Power & Light Plant, met in regular 3 session January 17, 1983 at the hour of 7 :00 p.m. in the Municipal Building 4 of said City. Vice Chairman Hankinson presided with the following members 5 present: Messrs. Elstro, Williams, Ms. Henry, Hankinson, Welch, Mills, Parker 6 and Paust. Absent: Carter. The following;;business was had, to-wit: 7 8 APPROVAL OF MINUTES OF JANUARY 3, 1983 9 10 Councilman Hankinson moved to approve the minutes of the previous meeting as 11 published, seconded by Councilman Mills and on unanimous voice vote the motion 12 was carried. 13 14 APPROVAL OF BILLS 15 16 Councilman Hankinson moved for approval of the following payroll, bills, trans- 17 fers and investments as published in the agenda, seconded by Councilwoman 18 Henry and on unanimous voice vote the motion was carried. 19 20 Approve the following: 21 Bills in the amount of 1,346,054.45 22 Bonds and Interest Coupons 16.25 23 2 Payrolls 399,575.36 24 25 Transfers from Cash Operating Fund to: 26 Bond Sinking Fund 68,151.87 27 Cash Reserve Fund 91,162.75 28 29 Transfer from Depreciation Reserve Fund to: 30 Cash Operating Fund 219,850.74 III 31 32 Investments Purchased 33 Bond Reserve Fund 279,506.00 34 Bond Sinking Fund 64,808.87 35 Cash. Operating Fund 1 ,696,570.00 36 Cash Reserve Fund 497,621.13 37 Depreciation Reserve Fund 1,554,270.00 38 39 REMARKS BY CHAIRMAN 40 41 Chairman Welch noted the monthly meeting of the Executive Committee will be 42 January 24, 1983 at 7 :00 p.m. at RP&L. 43 44 COMMITTEE REPORT 45 46 Councilman Larry Parker, Chairman of the Street Light Committee reported on a 47 meeting his committee had with Mr. Huffman, Mr. Mays, Mr. Rao and two people 48 from the State Department, Les Locke, a lighting engineer and Larry Rust, a 49 traffic engineer concerning interstate lighting and the repair that are billed 50 to the city. It is lumped into two separate bids - one is for routine main- 51 tai-nance that is billed to the city for cleaning and repair of the lights. 52 The other is for major and emergency repair which is billed to the state. 53 That would not include tower replacement. Various alternatives were discussed 54 for saving the city money by RP&L taking over. We could take over the routine 55 maintainance for a saving of about 40% or a $6,000 to $8,000. per year. There 56 are 138 lights and the cost to the city last year was $20,270. We should 57 have no trouble getting the contract. Contracts are being negotiated now and 58 go into effect April 1. 59 60 REPORT BY GENERAL MANAGER 61 Indiana Municipal Power Agency Report 62 63 Irving Huffman, General Manager, reported that the Agency appeared before the 64 rating agency and received a rating of "A" from Moody and "A minus" from Stand- 65 and & Poor, which they consider to be good for a first time issue. The bonds RP&L Minutes Cont'd. January 17, 1983 Page 2 1 will apparantly be taken up fast. The average interest rate is almost 10.3% 2 for a thirty (30) year period. We have worked out an agreement with the 3 Indiana Municipal Power Agency on Richmond becoming the dispatching point and 4 we are working on some other contract language for reimbursement which will be 5 of benefit to Richmond. 6 7 Opening of bids for Truck Chassis and Bodies 8 9 City Attorney Ed Anderson stated he does not find the legal ad to be in order 10 in accordance with the notice statute IC 5-3-1 which states "if the event is 11 the receiving of bids, notice shall be published two (2) times, at least one (1) 12 week apart, with the second publication made at least ten (10) days before the 13 date the bids will be received." The publisher's affidavit from the Palladium- 14 Item shows that the bid ran only one (1) time, which date was January 8th which 15 was ten days but not from a second date of publication. Mr. Anderson said, in 16 his opinion, the Chairman should rescind all action under the bidding statute, 17 and in Indiana Statute 36-1-9-1, the law does exempt you from the bidding 18 process as "this chapter does not apply to purchases or leases made by muni- 19 cipally owned utilities." Mr. Anderson offered the opinion that the Chairman 20 should call for a motion to rescind the action under any bidding process and 21 that you now proceed under this Statute and treat these bids as offers to enter 22 into a contract with RP&L for the purchases of the several items. 23 24 Councilman Mills moved to rescind the bidding process and to accept the offers 25 submitted as interested offers under the specifications, seconded by Councilman 26 Hankinson and on a call of the roll the motion was accepted by the following 27 vote: Ayes: Elstro, Williams, Henry, Hankinson, Mills, Parker, Paust, Welch. 28 Noes: None.
