Norris, H. Bayer, W. Schempf, E. Fortini. ALSO PRESENT: P. J. Waldock, Village Planner S. Hart, Secretary Chairman Sobkoviak called the meeting to order at 7:00 p.m. Roll call was taken. Chairman Sobkoviak declared the minutes of the December 17, 1991 meeting approved with the following correction: Typographical error, meeting was repeated twice. Delete last instance of meeting. OLD BUSINESS: None. NEW BUSINESS: CASE NO. 338-021192 V OWNER: Anthony Consola REQUEST: Variations to allow a lot split of a home site currently occupied by two homes with a rear setback of four feet where ten feet is required. LOCATION: 407 N. Illinois Street and 406 W. Ottawa Street P. Waldock summarized his report as follows: The subject site is located at 406 West Ottawa, and 407 N. Illinois it is a corner location. The subject site is made up of two parcels occupied by two structures. Each lot is 12,000 square feet in area. The primary residence is an "L" Shaped Ranch style house, which encroaches over the property line segregating the two properties. The applicant is requesting a lot split, ultimately, before he can do that, a Variance is required to provide a lot line separating the two parcels, to separate the ownership. The ultimate goal is to sell the two story frame dwelling, separately from the single family ranch. The request is one of paper work only, there is no new construction related to this project. This is simply a formality to allow for future separation of the two dwellings. When the property was purchased by Mr. Consola from Mr. ~~/~-a, it was sold as a package, it was Mr. that expanded the ~~. single story dwelling across the lot line, this is not a self created hardship. The present owner did not reate the situation. aa'~, ca-- ZONING BOARD OF APPEALS MINUTES MARCH 17, 1992 Page 2 We are looking at two specific variations, one a set back of four feet from the rear of the two story frame dwelling, also a four foot set back for the east wing of the larger dwelling. There are eight feet eight inches between the two residences. The lot split would establish a new lot line which would be roughly 4 feet 4 inches setback for each residence. The newly created lot will have a lot area of 5,968 sq ft. This is roughly half of what the Village ordinance would require. In this case, because there is no new construction associated with it, staff findings are as follows: 1. The variance if granted will not change existing conditions in the neighborhood. 2. The variance is intended to correct an existing encroachment situation established by a previous owner. 3. The variance if granted will not provide a negative impact an the neighborhood. Therefore, Staff is recommending approval of the variation to allow a four foot setback where a ten foot is required to accommodate a lot split, establishing an 80' X 74'6" lot of 5,968 sq. ft. CHAIRMAN SOBKOVTAK: Are there any questions of the applicant or the Planner? M. KRIPPEL: When will conformance take effect? How is it used now? A. CONSOLA: It is presently used as two family, I want to sell it as a single family. P. WALDOCK: Land use was not considered in my report. The two family use is an existing use. That type of conversion has been accepted as being grand fathered. This is the condition in which the applicant purchased the property. The Variance does not relate to the land use, they are two separate issues. CHAIRMAN SOBKOVIAK: If there are no other discussions or questions, the chair will entertain a motion. H. BAYER: I move that we recommend to the Village Board, that the variance should be granted. D. NORRIS: Seconded.
