HomeMy Public PortalAboutr 18-106YU501utivu Of th �Vrough of Tar t eref, N- Di- No. 18 -106 Date of Adoption %y 17, 2018 RESOLUTION AUTHORIZING A PROFESSIONAL SERVICES CONTRACT FOR ENGINEERING SERVICES WITH T &M ASSOCIATES CONCEPT PLAN DEVELOPMENT & STORMWATER MANAGEMENT PLAN FOR THE FORMER AGRICO SITE WHEREAS, the Borough of Carteret is in need of engineering services with regard to the concept plan development and stormwater management plan for the former Agrico site project; and WHEREAS, the Borough's Consulting Engineers, T &M Associates, possess the requisite skill and expertise for said services; and WHEREAS, T &M Associates has submitted a proposal to provide said engineering services at a total cost not to exceed $9,500.00; and WHEREAS, the Mayor and Council have reviewed said proposal; WHEREAS, the Chief Financial Officer has certified that funds are or will be available for said purpose. Account # 2 -01- 20-165 -254 NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Carteret, County of Middlesex, State of New Jersey, as follows: 1. That the proposal from T &M Associates for engineering services with regard to the concept plan development and stormwater management plan for the former Agrico site project at a total cost not to exceed $9,500.00 at the rate set forth in T &M's existing contract with the Borough is hereby approved. 2. That annexed hereto is a copy of said proposal. 3. That this action is approved as an award of a professional services contract pursuant to N.J.S.A. 40A:11- 5(1)(a) in accordance with the Borough's Fair and Open Process as authorized by law. 4. That a copy of this resolution be forwarded to the Borough's Purchasing Department, T &M Associates and Borough Director of Engineering. DuPont Corp) Dear Mr. DuPont: As requested, we are providing herein a scope of services and fee estimate for updating the original concept plan as requested by DuPont Corp and a pre - application conference with NJDEP and DuPont Corporation's professional team for the new stormwater management facilities. Due to the unknown stormwater management program requirements, some of which will be determined by the NJDEP during the pre -app, we are proposing to advance the stormwater design in a couple of steps. The initial step is presented herein. Scope of Improvements Per our discussions and consensus of the Borough waterfront development team reached at our March 19 project design review meeting, the new stormwater management facilities will consist of a bio infiltration swale immediately west of the Greenway and stone revetment currently being constructed by the DuPont Corp. The proposed improvements will result in the elimination of the proposed 10:1 sloped transition area between the bio swale and the Greenway. The revised concept plan will meet the minimum regulatory requirements associated with the remedial action taking place at the site including installation of the environmental DGABC cap. Based on recent discussions with Borough and DuPont Corp professionals, there is general agreement for all parties to work together to effectuate the environmental cap change and related plan and permit revisions for the ongoing project. The DuPont site engineer Geosyntec is taking the lead to schedule an NJDEP pre - application meeting for the proposed project changes and the addition of the required stormwater management system. DuPont Corp) May 1, 2018 Page 2 NJDEP will require a more detailed concept stormwater management plan prior to scheduling the pre -app for the project. It is recommended the Borough have a representative accompany us to the pre -app. With the addition of the bio Swale and as presented on the Borough approved concept stormwater plan, a new outfall is planned into the Arthur Kill. This new outfall will require an ACOE Jurisdictional Determination and an Individual Permit. At the NJDEP pre -app, guidance is expected on locating the new outfall and if there is a need to combine the outfall with the future ferry terminal stormwater outfall. Significant coordination is also needed with the DuPont professional team, Maser Consulting relative to the Riverwalk, and Borough officials to update the concept plan and the stormwater facility permits and approvals. Scope of Services Based on the above outlined project scope, we proposed to provide the following initial scope of services; 1. Base maps and design plans will be obtained from Geosyntec and Maser Consulting for their respective waterfront projects to refine the concept plan. 2. We will coordinate and define project engineering and permitting responsibilities with DuPont Corp and their professional team. 3. The stormwater concept plan will be revised to provide a bio infiltration swale /rain garden and new stormwater outfall into the Arthur Kill. The update concept plan will be reviewed with the Borough for concurrence and approval and will then be submitted to DuPont Corp and its site engineer Geosyntec for submission to the NJDEP Land Use for the pre- application meeting. 4. T &M will identify all required project permits and approvals including the anticipated ACOE Jurisdictional Determination and Individual Permit and NJDEP Waterfront Development Permit or amendment. Once the required permits are determined, we will coordinate and define roles and responsibilities with Geosyntec and DuPont Corp. 0 0 'fir CART -02517 Le: John P. DuPont, P.E. We will attend the NJDEP and Site Remediation Group pre -app along with representatives of Geosyntec and advocate on the Borough's behalf for the proposed stormwater facilities plan. 6. We will attend two meetings with Borough officials to present the updated concept plan and review the NJDEP pre -app recommendations. Exceptions Field survey will not be provided nor are they expected to be required for this initial scope of services. Design or geotechnical engineering services other than the revised concept plan are not included. Our scope of services does not include preparation of permits or agency fees. Any services not stated herein are specifically excluded from this scope of services. Summary of Fees and Schedule The fees for our services listed above are estimated at a not to exceed cost of $9,500. Any agency permit fees are to be paid directly by the Borough and are not included in our estimated fee. Upon authorization, we will initiate the preparation of the revised concept plan immediately, review the plan with the Borough for its approval. Once approved, we will submit the concept plan to Geosyntec for their submission to the NJDEP and Remediation Site Group as required to be able to schedule the pre -app meeting. A typical pre -app meeting will take from 3 to 4 weeks to schedule. We will provide the Borough and its project team with an update immediately after the pre -app is completed. Prior to proceeding with any work beyond the above outlined initial tasks, we will submit a second phase scope of services for Borough authorization.
