recreational area unless such area is specifically designated for such purpose". The Wilmington Street Canal is restricted from water activities and the excessive use of watercraft in this area has become a nuisance and poses a potential safety hazard. Several verbal warnings have been issued and ignored from patrons who frequent the areas to engage in boating, jet skiing and rafting. To ensure there is visible indication of the prohibition of watercraft, the Interim City Manager shall take all steps to place signage near and around the entrance of the Wilmington Street Canal. It is estimated that to establish the appropriate signage of sufficient size at both entrances will require ten signs at $300 per sign for a total of $3,000 and $2,500 for material to restore berms to impede access to the water. This will be charged to the Beautification & Maintenance Division, Ground Maintenance Department (39-541462) which has $19,415 available.
